In this case, we must decide if our state statute limiting civil marriage to a union between a man and a woman violates the Iowa Constitution, as the district court ruled. On our review, we hold the Iowa marriage statute violates the equal protection clause of the Iowa Constitution. Therefore, we affirm the decision of the district court.

...The plaintiffs produced evidence to demonstrate sexual orientation and gender have no effect on children raised by same-sex couples, and same-sex couples can raise children as well as opposite-sex couples. They also submitted evidence to show that most scientific research has repudiated the commonly assumed notion that children need opposite-sex parents or biological parents to grow into well-adjusted adults. Many leading organizations, including the American Academy of Pediatrics, the American Psychiatric Association, the American Psychological Association, the National Association of Social Workers, and the Child Welfare League of America, weighed the available research and supported the conclusion that gay and lesbian parents are as effective as heterosexual parents in raising children.

...When individuals invoke the Iowa Constitution's guarantees of freedom and equality, courts are bound to interpret those guarantees. In carrying out this fundamental and vital role, "we must never forget that it is a constitution we are expounding." M'Culloch v. Maryland, 17 U.S. (4 Wheat.) 316, 407, 4 L. Ed. 579, 602 (1819). This is fully expected in the nutbar places like New England and California. But Iowa? This is about as disturbing a news article as I could have ever imagined.

Prop 8...make it a constitutional change and the black robes can't be run by the lavender mafia. California doesn't do a lot right, but we got it correct here. (this time)

.....but I think they ruled that is was a violation of the UNITED STATES Constitutional rights.......so a local Constitutional change is irrelevant.

Prop 8 will be overturned by the end of the year. It will be overturned by boomer judges and politicians like Jerry Brown who just do what they want. People don't change unless they have to.

That is what happens when Iowa has governors like Vilsack and Culver appointing the Supreme Court. Iowa was the second state to have gay marriage, after Massachusetts. Both were imposed by the courts.

State Constitution. Haven't read the whole opinion yet, but in discussing the separation of powers they do say that "the power of the constitution flows from the people, and the people of Iowa retain the ultimate power to shape it over time." To me that means they are saying that if the people amend the state Constitution banning gay marriage, they will be bound by that amendment.

No way in hell a State Supreme Court ruled the US Constitution allows gay marriage.

Courts in middle-of-the-road states can be taken over, too.

State supreme courts rule on state constitutions, at least in most cases. Federal courts deal with the U.S. Constitution.

I have no problems with gays getting married. They just have to marry someone of the opposite sex, just like normal people. No special privileges for them!

It's soon coming time. Imagine a subset of the current landmass of the USSA establishing a Constitutional government where:

Only the Constitution and the Bill of Rights are ratified.
Anyone currently serving in a federal gov't position is banned for life from the gov't.
All federal laws are repealed, ready for Congress #1 of the New USA republic.

In Iowa, an amendment to the state Constitution has to be proposed by 2 successive legislatures before it goes to a referendum. This means that a referendum cannot happen until 2011 at the earliest. To make matters worse, the Dems control the state legislature and will likely block any vote on a constitutional amendment.

Quite right...courts in smaller, less populous states can be taken over actually more easily than in bigger states....witness the town in I think it was Oregon where a bunch of Moonies moved to, enmasse, and then had the votes to elect their own people to the town's elected offices and so took over the town govt.

And yes, the regular manner in which one or two non-elected "judges" ("czars"?) trump the will of the people (shown via voting results) as well as ursurp legislative powers that do not belong to the judiciary show the USA is much more the fascist dictatorship than the kind of govt of the people it was founded to be.

We could call the future of the USA the "4th Reich" or some such...USSA?

Well past time to move the presidential primaries out of Iowa.

State Courts frequently rule on rights under the U.S. Constitution and Federal Courts have ruled that not only do states have the right to do so but such cases cannot be removed to federal court just because the Constitutional right being ruled on is a right under the U.S. Constitution. These decisions can be appealed to SCOTUS.

Amend their Constitution to outlaw it. Same as all the other states are doing.

How long will Americans who love God and one of His best creations, the original US Constitution and its Bill of Rights, remain passive to the corruption of America? How long will we citizens stand by while the left socializes the economy and society? How long will we tolerate their massive spending and debt which makes us and our unborn children paupers?

Where is the outrage and push back? There were dozens of court challenges and debates back in the 1930's when Roosevelt expanded executive power, none now? Is it because we know the courts are corrupt? If so, what other means will we use to regain our shining city on a hill?

This is scary. Unlike Massachusetts, Iowa is an agricultural breadbasket. Watch crop yields plumett now. God takes His revenge in many ways. Just ask those people burned out of their homes (or had their crops dry up from drought) in California. Russia's crop yields plummeted too, once she became an atheistic nation in 1922.

I don't understand what is happening. I guess I would be considered old, at 60 I guess I am old fashioned. Why is it that if the majority of people are against queer marriage (I refuse to call it gay) how is it that we put up with it. Where are our conservative elected leaders. Why is it that none of them are putting their jobs on the line in defense of OUR standards. The silent majority if one exists needs to make some noise.

I am beginning to believe that there is no silent majority. The queers and the unemployed are running the country. I am a slave, 2/3rds of my taxes go into the pocket of someone else.

It is time for a lot more than a tea party, it is time for a revolt. If judges realize that they have to answer to the majority and the majority is not queer perhaps they will change their opinions/rulings. Because the press makes the most noise and because the majority is silent they think they are doing what we all want. They believe that those against queer marriage are a misguided few.

We've got to start making some noise. I'm not saying that it is time to get out the guns, but it would be nice if someone could lead us in the right direction to be heard.

The Iowa governor and legislature should tell the Iowa Supreme Court, in effect, "go to hell, we're not doing a damn thing to make same-sex marriage legal", just like old Andy Jackson did with the SCOTUS regarding the Cherokee. The Iowa Supreme Court has no "divisions", so it cannot enforce its decrees if no one goes along.

i love that he wants the "pro-family" theocrats to re-focus their arguments away from "religious freedom" and "traditional families" and instead concentrate on "conveying the monstrous evil of homosexualism (LOVE that word, btw) in our midst" and that homosexuality is "changeable" and that "homosexuals eat babies".  um, isn't that what the westboro baptists already do?  great, go for it!!  and take the FRC, CWA, and AFA with you where they belong.  they're already playing footsie with registered hate groups, so why not use this iowa marriage equality issue as an opportunity to make that final move already--to the FRINGE.

what effect will this have on Obama and the 2012 primaries?
With the Iowa supreme court's unanimous ruling today that it is unconstitutional to deny marriage to same-sex couples, and with the New Hampshire legislature on the brink of voting the same sentiment, the civil rights terrain has changed in the early bellwether states.

Further, there is little chance that Iowa or New Hampshire will become anti-equality amendment gotv circuses.

The way is now open for all good civil rights attorneys and scholars of constitutional law to show their spine.  The excuses are fast fading.

Who would be able to challenge Obama from the right
in a democratic primary?  I guess Clinton might be able to, but attacking gay marriage isn't going to help her much with her base voter demographic, either.  

If Obama gets a primary challenge, it will be from the left, and it will be because he's been ineffectual by going too small on the stimulus, and the double standard of hardballing the employers of working people while coddling large financial institutions.

have to take a stand on marriage equality (and other things) with a challenge from the left. He will not be able to split the difference (against gay marriage/against Proposition 8) as he did in California.

Yes, but this only happens if he gets an actual challenge from the left.
And I do wonder how likely a serious primary challenge from the right or left is.  The most recent time that a sitting president of either party had a legitimate primary challenge was when Ted Kennedy ran in 1980.  Before then, you have to go to the LBJ disaster in 1968.  

But I still say that a challenge from the right, particularly on this issue, is very unlikely.  Obama's governed way too close to the center thus far.

the challenge will come from the electorate
who expects him to keep up with their progress.  a large chunk of his '08 supporters will no longer put up with his wishy washy backsliding non-position on civil rights.  that position will no longer be tenable next month, let alone in '12 when a growing swath of the country supports equality.  it's time for him to stop promoting Jim Crow, and join the 21st century.

Who's their candidate?
Who will even run to get their support?  Much of the Democratic base was pretty furious at Clinton, and despite this, Bill Bradley lacked the ability to fundraise or get media attention to be a viable threat to Al Gore.  

I'm pissed at Obama too.  I didn't vote for him in the primaries, and was not particularly surprised with how he has governed.  But he's the Democratic nominee in 2012 in all but the most extreme of circumstances.  It is very rare for a sitting President to even have a serious challenger for the party's nomination, and even rarer for the sitting President to lose the renomination contest (I believe LBJ in 1968, and that weird stolen Republican primary in 1912 are the only examples).  

If a parimary challenge to Obama is to happen, we need to be thinking about nominees NOW, and start drafting them as soon as the midterms are over.  It's a nigh-impossible uphill battle that won't just magically come from the electorate.

Obama will not get a dime from me, or support,
  I will support who ever is going against him in a primary or a third party candidate.  As I wrote in another thread, he could have at least mentioned the Uniting American Families Act and pushed for this Legislation to go through the House and Senate a bit faster, and he didn't even to that.

He has kicked all LGBT issues to that dreaded back burner.  Just like the one turd during the VT testimony yesterday, 'What is waiting one more year going to hurt?'

 Well gee whiz, when you have been denied your civil rights for ALL YOUR LIFE, one year is a BIG DEAL.  

 Lets see, it would be one less year of your life that you had equal rights, but this doesn't make sense to those who have never experienced discrimination before. Typical dip shits.  

 I will stand by my word, there is no way in hell 'god is in the mix' Obama will get my support, bring on a challenger in the primary or a third party candidate.

If I make sense? it was quite by accident.

I have been saying this for months. My October 26th letter to the Obama/Biden campaign:

To Senators Barack Obama and Joe Biden, and the campaign staff:

Stop emailing me.

I am not interested in supporting your campaign.

I am a registered voter and consider myself a Democrat, though I am seriously reconsidering that. For the last umpteen years, the Democrats have continually thrown LGBT people under the bus, counting on automatically getting our votes because "Republicans are worse." Neither Sen. Obama nor Sen. Biden voted to help same-sex couples hurt by hateful, discriminatory immigration policies. You were all too willing to leave my transgender/intersex brothers and sisters out of ENDA. You were unwilling to fight George W. Bush on the Matthew Shepard Act. Where is your support for foster children who need stable, loving homes, no matter the gender of the parents involved? Do you ever think about the thousands of gay teens who run away from religious homes and hateful parents because they face violence if they stay? These kids need your help, too. You do not speak out against the violence perpetrated upon LGBT people every day. Where were you when Angie Zapata was murdered by a man who referred to her as an "it?" What fine words did you have for people who thought that 14-year-old Lawrence King deserved to die at the hands of his classmate for being gay?

You're so concerned with the economy and lowering taxes on the middle class. Yet you neglect to acknowledge that civil marriage means an automatic tax deduction for couples at the federal and state levels. Healthcare costs are crippling families, yet you are not speaking out on behalf of same-sex couples and families who can't get comprehensive healthcare because of bigoted state and corporate policies.

Newsflash: keeping LGBT people and same-sex couples a lower class of citizen means we get treated as sub-human on every issue, at every level. Not every family around that now-infamous kitchen table is Mommy, Daddy, and 2.5 kids, no matter how much your campaign ads would like to project.

Though Joe Biden spoke against Prop 8 in California on the Ellen show, your campaign has not diverted any funds to the No On 8 effort. The DNC has not, to my knowledge, donated any funds in the fight to maintain marriage rights on California, or to the fights against Prop 102 in Arizona or Prop 2 in Florida. Though Sen. Clinton just this weekend held a campaign rally in Florida, speaking against Prop 2 to a crowd of equality supporters, the DNC has not been willing to put its money where its mouth is.

When I hear Barack Obama tell the media that he thinks "separate but equal" is all right in regards to civil marriage, I feel sick. And then he sends an anti-gay Prop 8 supporter out to woo religious voters over to his side. What message does that send? "God is in the mix?" When did Barack Obama's personal Jesus become a marriage license issuer at any State office? What is wrong with this man? Have we not learned that when Church defines State policy, people get hurt? Christianity was used to justify slavery in America. That a black man would use that same argument to continue legislating against a group of his constituents boggles my mind. It makes me dismiss the veracity of his message of hope and change. He appears to be as big a hypocrite as his Republican counterparts.

Based on these words and actions, I have no confidence that an Obama presidency would do anything to advance the cause of civil equality for all in this country. Oh, you'll be better than Republicans, who actively want to see us "re-educated" or killed or deported in the name of their god, but you are more than content to leave the status quo in place. For those reasons, I ask that you remove me from your email list.

In closing, screw you. You're not getting any campaign donations from me. I gave what money I could spare to fight homophobic bigots in California, Arizona, and Florida.

Iowa continues to be a leader in guaranteeing civil rights

This is a joint statement from Iowa Senate Majority Leader Mike Gronstal and Iowa House Speaker Pat Murphy on today's Supreme Court decision:

"Thanks to today's decision, Iowa continues to be a leader in guaranteeing all of our citizens' equal rights.

"The court has ruled today that when two Iowans promise to share their lives together, state law will respect that commitment, regardless of whether the couple is gay or straight.

"When all is said and done, we believe the only lasting question about today's events will be why it took us so long.  It is a tough question to answer because treating everyone fairly is really a matter of Iowa common sense and Iowa common decency.

"Today, the Iowa Supreme Court has reaffirmed those Iowa values by ruling that gay and lesbian Iowans have all the same rights and responsibilities of citizenship as any other Iowan.

"Iowa has always been a leader in the area of civil rights.

"In 1839, the Iowa Supreme Court rejected slavery in a decision that found that a slave named Ralph became free when he stepped on Iowa soil, 26 years before the end of the Civil War decided the issue.

"In 1868, the Iowa Supreme Court ruled that racially segregated "separate but equal" schools had no place in Iowa, 85 years before the U.S. Supreme Court reached the same decision.

"In 1873, the Iowa Supreme Court ruled against racial discrimination in public accommodations, 91 years before the U.S. Supreme Court reached the same decision.

"In 1869, Iowa became the first state in the union to admit women to the practice of law.

"In the case of recognizing loving relationships between two adults, the Iowa Supreme Court is once again taking a leadership position on civil rights.

"Today, we congratulate the thousands of Iowans who now can express their love for each other and have it recognized by our laws."

Iowa requires TWO consecutive Legislative approvals
in order to amend their Constitution.  It will take at least two more years for them to get it on the agenda for a vote by the people, but only if the State Legislature agrees in two separate legislative terms.  They are not going to address it this year as the legislature is about to recess.  That means at least three years from now if they do agree to amend their Constitution.

Amendments need to be approved by simple majorities in both the House and Senate in two consecutive general assemblies, then must be approved by a simple majority of voters in the next general election. Each general assembly lasts for two years. This year [2008] is the second year of the current general assembly. That means if an amendment is approved this year and in the 2009 or 2010 legislative session, it can be on the general election ballot in November 2010. If lawmakers wait until 2009 to start the amendment process, the earliest that a proposed amendment could reach voters is November 2012.

As many of you are already aware, we were victorious in Iowa today.  In response, we are having a celebratory rally on the south side of Union Square at 6:30pm tonight.  The overall tone of the evening will be a celebration, but we must make everyone who attends aware of the steps we must take in our OWN state to achieve such a victory.  While today's victory in Iowa does not directly effect us in NY, it does on a NATIONAL level.  If at all possible, it would be great if everyone could post something about the event tonight or shoot out an email blast.  To show the opposition our strength, we must let them know that we care and are passionate about our fellow LGBTQ members across the nation.

But the supreme court got the case from a 2007 case where the ban on same-sex marriage was overturned. (cf., http://www.msnbc.msn.com/id/20... In 2007, the decision was active for about 2 hrs before marriages were put on hold pending the supreme court's decision. But, in that period, there was a couple that was able to get married.

Nitzschke explained that although his group wants gay marriage banned, Overton's sign wasn't projecting the right image. "Oftentimes, it's not just what you say, it's how you say it," Nitzschke told Overton. "It's not out of hate that we do it, it's out of compassion."

Overton was reluctant to put down the sign. In an interview, he said he was outraged that a few Supreme Court justices could decide such an important issue. "This country's going down the tubes," he said. "We the people haven't been heard."

By 2013, dea volente, we'll be done with DOMA and DADT and people will be much more used to marriage equality.  

Plus, Iowans are among the most educated Americans and have a strong libertarian streak.  

I have a feeling marriage equality will hold there permanently.  


The fact is...
An amendment will not see the light of day in the Iowa legislator.  Iowa, is a midwest state, in that it is not referendum based.  Referendums are rare, changing the states constitution for any reason, would be an exceptional occurance.  If the supreme court makes a decision on constitutionality with regards to an issue, it almost never happens that it is overturned by the legislature. The Iowa constitution is written in a way to make amendments extremely difficult. Iowa is not exposed to the irrationality of the referendum like California with regards to constitutional issues.  

So this is in fact a lasting victory, it is not like California where you will be left disappointed months down the line.

A little about why this is doubly wonderful for me.
First, obviously I believe in equal right for all, but judging from my comments on this thread you might denote a little more glee in my comments than usual.

From 2003-2005 I was the religion reporter for the Cedar Rapids Gazette. I opened up the coverage of the religion Saturday feature page and wrote stories no one had written previously.

Groups that had never talked to a Gazette reporter talked to me and, while I did features on patriarchal Christian families and FOUR stories on Gibson's "Passion of the Christ," I also wrote features on Wiccans and Atheists among other marginalized groups.

Unbeknownst to me this disturbed the local evangelical alliance very much. At some point they sent a delegation to our chickenshit editor Mark B., to express their concern that I was not an evangelical Christian - in almost those words.

To his everlasting shame, Mark, instead of throwing them out of his office, went to his knees and promised he would make sure that my coverage would remain impartial (and it always was). But then, being on his knees was common for him.

Well you know these people - you have to be with them 100 percent or you are an enemy. They became a thorn in my side until I resigned out of frustration.

So today I sit here and wonder what kind of pain these hypocritical bunch of Eastern Iowan Christofascists are in today.

And I am smiling. The good guys won a big one today.

Iowa Delivers: A Big Win & A Big Question
This is good news, and is just the kind of fortification that our movement needs. But it also raises big strategic questions for the national LGBT movement.

We have been operating on the (flawed) premise that the only way to win marriage equality is to make incremental gains in the nation's most progressives states, while more or less ignoring regions like the Midwest and South because they are deemed unwinnable. This ruling offers further evidence that this is a misguided path.

It's misguided for the same reasons that the Democratic Party was off-base in its insistence between 2000 and 2004 that it could the win the White House by campaigning in only 16 states. You don't win a national campaign by simply flying over the majority of the nation as you hop from White Parties in Miami to black tie fundraisers in DC to opening night screenings of MILK in San Francisco. You win a national campaign by working in all 50-states and devoting resources to states like Iowa and North Carolina, which have been overlooked because of a thin reading of regional trends and which possess the potential for wins like this. Our national organizations need to get this, and quickly.

This ruling is the result of people and organizations, including Lambda Legal and One Iowa, pursuing a a true national strategy. The more we do this, the more we will win.

Just read article that the 'LOVE MAKES A FAMILY' Group in Connecticut has voted to disband except for helping GLBT candidates get elected.

"Here we go again," said Barber. "While citing the specter of 'equal protection,' the Iowa Supreme Court today has unanimously joined a leftist gaggle of ideologically driven judges in California, Massachusetts and Connecticut, creating, from thin air, a phantom 'right' to the ridiculous, oxymoronic and postmodern 'gay' marriage counterfeit

"Although, not controlling here" continued Barber, "the U.S. Supreme Court long ago rejected the untenable notion that 'equal protection' requires two biologically incompatible persons to be permitted to 'marry.'  Marriage, of course, by its very spiritual, historical and biological nature, requires binary compatibility. It is no more discriminatory to disallow two men from marrying each other, than it is to prohibit a man from marrying his house plant.    

In Baker v. Baker v. Nelson was decided in 1971; the SCOTUS use of a dismissal rather than refusing certiorari did make it an official pronouncement that the court at that time was not willing to extend its decision in Loving v. Virginia to require marriage to be gender as well as race neutral.

The times have changed since 1971, and Baker has to be read in the light of Justice Scalia's dissent in Lawrence v. Texas - striking down the sodomy laws will inevitably lead to recognition of same-sex marriage, despite the reluctance of the Lawrence majority to go quite that far.

In 1971, it had been only a couple of years since the Stonewall riots.  The whole gay rights movement was in its infancy.  The society was not yet ready to accept the idea of human rights for gay folks.

Matt Barber and his ilk don't deserve any more rights than they would be willing to grant to people who are different from themselves.  If Barber is a Christianist, I can imagine seeing his face on the Day of Judgment when he finds himself numbered among the goats.  Perhaps, like Dives, while burning in the Hell to which he is condemning himself, he will look to a someone he oppressed to slake his unquenchable thirst, but will learn of the uncrossable gulf between them.

Update - THREE WEEKS!
From the Register:

The Iowa Supreme Court this morning upheld a Polk County judge's 2007 ruling that marriage should not be limited to one man and one woman.

The ruling, viewed nationally and at home as a victory for the gay rights movement and a setback for social conservatives, means Iowa's 5,800 gay couples can legally marry in Iowa beginning April 24.

There are no residency rules for marriage in Iowa, so the rule would apply to any couple who wanted to travel to Iowa.

Shelly Wolfe and Melisa Keeton, who waited for word of the ruling outside the Polk County Recorder's Office, immediately called their pastor anyway to make plans.

"We're going to make it legal," Keeton, 31, of Des Moines said.

SO. . . I e-mailed my ex who still lives in Cedar Rapids and urged her to let her sister and her partner know. They had a commitment ceremony in Missouri last year but now they could come up for a visit and be legally married.

I think they might do it and if they do, I want to be there this time.

April 2, the Vermont Legislature passes its SSM bill.
April 3, the Iowa Supreme Court legalizes SSM.

New Scare Quoting?
It jumped out at me that Bam Bam is scare quoting gay instead of marriage unlike the usual practice.  In fact, it's downright weird that he's using "gay" instead of the usual othering choice of "homosexual".  Guess he lost his copy of the wingnut style manual.

No helmet law. Every summer around the 4th (Freedom Rally) the bikers get together and have a big bash in the middle of Iowa. As it turns out, the place they have their big bash is also right down the road from my dad's house:

It is land they purchased and maintain just for their own use where nobody will bother them.

The best place in the world to visit is Clear Lake Iowa on the 4th of July. During the last election cycle, I was there on the 4th (2006) and saw Bill and Hillary as well as the introduction of the famed Mittmobile.

The place is as seriously Norman Rockwell as you will ever see in your lifetime.
