Blend Exclusive - National Car Rental Employee To Trans Customer: "Screwed-Up Man Faggot"

Before I begin to relate the details so how trans woman Sarah Vestal has reported being called a "screwed-up man faggot" by a National Rental Car employee, I need to first explain a bit about transsexuals' transitioning, and how most transsexuals go through at least a short period of time as being visibly trans.

Basically, when transsexuals transition, there is a period of time where most dress and live as members of one's target sex, instead of the sex assigned to one at birth, but because one still has facial and body features that identify one as the sex assigned at birth, a transsexual is visibly transgender.

Sometimes, those facial and body features that identify one as one's sex at birth are corrected with the use of hormones over a few years time. And sometimes too, these features would require surgery or professional procedures -- such as facial hair removal and facial feminization surgery male-to-female (abbreviated to M2F or MTF) transsexuals, or breast removal for female-to-male (abbreviated to F2M or FTM) transsexuals -- if a trans person is to seamlessly "pass" in their target sex. And sometimes, no matter what one does, one never can seamlessly "pass" in their target sex -- and many within the trans community (like me) don't consider passing as the be all and end all of trans experience.

Essentially, due to this period of time whe one is visibly transitioning sexes...Well, trans people don't call this process a transition for nothing.

In the real world, if one is visibly trans, then one often finds oneself on the receiving end of discrimination and verbal harassment. And, sometimes in this atmosphere of discrimination and harassment, violent physical harassment is threatened, and sometimes violent physical harassment actually occurs.

Sometimes, one can't tell if it's anti-gay or anti-transgender hate one is experincing -- sometimes, that hate is just one and the same thing.

Sarah Vestal's story of an incident at the National Rental Car facility last Tuesday (April 7, 2009) at the Little Rock, Arkansas airport is one where she reports that she was discriminated against and verbally harassed by an employee, and then threatened with physical violence. She reported being called a "screwed-up man faggot" while just trying to return a rental car as someone who is visably trans.

When she complained to the someone who was identified to her as a manager, the first employee allegedly interrupted the identified manager's and her's conversation about her complaint. The employee Sarah was complaining about reportely threatened to "take the head off the big motha fuckin faggot" for complaining to the manager, and reportedly cocked his fist back as if preparing to strike her.

Sarah then took the next step of reporting the incident to an officer at the Little Rock Police Department there in the airport by a Southwest Airline counter, but she reported that the officer...

...looked at me crying, and said he could not do anything since the man did not physically hit me.

National Car Rental (sometimes referred to a National Rent-A-Car) and Alamo are both subsidiaries of Vanguard Corporation. In 2007, the International Gay & Lesbian Travel Association (IGLTA) announced in 2007 that it had entered into a one year partnership with Vanguard Corporation. The press release for that announcement was entitled IGLTA Partners with Alamo/National Rent-A-Car -- Vanguard Corporation has apparently had at least one significant business relationship with a lesbian, gay, bisexual, and transgender business organization in the past.

National Car Rental, IGLTA, and the Little Rock Police Department were all called for comment for this story, but none replied prior to the publication of this article this morning.

Below the fold is the text of the letter Sarah sent to the airport police explaining -- in her words -- what occurred on April 7th. There is also follow-up from Sarah regarding the responses from the Little Rock Police Department and National Car Rental regarding this incident.

Re: Threatened Physical Harm at LR Nat'l Airport with No Police Action

Dear Chief Thomas:

National Car Rental Employee Calls Trans Woman A 'Screwed-Up Man Faggot'Late yesterday morning, I returned a rental car to National Car Rental at Little Rock National Airport. The attendant, obviously noting that I was a male to female transsexual, forced me to park my car in three different spaces, move my luggage twice, then move the car again before he would provide me a receipt for my car rental. During this time, he referred to me as a "screwed-up man faggot" and used other derogatory male terms even though I was presenting entirely as female. (I am a post-operative transsexual who has lived solely as a woman for years.) When I asked for the manager, he pointed at the person in their key booth in the parking lot. He followed me to that person and when I tried to explain what happened, the original attendant interrupted and threatened to "take the head off the big motha fuckin faggot" if I continued with the story. He then took actions which led me to believe he was going to cause me physical harm such as running up to me and cocking his arm as to hit me. The man in the booth yelled at the attendant to stop, but he then chased me into the airport while screaming more threats of bodily harm. This incident was also witnessed by the National Car customer service woman who had walked out of the desk area. She made no effort to help me with the attendant.

With the encouragement of Southwest Air ticket agent, I went straight to the police area near check-in. The officer who was behind the door listened to my story, looked at me crying, and said he could not do anything since the man did not physically hit me. The police officer told me to go back to the National Car rental area and speak to the manager. I went back to the National Car rental office where I was met with rude indifference from the two representatives, one of which witnessed the incident. After making me wait and laughing among themselves knowing what happened, they told me there was no manager and I needed to call the 1-800 reservation number if I wanted to complain.

By this point, I was even more upset. The airport manager's staff did their best to calm me down and took a written report including a copy of my rental agreement. On the way through security, I stopped and tried to speak to LRPD Officer "Mack" so as to understand why they would not help me. Officer Mack rudely told me that if I did not calm down, he would make sure I would miss my flight home. I gave up with him and walked away after asking him his name.

I come from one of the oldest Little Rock families and graduated 2 years after you from Catholic High School for Boys. Never have I received so little assistance from Little Rock police officers. Would you please explain to me why I could be threatened with physical harm in a public area and not receive any assistance from your officers?

I talked by cell on Friday afternoon to her, as well as talking to Sarah's friend Abby (who first made me aware of the story), and was given some updates.

First, National Car Rental's email reply to the filing of Sarah's initial complaint:

Thank you for your email. Let me begin by apologizing for all of the inconvenience that this issue has caused you. National is committed to providing exceptional service to all of our customers. The actions of our employee as stated in your email is completely unacceptable and will not be tolerated. Therefore, this email has been documented and will be forwarded to the General Manager of the Little Rock Location for follow up and review with their staff.

In closing, thank you for offering your invaluable feedback, as we are dedicated to become the car rental company of choice.

Seriously, National Car Rental responds to an incident of harassment, anti-gay epithets, and threatened violence by one of their employees by "apologizing for all of the inconvenience that this issue has caused you"? That has to be from a automatic template, as that response seems just beyond the pale for a human, customer service representative to actually state on their own.

Secondly, Sarah told me over the phone that a sergeant of the Little Rock Police Department has become personally involved in investigating the incident at the Police Captain's Chief's direction, and the segeant will try and have a copy of the report sent out to Sarah on Monday or Tuesday.

This incident took place in a secure area of the Little Rock airport -- there is likely surveillance footage of at least part of the incident somewhere. It'll be interesting to see if video(s) are released at some point.

Lastly, this coming week, I'm going to be in Greeley, Colorado to cover the Angie Zapata hate crime murder trial. Hearing Sarah Vestal's story late this week reminds me that anti-lesbian, gay, bisexual, and transgender (anti-LGBT) hate can pop up anywhere. These coming weeks I'll be focusing on name-calling, harassment, bigotry, and violence as related to Angie Zapata's life, and her killing.

So with that hate behavior in mind, here's a thought to ponder related to anti-LGBT hate: Although we in the LGBT community think of homophobia and transphobia as two different things, sometimes the haters can't tell the difference between us -- homophobia and transphobia are functionally the same thing for them. Take note that Sarah wasn't called anti-trans pejoratives -- like it or she-male -- but instead the employee reportedly yelled the anti-gay epithet faggot at her.

Any federal hate crimes legislation that doesn't include civil rights and protections on sexual orientation and gender identity or expression just doesn't cover enough range. So, when federal hate crimes legislation comes up for a vote in Congress this year, we need to remember that the LGBT community is one community, and we're often hated as one community.

(UPDATE: Autumn has removed the PDF that disclosed some personal information of Sarah; in prior emails and phone conversations she was asked whether she wanted this information public -- and the ramifications of posting it on the blog, so we've posted the non-disclosing version subsequently sent to the Blend.)

(a)A person commits assault in the third degree if he or she purposely creates apprehension of imminent physical injury in another person.

(b)Assault in the third degree is a Class C misdemeanor.

5-13-206.Assault in the second degree.

(a)A person commits assault in the second degree if he or she recklessly engages in conduct that creates a substantial risk of physical injury to another person.

(b)Assault in the second degree is a Class B misdemeanor.

5-13-301.Terroristic threatening.

(a)(1)A person commits the offense of terroristic threatening in the first degree if:

(A)With the purpose of terrorizing another person, the person threatens to cause death or serious physical injury or substantial property damage to another person; or

Bear in mind that I'm licensed to practice law in Texas, not Arkansas, but I find it hard to believe that, all things being equal, had the rental car employee(s) been on the receving end of the phrase "take the head off the big motha fuckin faggot," some law enforcement officer would have found a way to at least make an arrest pursuant to one or more of the above code sections (assault 2nd, might be a stretch depending on the specifics, but I'm relatively comfortable about assault 3rd and the terroristic threats.)

Kat, I agree completely.  The idea that no crime has been committed because no physical contact was made was debunked under the English common law centuries ago.  Under that tradition, adopted in every state in the U.S. other than Louisiana, "battery" is defined as "an unlawful attack upon another person by beating or wounding, or by touching in an offensive manner."  "Assault," on the other hand, is "an attempt or offer to do violence to another, with or without battery, as by holding a stone or club in a threatening manner."  I see no reasonable explanation for the officers' refusal to help Sarah other than that they too objected to her because of who she is.

I would also assume that - unless 'tort reform' has completely killed tort law in Arkansas - assault is an actionable tort in Arkansas.

And that doesn't require trans-inclusivity; its just good ol' fashioned common law.

Oh - and lets also not forget potential liability on the part of the company and, potentially, the city.

My advice: find lawyers who will make this as painful as possible for those responsible.

Using leverage
I just got off the phone with the operator at Boeing,  identified myself as a retired employee (which is true), asked if they still had a contract with National, and described the situation briefly and asked if someone in Boeing Travel could help National make the right decision in this matter. I left my email and thanked the operator nicely.

It's a small thing, but if other people can ask the travel departments of National's corporate customers to get involved, it might be a step in the right direction.

 

What a day, what a day for an auto-da-fe


The response from National is pretyped.
  The responses most companies send out have to do many things.  All with in avoiding any lawsuits.

 They must acknowledge the claim, which they did.  At the same time they cannot share any investigative procedures taking place.  They cannot reveal anything until there is final action taken against an employee.  

 The customer service industry has a set of standards they all must comply with as well as company policies.  During any incident and until there is a resolution to each situation, most companies will not offer anything but an apology and generally they are a canned response.  They cannot admit any guilt to a customer until there it is over.

 You wouldn't believe the complaints that come into places from customers that are false.  I know, I have worked as a customer service agent for rental car companies.  We got complaints from people trying to get free stuff a lot.

 But that said, this incident was handled badly by National.  When a complaint is being handled on the spot, the employee in question should not have been able to address the customer again.  As Julien mentions this is an assault.

 I know the companies that I have worked for constantly review their customer service agents.  They should also know how employees regard others.  I had to go through several anti-discrimination classes.  Actions mentioned as above would have not been tolerated.  

 Unfortunately, this employee will end up keeping his job unless there has been a series of complaints against him.  At the same time, companies do thorough investigations of all claims.  As for video tape, good luck on any of that coming to the surface unless there was a camera in view.  Not all areas have surveillance cameras.

 She needs to stay persistent on this, and continue making phone calls to get as much of an update as she can.

 And to anyone who reads this, if you have problems, GET NAMES, first and Last. And if you have a camera, take pictures.  Places can track who was where and saw what.  They also have the information of who was at the service counter for possible witnesses.As a citizen, you can't get the company to release other customer information to you, but the police can.

 I hope Sarah follows through, and a resolution can be made.

A canned apology is one thing.
Describing a threatened physical assault (even if they haven't had time to investigate yet) as an "inconvenience" is something else again.  It is an egregious insult that can only make the situation worse.  And if, as you say (and I think is probably the case), it was a canned response, that only makes the matter more awful in my mind.  Somebody in their corporate hierarchy, given plenty of advance time to think about it, decided that the appropriate response to something this serious is a calculated slight?!  I don't have words to express how outrageous I find that.  Given that corporations tend to be swinishly bureaucratic, that goes way beyond the limits of decency and acceptability.

I'd love to see Sarah hang this company out to dry.

Car rental agencies occupy space at Airports under concession leases from the airport & the City under FAA regs. Ms. Vestal may wish to file a complaint with the airport ED, compliance unit and with their oversight board & the FAA. This is the kind of situation that could put the businesses lease at risk.

Additionally - she should seriously consider filing a complaint with the Airport Security Officer & the TSA. This employee may represent a risk to others & to airport safety and should have to have their security clearances to work at the Airport reviewed & possibly revoked.

My LR Natl Airport incident
As a follow-up to my incident, Little Rock was my home for more than 50 years and I am from one of the oldest Little Rock families - we were "carpetbaggers" from Indianna arriving in the 1880s.  As such, it is difficult for me to criticize Little Rock government officials. On the other hand, it is disconcerting to me that this DID happen in Little Rock.

The LR airport staff were kind, consoling and helpful to me - I went to them after the incident following the police refusal to help.  They took me to a private room and calmed me down.  Further, they made copies of my rental agreement, filled out a report with all my contact details and promised they would investigate. I am hopeful they will publicly release whatever the airport security cameras caught of the incident.

In regards to the LR Airport Commissioners, I personally know Jim Dailey, Virgil Miller and Jimmy Moses.  The LR Chief of Police and I went to high school together.  I have no doubt that they will make sure my matter is adequately addressed by all relevant stakeholders, including the lack of response by the police.  Thus, I informed the LRPD on Friday that I do not wish to pursue any potential claims against the police officers.

I truly appreciate the support I have received from our community once this story began circulating last week on Facebook. Thank you!

An opportunity
It would be most useful if the incident could be the catalyst for the creation of some training presentations for the Little Rock public employees.  Even if the training doesn't change the attitudes of individual employees it at least shows official disapproval of mistreatment of transgender and gay people, and it's a good idea to seize any opportunity to combat ignorance.

Some individual training for the police officers involved seems in order.  Calling someone a rude name is not assault, and I'm not in agreement with KatRose that the incident constituted felony terroristic threat, but if the car rental employee was anywhere near Sarah when the man "cock(ed) his arm as to hit" after having said said he was going to "take (her) head off," then that's pretty much a textbook case of assault.  The video will tell the tale for that.

Is this really a training issue?
I can't imagine any person employed in customer service would really need additional TRAINING to understand that you don't swear at, scream at or threaten customers.

I also can't imagine either one of us NOT getting arrested if we started screaming at someone or calling them names - cocked fist or no - in an airport in this day and age.  

Don't get me wrong, new or additional diversity training would be a wonderful thing, but what's really needed is for National and the LR PD to make it very clear to their employees that treating a customer this way, or in the case of the cop, allowing someone to harass a person in this way, will be tolerated.

I've been a preferred customer at National for over 30 years
While I have never been on the receiving end of such grief from them, I was actually arrested after getting fag bashed by the Houston Police Department. You get that? I was the one beaten up AND I was the one arrested. Though I was never charged with a crime, their theory was that I should have walked 7 blocks out of my way to avoid the people who attacked me. To the best of my knowledge, nothing happened to the perpetrators, they were still there the next day, hanging around and still drinking beer. That led to me walking home by myself after midnight. They never charged me but intentionally waited until after the busses had stopped running so I had to walk home. Unfortunately this behavior is still rampant today. I hope that you eventually get some relief from the cops there but I wouldn't hold my breath.
 As for National, as I said, I've been a preferred customer forever and they will usually send me a basket full of platittudes when I complain and I shall spend my next ten minutes or so complaining about that weak, inadequate response you got.
 I'm sorry you had to go through that but I'm not at all surprised.

What is it about the name Sarah and Airlines?
This story is reminding me of my friend Sarah West who I loved to host in my home on her visits to NYC.

In 2001 she was kicked off of a United Airlines Flight and told to dress like a man or she couldn't fly.

Horrendous.
But not really surprised.  I think all these unhinged (fill-in-the-blank)phobes are getting even more out of control with each and every advancement we (we being leftists, liberals, queers, anyone they deem to be a threat) make, be it acceptance, rights, same-sex marriage, etc.  

This tide started rising as soon as it became obvious to the whackjobs that Obama was probably going to be president.  Take these whackjobs, give them arms & ammo and the right to carry it wherever they please (i.e. work/church) and get ready for some absolutely HELLISH days ahead.

I hang my head in shame.


Already selling out of ammo
Already happening.  Many Wal-Marts are running out of ammo.  I'm seeing a rise in the murder-suicide and gunman-rampage stories lately.

Although we in the LGBT community think of homophobia and transphobia as two different things, sometimes the haters can't tell the difference between us -- homophobia and transphobia are functionally the same thing for them.

I'd take out the 'sometimes'.

The National employee who feels entitled to assault and threaten Sarah is a hazard I would not want my family to encounter.

We have to remember, when arguing amongst ourselves, the lesson of this type of incident: the issue is not whether I describe myself as 'trans', 'queer' or whatever term the kids are using today.

The issue is the out-of-whack people I encounter in living my life who share this jerk's opinions about enforcing gender norms.

Also a National Preferred Customer
I'm drafting a postal letter to them right now, which I believe may be taken more seriously than an e-mail. To send a form letter with that offensive wording was adding insult to injury. Corporate wouldn't know that a troglodytic phobic asshole worked as a returns jockey at the LR airport, but they should have better sense than to handle such a serious complaint so glibly.

Autumn and Sarah, please keep us updated with any further news about this incident.

Discrimination
This is an interesting example (not to be dismissive in the least) of why we cannot dissect "gender identity" and "gender presentation" protections from "sexual orientation" when crafting anti-discrimination legislation.  This is the case here in Allegheny County (SW Pennsylvania -- home of Pittsburgh) as well as on the statewide level.  There is talk among leaders in the community that it might be best to scrap trans protections to secure sexual orientation protections.  Sarah's story, to me at least, is ample evidence why that is not the case.

Letters to National
A letter campaign will help push them in the right direction.  Keep it calm and factual with no name-calling.  I just sent the following:

Ladies and Gentlemen:

I've just read of the incident in Little Rock of a transsexual customer, Sarah Vestal, being harassed and threatened by one of your employees as she was returning a car.

As a frequent traveler I often have occasion to rent cars and shop around for the best deal.  I cannot claim to be a regular customer of yours, but I will not be a customer at all until this matter is resolved to Ms. Vestal's satisfaction.  Moreover I will do my best to alert friends against patronizing your company, as I would against any company that tolerates bigotry based on gender, orientation, religion, race, or nationality.

Past discrimination by National
I find it interesting to note that only 12 years ago, National was also involved in a class action suit against them for racial discrimination in Florida(see http://tinyurl.com/deuwzq)

Sarah is a friend of mine, and I am appalled at this treatment she received. I travel often, and refuse to be a customer of this rental company due to this situation.

I encourage everyone to write to National. Another friend of mine has drafted a letter that she herself sent to them, and has shared it as a template for others to us. Anyone is free to ontact me if you would like a copy to pattern your own letter after.

I also encourage bloggers to not only link here to this page on PHB, but also write about this incident in your own blogs. I have seen this story circulating around Twitter-Land and Facebook, and several sites are already linking to this article.

We need to get this out to everyone we can reach.

Little Rock resident tells it like it is
Max Brantley of the Arkansas Times provided a link to this post on his "Arkansas Blog": http://www.arktimes.com/blogs/...  This is what one of his readers had to say in response:

Well, hurrah for the Little Rock Police Department! They know how to handle "those people."

Geez, this situation sounds like a clear cut example of assault and battery. And those in charge (the police and National managers) reacted in a very predictable way.

This is what happens everyday in this city and state to gay and transgender people, and most of the time it doesn't get reported. I mean, "what's the point?" And when it is, it's often responded to with indifference. Or, those in charge shuffle you around from points A to Z and throw up road blocks to slow down the process. Or, they play the game to imply that YOU were the one that caused the offending behavior, so it might be best to let things alone.

Shame on LRPD's response and shame on National Car Rental for allowing this behavior out of an employee. The employee and local managers involved should be fired. But he won't be, based upon the response of the local branch manager and employees.

I'm not a lawyer, but I'd find out if I could sue this employee's ass in civil court--or something. ANYthing to make his life more miserable. It probably wouldn't work though--the only thing that gets to people like this employee is to take away their old beat up car, their cigarettes, liquor and illegal drugs. Oh, and don't forget their "booty calls." And he's probably on the downlow anyway--they always are. That's why I'd hire a private detective to dig up every miserable piece of dung he/she could find about this employee, and I'd use it against him somehow. Yes, some gay people ARE vindictive. :/

No doubt, some will applaud this behavior on the behalf of National.

Ever wonder what it feels like to receive this type of discrimination? This gets close to how it feels: Ever watch movies where Americans are in a foreign country on vacation? And something tragic happens to one of the American vacationers? It could be a murder, a robbery, a beating, a kidnapping. And when the other vacationers attempt to report said crime to the local authorities, what happens? Because they are American citizens, and this particular country hates Amercians, the vacationers are treated with indifference, information roadblocks, and false information. They are shuffled from one office to another and one person to another. Maybe the vacationers themselves are accused of the crime and arrested. And if you the movie viewer get caught up in in the plot line, your stomach gets in a knot. You are amazed at the surreal treatment the characters recieve. And sometimes you are outraged. Or maybe you just want to hide your eyes in disbelief.

The movie characters know if they can just get back home to the good ol' USA, things will be fine. But what if you had no escape? What if it was the good ol' USA or ARKANSAS that was doing this to you for your entire life?.

THAT is what it's like when you're gay, lesbian, bi or transgender and you recieve this type of abuse and discrimination at the hands of anti gay managers, bosses, clerks, police, teachers, and anyone else who's in charge in particular situations. THAT'S what it's like. Perhaps someday you'll be the hated American in a foreign country.

I'm so angry I'm shaking.
