Louise just emailed me to say that it in minutes a decision will be made by Gov. Baldacci about whether he will sign the marriage equality bill when it hits his desk. She was told to head to the governor's office to get the news.

Governor Signs LD 1020, An Act to End Discrimination in Civil Marriage and Affirm Religious Freedom

AUGUSTA - Governor John E. Baldacci today signed into law LD 1020, An Act to End Discrimination in Civil Marriage and Affirm Religious Freedom.

"I have followed closely the debate on this issue. I have listened to both sides, as they have presented their arguments during the public hearing and on the floor of the Maine Senate and the House of Representatives. I have read many of the notes and letters sent to my office, and I have weighed my decision carefully," Governor Baldacci said. "I did not come to this decision lightly or in haste."

"I appreciate the tone brought to this debate by both sides of the issue," Governor Baldacci said. "This is an emotional issue that touches deeply many of our most important ideals and traditions. There are good, earnest and honest people on both sides of the question."

"In the past, I opposed gay marriage while supporting the idea of civil unions," Governor Baldacci said. "I have come to believe that this is a question of fairness and of equal protection under the law, and that a civil union is not equal to civil marriage."

"Article I in the Maine Constitution states that 'no person shall be deprived of life, liberty or property without due process of law, nor be denied the equal protection of the laws, nor be denied the enjoyment of that person's civil rights or be discriminated against.'"

"This new law does not force any religion to recognize a marriage that falls outside of its beliefs. It does not require the church to perform any ceremony with which it disagrees. Instead, it reaffirms the separation of Church and State," Governor Baldacci said.

"It guarantees that Maine citizens will be treated equally under Maine's civil marriage laws, and that is the responsibility of government."

"Even as I sign this important legislation into law, I recognize that this may not be the final word," Governor Baldacci said. "Just as the Maine Constitution demands that all people are treated equally under the law, it also guarantees that the ultimate political power in the State belongs to the people."

"While the good and just people of Maine may determine this issue, my responsibility is to uphold the Constitution and do, as best as possible, what is right. I believe that signing this legislation is the right thing to do," Governor Baldacci said.

When Gov. Baldacci spoke with Louise on the phone the other day (he called her at home!), he sounded like he was leaning towards signing, but didn't say it outright. I give him credit for listening -- and thumbs up for Louise taking the bull by the horns with that golden opportunity to lobby for equality.

"I'm especially proud of Maine's openly gay state legislators, who stood before their colleagues and asked to be treated equally.  Their powerful and heartfelt speeches helped people understand what is at stake when we exclude certain families from the protections and benefits afforded by civil marriage," said Chuck Wolfe, president and CEO of the Victory Fund.

Maine's three out state lawmakers are Sen. Larry Bliss, Rep. Terry Morrison and Rep. Jim Martin.

Freedom to Marry:
"Throughout weeks of conversations, constituent visits, town halls, and hearings, Maine legislators carefully listened to the stories of families, neighbors, businesses, and professional groups from around the state, and then democratically voted to end the denial of marriage that unfairly harmed gay Mainers and served no legitimate purpose," said Evan Wolfson, executive director of Freedom to Marry and author of Why Marriage Matters: America, Equality and Gay People's Right to Marry.  "Couples that have made a personal commitment in life deserve an equal commitment under the law-and in Maine, that's called marriage."

Unless anti-gay forces take action, committed same-sex couples in Maine will be able to start getting married 90 days after adjournment of the legislative session, expected around the end of June.  Opponents of equality are threatening to spend millions of dollars to gather signatures and mount an attack campaign to put a referendum on the November ballot.

"The fight is not over in Maine," Wolfson said.  "To avoid a Prop 8-type assault in Maine, all who believe in fairness and equality under the law must take action now and over the next several months to ensure that the people in Maine get the information they need to reject the deceptive, anti-gay campaign we are likely to see mounted."

The Williams Institute, on how marriage economy will affect the state's economy (are you listening, Gov. Lynch?):
A new research study released today by the Williams Institute at UCLA School of Law shows that by allowing same-sex couples to marry in Maine the state budget will experience a boost of approximately $8 million per year.  This net impact will  result from an increase in state income and sales tax revenue as well as savings in expenditures on state means-tested public benefit programs.

Today, the governor of Maine signed a bill into law that extends marriage to same-sex couples in the state.

"Extending marriage rights to same-sex couples will not only provide needed protections to same-sex couples in Maine, but it will also inject new tax revenue and spending into Maine's economy and state budget," explains study co-author Brad Sears, Executive Director of The Williams Institute.

In calculating the net benefit to the State, the study predicts that half of Maine's 4,644 same-sex couples, or 2,316 couples, will marry in the first three years of being able to do so. The study also projects that 15,660 non-resident same-sex couples will come to Maine to marry.

"As recent experiences in other states demonstrate, same-sex couples will travel for the right to marry and Maine is a likely tourist destination for many of those couples," noted co-author M. V. Lee Badgett, Research Director of the Williams Institute and director of the Center for Public Policy and Administration at the University of Massachusetts Amherst.

"As marriage equality expands in New England, Maine has now ensured that most of its residents will marry at home instead of neighboring Vermont, Connecticut or Massachusetts," added study co-author Christopher Ramos, Researcher at the Williams Institute.

The study finds that same-sex weddings and associated tourism will generate $60 million in spending over three years, providing a boom to the state economy. Furthermore, this spending will generate an increase in sales tax revenue of about $3.1 million over three years.  Marriage license fees will generate more than $500,000 for Maine's counties.

The Williams Institute for Sexual Orientation Law and Public Policy advances law and public policy through rigorous, independent research and scholarship, and disseminates its work through a variety of education programs and media to judges, legislators, lawyers, other policymakers and the public. People's Veto- Big fight ahead
This is great news. But we will now face the biggest fight since Prop 8. The anti-gays will now use the "People's Veto" process. In the past 14 years, they have won 2 of those and lost 2 of these referenda.

1995: Failed to pass Colorado-style anti-gay initiative barring all gay rights laws prospectively

1997: Successfully repealed the state gay rights law

2000: Again successfully repealed the latest gay rights law passed by the legislature

2005: Failed to repeal the third gay rights law passed by the legislature

The marriage law will definitely get on the ballot and it will be a big fight. If we lose, it will take the wind out of our momentum. If we win, it will mean a corner has been turned. Prepare to open your wallets.

BTW, PHB readers should know that this time around, the main anti-gay effort will be a Catholic Church/Mormon operation, with an assist from NOM.  The 4 referenda above were led by Mr. Michael Heath of what is now called the Maine Family Policy Council.  There is a schism b/t Heath and the Catholics.  Heath is again heading his own effort to do a People's Veto, but the real action is with a group called the Maine Marriage Initiative, a Catholic/Mormon-led outfit.

When a court issues a pro-gay ruling, they scream that it's the legislature's job.  When they legislature passes a pro-LGBT law, they scream that the people should decide.  And when the people approve a pro-LGBT measure (as they did in Cleveland Heights, e.g., for a DP registry), they...take it back to the courts.  It's the most absurd circle-jerk imaginable.  But it couldn't be more clear that they will harry us forever, in any way they can.  To put it in Christian terms, they're going to make our lives hell on earth, and like the "real" hell there will be no end.

You are exactly right
In their world, it is not fair when gays seek constitutional rulings from courts.  It isn't fair when a legislature passes a law; all gay rights must be subjected to referendum.  And if we win on a direct vote, as happened in Maine in 1995 and 2005, then that won't be fair because they will claim that outside influence/media bias/spending disparities were to blame.  In sum, all of the procedural arguments are pure BS.  

That having been said, life isn't fair.  This will go on the ballot in either 11/09 or 6/10.  And we cannot screw this up like Prop 8.  No 2-week vacations in Spain for whoever runs this campaign.

They're grasping at straws to find procedural reasons why legalising gay marriage is wrong. I wonder why? Could it be because somehow they've admitted deep down, so deep down that they're not really aware of it, that it might actually be that pesky little thing called a civil right, and that Americans are finally beginning to recognise this?

Different states have different types of referendum procedures and rules and limits to what referenda can do.

Maine's referendum "people's veto" would be to overturn an enacted law.  California's Prop 8 was to amend (actually revise, IMNSHO, but that's what we're waiting to hear from the CA Supreme Court about by June) the state constitution.  Different animals.

California could (and I wish it WOULD!) change the rules for getting something on the ballot, whether to make a law or change the constitution -- it's way too easy there, any wingnut can do it.

Other states' rules are more stringent -- the people can intiate legislation but it has to be passed by the legislature also and ratified by popular vote (simple or 2/3rds majority, I think, depending on where you are).

That's one reason why Iowa is cool, too -- marriage equality was judicially decided like it was in California, but because of the lengthy and layered referendum process to amend the Iowa state constitution, there will be a few years (rather than a few months) of marriage equality and enough time for people to see the sky didn't fall (just like it didn't in Massachusetts), and I believe an anti-equality referendum will be less likely to pass there the longer people have to get used to the reality of the situation.

Which prompts a question: is the earliest the "people's veto" of the marriage equality law could get on a ballot  November 2009?  If so, is that a major election or a minor one?  I'm assuming planning is being done to get this thing -- if indeed it does gather enough valid signatures at the right time and meets deadlines and so forth -- manipulated to the most advantageous election turnout situation.

A favorable decision in CA should help here in WA.
My opinion only of course, but I think a good decision in CA will further undermine the mood to hunt and kill LGBT rights here in Washington state.  The referendum just filed here to repeal the latest domestic partnership law is already being undermined in a very public way by big name religious conservatives in the state who see it as a sure loser.  A favorable CA decision would take even more of the last gasp out of the referendum sails here.

Governor Baldacci,

I am not a resident of Maine, but have vacationed there over the years, and I simply had to send along my thanks for your signing the equal marriage law. As a gay man, I am still stunned to see so many straight people willing to look beyond the simple rhetoric and lead on this important civil rights issue. Although I certainly understand that emotions can run high over the issue (just look at the controversy in DC over a relatively more minor action yesterday), I truly believe that next great challenge to our fulfilling our Founding Fathers' vision for this country is the full recognition and respect of the GLBT community.

Today is a great day for the state of Maine, and you will go down in history as an important first - the first US Governor to sign an equal marriage law, and without any threat of action by a state court.

Thank you so much for your leadership.

HOLY SHIT!!!
Oh my god, I saw the news when I got to work, and let out a loud "SQUEE!!!" before I could stop myself. I have been bouncing in my seat and the officers are looking at me funny. I finally snagged the one lone naval officer I am out to, dragged him to the corner and told him. He did the happy dance and terrorist fist-bumped me. Yes, there are some progressives amongst military officers, and I know a LOT of them.

Louise, I haven't forgotten the joint custody agreement. Does that mean I can come stay with you and Charlie and the Junior Associates for half the year?

I'm still staggered that we went from the extremely reinforcing public hearings just 2 weeks ago to signed LAW.

58% passage in House
60% passage in Senate
Signature by Governor

No re-votes, no amendments, no vetoes, no political blocking and posturing.

PASSAGE.

Our roll of victories will
definitely come up in the Senate confirmation hearings for the Supreme Court. Our opponents will use it to energize the base and Obama's against us and with us tortured position will be on full awkward display. Consequently, most of the Democrats will hide behind his cowardly triangulation.

Should be an interesting show.


Then I have this hope
that a prudent nominee will appropriately not comment on a matter that is "likely to come before the Court," which position gives marriage equality's fearful supporters a wall to hide behind and its opponents nowhere else to go with the issue.
