Report: Obama can stop the discharge of openly gay and lesbian service members now

I would love to see a White House response to the arguments in this study, but I'm sure we'll continue to get chirping crickets. It makes the excuses for why the Obama Administration thinks it can do NOTHING about DADT is pure baloney.

A new report released today, "How to End 'Don't Ask, Don't Tell': A Roadmap of Political, Legal, Regulatory, and Organizational Steps to Equal Treatment," sponsored by the Palm Center at the University of California, Santa Barbara, clearly presents a way the President can stop the discriminatory discharge of gay and lesbian service members without Congress passing a law. It boils down to three points (the full release is below the fold).

1) Under the law "the President may suspend any provision of law relating to promotion, retirement, or separation applicable to any member of the armed forces who the President determines is essential to the national security of the United States" during a "period of national emergency."  The statute specifically defines a "national emergency" as a time when "members of a reserve component are serving involuntarily on active duty."

Check on that front. How many tours have reservist gone on now?

2) Don't Ask, Don't Tell grants to the Defense Department authority to determine the process by which discharges will be carried out, saying they will proceed "under regulations prescribed by the Secretary of Defense... in accordance with procedures set forth in such regulation."

All President Obama has to do is tell Bob Gates to stop discharging gays and lesbians from the military's ranks.

3) Don't Ask, Don't Tell calls for the discharge of service members "if" a finding of homosexuality is made, but it does not require that such a finding ever be made. According to the study, these provisions mean that the Pentagon, not Congress, has the "authority to devise and implement the procedures under which those findings may be made."

Again, the witchhunts can be stopped; all the President has to do is tell the Pentagon to knock it off.

There really isn't any excuse except for political cowardice a desire to expend political capital when it best suits the administration, and apparently that's not any time soon.

A study released today by a team of military law experts shows that the president has the legal authority to end gay discharges with a single order. The idea of ending the ban by executive order has gained momentum in the wake of news that mission-critical personnel, including Arabic language speaker Dan Choi, continue to be fired under the Obama administration because they're gay.  Congressman Rush Holt endorsed an executive order to end the ban on Saturday and National Security Adviser James Jones was asked about it by George Stephanopoulos  on Sunday morning. The report, "How to End 'Don't Ask, Don't Tell': A Roadmap of Political, Legal, Regulatory, and Organizational Steps to Equal Treatment," is sponsored by the Palm Center at the University of California, Santa Barbara.

Many have argued that only Congress can lift the ban on service by openly gay troops.  But according to the study, Congressional approval is not needed.  Dr. Aaron Belkin, Director of the Palm Center and a study co-author, said "The administration does not want to move forward on this issue because of conservative opposition from both parties in Congress, and Congress does not want to move forward without a signal from the White House.  This study provides a recipe for breaking through the political deadlock, as well as a roadmap for military leaders once the civilians give the green light."

There are three legal bases to the president's authority, the report says.  First, Congress has already granted to the Commander in Chief the statutory authority to halt military separations under 10 U.S.C. § 12305, a law which Congress titled, "Authority of President to suspend certain laws relating to promotion, retirement, and separation"  Under the law "the President may suspend any provision of law relating to promotion, retirement, or separation applicable to any member of the armed forces who the President determines is essential to the national security of the United States" during a "period of national emergency."  The statute specifically defines a "national emergency" as a time when "members of a reserve component are serving involuntarily on active duty."

The second and third bases of presidential authority are contained within the "don't ask, don't tell" legislation itself. The law grants to the Defense Department authority to determine the process by which discharges will be carried out, saying they will proceed "under regulations prescribed by the Secretary of Defense... in accordance with procedures set forth in such regulation."  Finally, the law calls for the discharge of service members "if" a finding of homosexuality is made, but it does not require that such a finding ever be made. According to the study, these provisions mean that the Pentagon, not Congress, has the "authority to devise and implement the procedures under which those findings may be made."

Diane H. Mazur, Professor of Law at the University of Florida College of Law and another study co-author, said the presidential authority to stop firing gay troops, known as "stop-loss," is different from the highly unpopular stop-loss policy that the Army recently announced it would phase out. "That use of stop-loss forcibly extends service by those who wish to leave the military," she said, "whereas suspending discharges for homosexuality would do the opposite: allow ongoing service by those who wish to remain in uniform."  The study says the provisions of the stop-loss law, which are granted by Congress, are "sensible because they give the President authority to suspend laws relating to separation when a national emergency has strained personnel requirements."

The other four authors of the study in addition to Mazur and Belkin are Dr. Nathaniel Frank, a Palm researcher and author of "Unfriendly Fire: How the Gay Ban Undermines the Military and Weakens America"; Dr. Gregory M. Herek, Professor of Psychology at the University of California, Davis; Dr. Elizabeth L. Hillman, Professor of Law at the University of California Hastings College of the Law; and Bridget J. Wilson, who practices law at Rosenstein Wilson & Dean in San Diego. The report will also be published in a forthcoming book, "Department of Defense Social Policy Perspectives 2010," edited by James Parco, David Levy and Fred Blass.

I didn't need a report to tell me that
Obama has had the power as Commander in Chief, since 12:00 noon CST on January 20, 2009, to stop enforcing any policy he wished governing promotion, retention, seperation, etc. He doesn't have the power to remove policies in most cases but he can certainly suspend enforcement. As easilly as he could end Stop Loss, he could end the implimentation of DADT.

Couldn't such a action by the President soak up the political capital needed for a complete repeal by Congress?

Think for a second
Republicans will oppose a repeal up to and long past the moment their Jesus comes thundering out of the sky on a winged horse to announce that he's directing it himself. "Political capital" be damned. They have slapped Obama's hand away since Jon Stewart announced the election results and they will continue to do so because they can't imagine doing anything else.

DINOs will oppose it because they're professional christians who just want to pander to the hate voters while still winning elections.

"Real Dems" will oppose it or refuse to address it because they're professional cowards, and addressing anything LGBT-related causes spontaneous pants-wetting.

Using up political capital? You give Washington too much credit. There is no such thing as political capital on the issues surrounding LGBT lives. There is only hate opposing progression.

If the president were to follow this recommendation and halt the dismissals then we would have military personnel serving openly. With a "trial period" of having openly gay personnel we will have further proof that the military can continue to function without incident by "pesky gays" wishing to serve honestly and proudly for their country.

That would seem to fit Obama's needs perfectly and make the case while protecting the country and without need for time and money spent on a "study".

I've gone back and forth on trying to figure out Obama since The Rick Warren Insult to America, but when most people favor a DADT repeal and most Republicans will always oppose everything, exactly what is it he has to lose?

Also, after not enforcing the policy for a period of time will make it easier for congress to repeal since at that point the controversy will have passed and it will just be a formality and they won't be making any actual changes to how the military is operating.

No, of course not.
All Obama would have to do is instruct the Pentagon to stop the discharges for a fixed period of time, say six months, pending congressional action.  Similar, in effect, to a judge issuing an injunction to prevent a decision from being finalized pending appeals.  This would effectively put the ball in congress' court; if they fail to repeal DADT he cold then extend his order indefinitely, and no one could blame him.

Hmm...
I can see the possible legality on the first issue, but the second and third seem a bit of a "stretch for convenience" to me.  I didn't like it when the previous administration used "stretches for convenience" when dealing with law passed by Congress and I can't will myself to be hypocritical in this case just because I like the outcome.  (yes I know Bush's stretches were like pulling Taffy to the breaking point.

I think the administration should immediately put a stop to the witch hunts--meaning that unless you come out on national TV or wear a gay pride T-shirt to work you should be safe.  Then I think they need to put the military procedures in place for diversity training, punishment procedures, recruitment training, etc. before giving a green light to Congress to overturn DADT.  Yes, I am not letting Congress off.  They own this too.  They are the ones (some of them left at least) who forced the compromise in the first place and they need to overturn it.  

I just get the feeling that if Obama does this alone with the swipe of the pen, it is going to be a media circus with the right--claiming the unpreparedness of his action, the stressing of our military at an important time, parading recent military recruitments around saying the don't want to serve now because they didn't know they were going to have to serve with "a gay", etc., etc.

Ok, flaming expected. Go easy :)

I agree with others commenting here. At minimum, do a 2 year trial of not enforcing the 'law' and then easily repeal the darn thing when the earth does not shatter. But do something. All talk and no action for our community is beginning to bug the crap out of us. He's got to do something that he promised, doesn't he?

Is President Obama indicating that repealing a law that protects states from being forced to recognize out-of-state "gay marriages" - the Defense of Marriage Act (DOMA), signed by President Clinton and passed overwhelmingly by Congress in 1996 - is now a low priority for his administration? We hope so, given that support for traditional marriage, between a man and a woman, remains strong throughout the country.

The White House has stripped Obama's anti-DOMA pledge ("Obama also believes we need to repeal the Defense of Marriage Act ...") from its website, as part of new, tighter language under the "Civil Rights" section dealing with homosexuality. Already homosexual activists are chafing at the slow pace of "change" offered by Obama in support of their agenda; many will not appreciate the public scrubbing of his DOMA promise - even though most Americans probably are unaware of it in the first place, as it barely surfaced in the presidential campaign. (Obama hardly has a mandate on DOMA; in fact, in informally questioning voters, I have yet to find an Obama supporter who was aware that Mr. Obama even made the anti-DOMA promise.)

We hope that President Obama recognizes that his anti-DOMA pledge - like his radical campaign embrace of the Freedom of Choice Act (FOCA), which would eviscerate pro-life laws restricting abortion across America - is not popular with mainstream voters, even if it was useful in rallying liberal Democratic activists during the campaign. (At his last press conference, Obama disappointed ardent feminist backers by indicating that FOCA - which has engendered huge concern among pro-lifers and mobilized pro-life advocates against the president's abortion agenda - is not a major priority for his Administration at this point.)

The following is the original language related to President Obama's pro-homosexuality agenda posted shortly after his inauguration as president of the United States (courtesy of the pro-family group Culture Campaign; emphasis added in red):

Oppose a Constitutional Ban on Same-Sex Marriage: President Obama voted against the Federal Marriage Amendment in 2006 which would have defined marriage as between a man and a woman and prevented judicial extension of marriage-like rights to same-sex or other unmarried couples.

Support Full Civil Unions and Federal Rights for LGBT Couples: President Obama supports full civil unions that give same-sex couples legal rights and privileges equal to those of married couples. Obama also believes we need to repeal the Defense of Marriage Act and enact legislation that would ensure that the 1,100+ federal legal rights and benefits currently provided on the basis of marital status are extended to same-sex couples in civil unions and other legally-recognized unions. These rights and benefits include the right to assist a loved one in times of emergency, the right to equal health insurance and other employment benefits, and property rights.

The following is the new White House web language on homosexuality, with the anti-DOMA text removed:

President Obama also continues to support the Employment Non-Discrimination Act and believes that our anti-discrimination employment laws should be expanded to include sexual orientation and gender identity. He supports full civil unions and federal rights for LGBT couples and opposes a constitutional ban on same-sex marriage.  He supports repealing Don't Ask Don't Tell in a sensible way that strengthens our armed forces and our national security, and also believes that we must ensure adoption rights for all couples and individuals, regardless of their sexual orientation.

It is interesting that the White House through its official website retained Obama's promise to repeal "Don't Ask/Don't Tell" (thus allowing open homosexuality in the armed forces) even as it removed his pledge to repeal DOMA-one of the top goals of his homosexual activist allies.


NO accusations, but...
....I just don't understand why we are not revolting, as in doing something MORE radical than what we've been doing, things that tell Obama AND America,

We're not alone
Maura, is there any way to bring together true "Queer Revolutionaries"?   Surely the technology is there (Twitter, Facebook, etc.), we just need an ACTION that is effective and a large enough number of people that will be taken seriously.

Having a specific location can be problematic (EX - too many cannot afford travel; others cannot leave the house)...which was one reason I screamed tax revolt for 9 months.

There just HAS to be 100, 200, 300 people who are willing to do actions that go well beyond what the gay organizations "support".   Since I dream a lot, I hope there are 1,000's who are ready to initiated REAL civil disobedience.   At age 43 and disabled, I can't believe I'm going to spend my life watching various PRO-gay legislations being voted away, then reinstated, then voted away, ....etc.

NOT GOOD for out collective psychological health.

than everything else on the Obama agenda, including appointing fundies to the faith based initiative and pondering responses to equality in Iowa?

Evading the law
Actually, it's not quite the same since there is a specific law that would allow Obama to suspend DADT based on military necessity.  Unlike some of the maneuvers that Bush did with the executive power that were based on questionable interpretations of law.  However, there could be political backlash if Obama did what is well within his authority, given the Bush-Cheney power plays.  

Also - as Pam called for in her post, there has been a direct response to this report from the White House.  They have said that Obama will NOT use an executive order but that he will fight for repeal through legislative action, which is at least a clear statement on the question.

No on evading the law
Obama needs to push Congress to change the policy. The constitutional power of Congress to enact military regulations trumps the president's Commander in Chief powers. He should not just sign an executive order or decline to enforce the law.

It was bad when Bush evaded the law and the principle still holds for Obama, even if the ends are more acceptable to most of us here.


Say he's halting discharges pending Congressional review
DADT has to be repealed by Congress.  Fine.  But it's not unusual to say that action on legislation is going to be suspended pending review by another branch of government.

Then get every Democrat over to the White House and figure this thing out. It's the simplest, most basic thing to do--far easier than ENDA or hate crimes.  Let all the Democrats see the numbers of LGBT people in their districts and figure out what will happen if we all decide that 2 Nov 10 would be the best date ever for dinner parties with our friends.
