Did New Hampshire Become Domino, er, State #6 Overnight?

Have checked all of my own "usual suspects"/ sources and not a PEEP anywhere...

But sure does look that way:


According to Article 44 of the New Hampshire Constitution:

Every bill which shall have passed both houses of the general court, shall, before it becomes a law, be presented to the governor, if he approves, he shall sign it, but if not, he shall return it, with his objections, to that house in which it shall have originated, who shall enter the objections at large on their journal, and proceed to reconsider it; if after such reconsideration, two-thirds of that house shall agree to pass the bill, it shall be sent, together with such objections, to the other house, by which it shall likewise be reconsidered, and, if approved by two-thirds of that house, it shall become a law. . . . If any bill shall not be returned by the governor within five days (Sundays excepted) after it shall have been presented to him, the same shall be a law in like manner as if he had signed it unless the legislature, by their adjournment, prevent its return, in which case it shall not be a law.

The Union Leader, by way of The New Civil Rights Movement, has reported on May 7 that the bill, the Senate version of which was passed by the House on May 6, was sent to the Governor on May 6:

CONCORD - The New Hampshire House yesterday sent the gay marriage bill to Gov. John Lynch for signature, voting to agree with Senate changes to the bill.

Although I am no stranger to bill-signing-days-counting disputes, the five days - if the Union Leader report is correct - were May 7, 8, 9, 11 and 12.

Accordingly, at midnight, the marriage equality bill has become "law in like manner as if he had signed it."

The only relevant mention I could find is a notation in the Bill Status section of the legislature's Web site of:

Status PASSED / ADOPTED WITH AMENDMENT
Status Date 5/12/2009

This notice is in addition to the notice of the House's concurrence on 5/6/2009.

As such, and in addition to the text of the Constitution, it would appear that marriage is law in New Hampshire if the bill was presented to the Governor on May 6, as the Union Leader reported.

Passive-aggressive passage maybe, but passage nonetheless!

I received an email from NHFTM the other day, said the bill is expected to reach the Gov's desk today so we have 5 days from then...

One major correction Louise - they would become # 7 - CA had legalized
same sex marriage but the bigots took it away.

Yet every media report that I see only counts the states that currently (or would currently) allow it - and they're all inaccurate in that respect.

If NH becomes law, then 14% of the States have had legally recognized same sex marriage - not 12% of the States.  With a few others potentially on the horizon.

I grew tired of making this point after Iowa and Vermont hit the news.  

The fact that marriage equality existed in CA before the right was stripped from a minority population is an enormous statistical exception that should NOT be swept under the rug.  

What happens when Prop 8 is overturned or repealed?  Do all the subsequent states move up a notch or does CA become number 8, 9, 10 or 11?  

In any event, the thousands of same-sex marriages conducted in CA should not simply be forgotten in the horse race because the media has a hard time explaining the inconsistencies in equality.  

Thanks for not upholding that dishonesty.

CA is now noted as 'recognized in some regions.'  
United States (CA, CO5, DC, HI, MD, NH, NJ, OR, WA)
   ??? Maybe others know more about this.

with the CO footnote = as of July 1.

New York is listed as 'recognizing, but not performing)

?? Also re California, as someone asked me. Are all legal marriages performed in other countries and other states before November 5, 2008 recognized in California?

those are some questions that are unanswered....
if the person was a resident of CA previously and was married internationally between june 15 and nov 4 then those marriages are probably recognized in CA after the Supremes rule.

Although earlier marriages (i.e. in Canada) went into effect on June 15th, I suspect that when the court rules they will determine that only marriages that actually OCCURRED in the window, not those that became LEGAL during the window, will be legal going forward.

For better or worse,
if the CA Supreme Court upholds Prop 8, California will next year become the first and only state to have marriage equality supported by all "three" branches of government; the legislature, the court, and the voters....then what are the Antis gonna be able to say?

I'm not forgetting at ALL
since one of those 18,000 couples are dear friends of mine (Teac and her wife) and a few others are Maine residents who spoke at the public hearing a few weeks ago.

California knocked over the domino- then Prop 8 stood the damned thing back up. So now it needs to be knocked down again.

Legislative supporters in the House and Senate said they want to get both bills to Lynch at the same time.

The original gay marriage bill (HB 436) needs the signatures of House Speaker Terie Norelli, D-Portsmouth, and Senate President Sylvia Larsen, D-Concord, before it could head to Lynch's desk.

The bill that fixes the first (HB 310) still needs clearance from legislators who have to confirm it's been technically reviewed before it can then go to Norelli and then on to Larsen.

Once Lynch gets both of them, he has five days to make up his mind or they become law automatically without his signature.

It hasn't even reached his desk yet.

I talked to one of our state Reps here in Hudson, NH this morning and he confirmed that Lynch has not seen the bills on his desk yet. He also said the calls and emails to Lynch were heavily in favor of the veto but also noted many were from out-of-state.

Why do out of state people think they will have any influence
it's so bizare to me. I guess they think they can have influence by sheer numbers.

NH bill
We have a similar arrangement in Washington state.  A bill becomes law by default unless vetoed by the governor within 5 days of it being presented to her, excepting Sundays.  The exception is that the governor has 20 days to act if the law was presented to her within 5 days before adjournment of the legislature.  (Check your constitution in NH to see if it has such an exception).

We have a similar situation here in WA where it was widely believed that our governor would let the greatly expanded domestic partnership law become law by default.  Then she announced she would sign it on 5/18 (one day before the default deadline of 5/19)


WA governor is supportive, but...
word is she is postponing signing until the last possible moment in order to limit the amount of time available for opponents to gather signatures for a repeal initiative.

The gov is in no hurry to sign it....
and for once I'm thankful for government delay and foot-dragging!  If the governor were to line-item veto one little section of that massive 181 page bill (ie the section on public waterways, or fishing licenses, or dikage and irrigation districts...), I wouldn't be offended. The opposition would have to refile their initiative and begin a new waiting period for a ballot title.  Good for at least another week of delay.

Seems the Union Leader story
was in error when they reported that the bill HAD been sent to the Governor.

How big a building is in Concord, anyways? Never looked that big when I passed it on I-93 before... funny how Maine was able to have Senators Damon and Bliss walk our bill from the Senate to Gov Baldacci's office in a matter of minutes!

I think the governor is dragging this out as long as possible.

For the record you can see the gold capitol dome from I-93, but yes the building isn't all that big.
