S1584, the Employment Non-Discrimination Act - What's The Math?

Yesterday, the Employment Non-Discrimination Act, S 1584, was introduced into the U.S. Senate by Oregon Senator Jeff Merkley, along with three other co-sponsors, two of them Republicans.

It has been widely noted in press releases that it's the first time ENDA has been introduced in the Senate, though it has been in the House in many forms on and off since 1974. This is significant not only for its historic nature, but it also signals that the real battles on this legislation are to be found in the Senate. After all, as I pointed out last month, the U.S. Senate is the only spot on earth where a majority of 100 is not 50, but 60.

After adding in all the co-sponsors of S 1584, there are 44 Senators with confirmed yes votes, as you can see on the Facebook Inclusive ENDA Senate spreadsheet. Another 16 votes must be found before S 1584 can be passed.

16 votes doesn't sound like a lot, but it's a big chunk of the Senate. Some Senators will require a lot of persuading, like someplace very hot freezing over or certain oinking mammals sprouting wings and flying.

If your Senators are unconfirmed, you should be on the phone right now, asking them to co-sponsor S 1584. Click here for a list of the unconfirmed Senators with contact info.

My Senators are co-sponsors, but I will contact the offices of other Senators and encourage their support. We are at a critical juncture with this legislation. We're closer than we have ever been, lets work together to get this passed!! Please contact your Senators.

It wouldn't be enough
Some Senators will require a lot of persuading, like someplace very hot freezing over or certain oinking mammals sprouting wings and flying.

If god came down, changed their water carafes to wine, then called down a burning bush to say "Vote for this, it is My will", they'd argue that they know what s/he REALLY wants, and vote against it.

Cause any fool knows, a dog needs a home; a shelter from pigs on the wing


Sad to think this may not have enough support.


It's not just the math
Please don't be so naive as to believe this will necessarily come up for a vote this year -- just because a bill is introduced doesn't mean it will ever go anywhere.

And if the bill does come up, please don't be so naive as to believe it won't be amended, perhaps to allow lots of people to continue to discriminate if, you know, that's what their religion tells them to do.

And if the bill doesn't go anywhere this year, please don't be so naive as to believe it will be voted on next year, because next year's another election year, when Democrats are typically shy about being seen with us.

And if nothing happens in 2009 or 2010, please don't be so naive as to believe anything will happen before 2013, because the 2012 presidential race begins in earnest right after the 2010 elections.

In other words: Call and write and visit with your senators and representative -- they'll be hearing from hordes of our enemies, so every one of us needs to make as much contact as possible. Only, please don't be so naive as to get set your hopes too high.  


In the Senate...
In the Senate, California voters count for a lot less than Wyoming voters.

The voters of sparsely-populated states always count for 'way more than the voters in more populous states.

How do we persuade a Senator form Wyoming (or Alaska, or North Dakota,) to ignore their constituents -- if their constituents are dead-set against ENDA?

So Senate Math is 60.  But what's the math for the representation behind those Senators' votes?


Not just in the Senate...
Compare voting population per electoral college vote between California and Wyoming...and it's like 600,000+ voters to 67,000 voters.  The votes for president in WY are worth 10x's more than in California.   The electoral college has served it's purpose but not likely to change soon.
