HRC delivers DOMA survey to Congress; Rep. Nadler to introduce repeal bill next week

Lord knows the White House won't want to comment on any DOMA repeal legislation that starts moving, so this pressure is a good move IMHO. HRC Legislative Director Allison Herwitt delivered a survey on DOMA to Congress. (HRC BackStory):

The Human Rights Campaign, the nation’s largest lesbian, gay, bisexual and transgender (LGBT) civil rights organization, today launched a campaign to repeal the Defense of Marriage Act (DOMA), which denies legally married same-sex couples more than 1,000 federal protections and responsibilities. As part of the campaign, HRC launched a national action alert, an interactive website, RepealDOMAnow.org, and delivered to Congress nearly 50,000 survey responses showing the concrete harms DOMA brings to the lives of LGBT Americans and their families. A bill is expected to be introduced in the U.S. House as early as next week.

“Now is the time to let Congress and President Obama know that DOMA must go. The introduction of a bill to repeal DOMA with this unprecedented momentum behind it will mark a tidal shift in this fight,” said Human Rights Campaign President Joe Solmonese. “This hurtful and discriminatory law denies millions of Americans federal recognition of marriage and the critical rights and benefits that come with it – Social Security survivors' benefits, equal treatment under U.S. immigration laws, the right to take leave to care for a spouse, and more. It is more important than ever to push for repeal of DOMA.”

You can view the survey at: www.hrc.org/DOMASurvey. Over at The Politico, Ben Smith makes the call that Rep. Jerry Nadler (D-NY) will be the one to introduce legislation to repeal DOMA. It will be interesting to see who signs on as co-sponsors (and who doesn't).

One of the more abstract
effects of not having federal marriage rights is the unlimited gifting to spouses law that straight couples have but GLBT couples don't.  The mess of trying to keep track of "gifts" in a household of combined finances is just one of the elements of the Gay Tax imposed on anyone born GLBT who chooses (like the majority of straight people) to seek a partner to share all the parts of life with (including financial matters).  Yes, you don't have to report anything under $13,000 in 2009.  But this still could create a nightmare for a couple if one or the other of them receives some sort of windfall or if one spouse chooses to stay home and care for children.  In effect, the gay person not only has to pay for their fair share of regular taxes, but also additional gift taxes (hence the Gay Tax in this situation).  Maybe the hesitation in government to repeal has less to do with fewer taxes to collect in the future if marriage rights are given to GLBT, but more to REFUNDS they owe just about all of us.

There is definitely a Gay Tax in our country.  I'm sure there are plenty of people who, in the past, have lived a straight life to avoid the Gay Tax.  But should that really be our only alternative to fully participating in the American way of life?  Is the Gay Tax like a sin tax for cigarettes and alcohol?  I think some conservatives would view it that way and think it's an appropriate tax to keep on the books.  Right now, the law says if you "choose" to be gay, you're going to miss out financially.  Since it hasn't been the educated position in a long time that anyone chooses to be gay, I think the obviousness of discrimination has to hit any logical, moral person over the head.


Hmmmn, tell that to Brian "it's a perfectly rational position" Brown.

That's great.  HRC and Nadler are to be congratulated.  I will pay my IRS taxes I owe for the past 5 years once it is repealed.

Same-Sex Marriage is good for the economy.

Well I'm sorry folks
But I love a good fight. And if the national organizations are going to jump in with both feet on DADT and DOMA as well, them I am down to get down! I am a strong advocate on put up or shut up, but the national organization really have in the past month. And after Obama's speech last night, and the terrible behavior of the extreme right over the summer. Not to mention the horrible response of the not so extreme right in down playing such behavior, I am back in it. Sometimes its just a gansta thang, and you got to just throw down because err body else is. We can sort out the blame and thangs later. But I love it when its on!!

As Meshach Taylor said when he played Hollywood Montrose, "There is two things I like to do. That is fight and kiss boys!"
