FL: Fed court dismisses lawsuit of woman kept apart from dying partner by hospital

-- Jackson Memorial Hospital official to Janice Langbehn, who was not allowed to see her dying partner. And the court agreed.

In the home state of Charlie Crist, where the law does little for the Sunshine State's LGBT residents, a horrific court rejection that only highlights the extent to which gay and lesbian couples are treated in the most inhumane way --one that heterosexual couples will never experience -- during their most vulnerable moments. The case is Langbehn v. Jackson Memorial Hospital. (Lambda Legal):

The United States District Court for the Southern District of Florida today rejected Lambda Legal's lawsuit filed against Jackson Memorial Hospital on behalf of Janice Langbehn, the Estate of Lisa Pond and their three adopted children who were kept apart by hospital staff for eight hours as Lisa slipped into a coma and died.

"The court's decision paints a tragically stark picture of how vulnerable same-sex couples and their families really are during times of crisis," said Beth Littrell, Staff Attorney in Lambda Legal's Southern Regional Office based in Atlanta. "We hope that because of Janice's courage to seek justice for her family in this case that more people better understand the costs of antigay discrimination. This should never happen to anyone."

While on a family cruise leaving from Miami, Lisa Pond, a healthy 39 year-old, suddenly collapsed. She was rushed to Miami's Jackson Memorial Hospital with her partner Janice and three children following close behind. There, the hospital refused to accept information from Janice about her partner's medical history. Janice was informed that she was in an antigay city and state, and she could expect to receive no information or acknowledgment as Lisa's partner or family.

A doctor finally spoke with Janice telling her that there was no chance of recovery. Other than one five minute visit that was arranged by a Catholic priest at Janice's request to perform last rites, and despite the doctor's acknowledgement that no medical reason existed to prevent visitation, neither Janice - who provided the hospital with a medical Power of Attorney document - nor their children were allowed to see Lisa until nearly eight hours after their arrival. Soon after Lisa's death, Janice tried to get her death certificate in order to get life insurance and Social Security benefits for their children. She was denied both by the State of Florida and the Dade County Medical Examiner.

Today's ruling comes after the Public Health Trust of the Miami Dade County, the governing body of Jackson Memorial Hospital, filed a motion to dismiss the case. The court ruled that the hospital has neither an obligation to allow their patients' visitors nor any obligation whatsoever to provide their patients' families, healthcare surrogates, or visitors with access to patients in their trauma unit. The court has given the Langbehn-Pond family until October 16 to review the ruling and consider all legal options.

You see that - even though the hospital was presented with a legal document giving her medical POA, she could neither see her dying partner nor obtain a flipping death certificate!? This is sick on so many levels. The issue here is that even with the right legal documentation, once the battle in the hospital begins between homophobic officials and the partner, time wasted on trying to obtain basic rights you are entitled to allows the patient's life to fritter away over this bullsh*t. If the doctor said there was no medical reason for her not to see her partner, then that should have been the end of it.

my world has crumbled, my heart was stabbed just like watching Lisa collapsing all over again on the Rfamily cruise on 2/18/07

words of encouragement have poured in from friends, family and others to say "hang in there - the fight is just starting".

and then our son David - saying "mom that's messed up - if we were here in Group Health we could have been with other mom but because we were in Florida we couldn't -  how is that fair - shouldn't the laws me the same in all the states" he is only 14 and has some learning delays - what does that say about our society, our laws, and how we wrong others every day if my 14 year old son can see it's "not fair"

I honestly don't know how I pick myself up and put on a brave face for public speaking that has always been very trying and hard for me even before this decision - now it will be augmented with an asterisk that says but she failed in court

I know there are people who disagreed that I should never have filed the lawsuit to begin with, that to let the dead lay in rest. I couldn't - I never could - I always picked at those wounds on my arms or face hoping for a different outcome. Speaking out about the inequality we faced was no difference.

This is tragic, enraging and disgusting because there was no reason for this to happen. Florida needs to stop this rank discrimination -- and it doesn't even have to do it by affirming gay families, btw. At least in NC, the law on the books is that a patient can designate anyone to be their primary point of contact. Of course if the patient is not conscious, then you do have to rely on legal paperwork. However, I've never experienced any problems here, in fact it's been the opposite, neither of us have ever been asked for documentation or questioned at all. I will say that hospitals need to update all of their forms to allow a box for "partner" or "significant other."

The cruelty could be resolved by the state's legislature changing the law -- is there any chance this will happen?

Question
Does anyone know the grounds for dismissal?

My brother's partner was treated far better by a hospital in Montgomery AL
and he didn't have paperwork.  I cannot believe medical personnel would be so cruel to a grieving spouse (that's what she was, no matter how she's classified by stupid laws) and to the children.  Everyone who thinks we don't need marriage equality in the US needs to read this.

That's why we have stories like Janice Langbehn's.

Something similar happened to me and Beloved back in February. I was hit by a car, went to the ER, and was hustled in for a CT scan and treatment. Beloved was called because her name was on my "in case of emergency" card. When she got to the ER, she wasn't even allowed in the building. The nearest hospital's ER is in a high violent and drug-related crime area, so the doors to the ER are armored, buzzer-controlled, and the ER nurse talks to you through bulletproof glass in the entryway. The ER nurse wouldn't let Beloved in, wouldn't tell her what happened, or if I was even alive, and instead told her, "You're not family, you can wait in the parking lot." This in spite of the medical POA.

Hospital personnel do this to be cruel for the sake of being cruel. They do it because it's how they get their kicks. They do it because they know they can do so with impunity, without fear of reprisal. Without that critical right of next-of-kin, we have nothing, no rights, and our lawsuits get dismissed. Hospitals and judges do this because they enjoy being cruel to gay people, and we all know where that behavior is taught and encouraged.

I'd tell that c*nt of a nurse, "Either you let me in right now, or I'm coming in with my car!"

That or cal the cops and have the bitch arrested for interfereing with a valid legal document. Had she done that with a warrant for someone's arrest, she'd by up on charges in a nanosecond!

Insanity!
Shades of Anita Bryant!

That is just crazy and cruel. What on earth did the hospital hope to accomplish by keeping this family apart? You couldn't pay me to set foot in Florida after this. If every gay person left that state, Florida would be in a world of hurt. Maybe they need to be sent a message.


Brutal, Inhuman and Sickening
How was this hospital caring for the health of Lisa Pond? She had apparently been stabilized but was left alone to die without the support of her loved ones. Perhaps if they had been in her presence she might have fared better. At the very least, she would have been more comforted. What about "First, do no harm?" What about accreditation standards which uphold the right to have visitors? The argument that once you are placed in a hospital's trauma unit, their obligation to allow you visitors ends, seems medieval and cruel, especially once you are stable. That a hospital can treat a durable power of attorney for healthcare as though it were tissue paper is also infuriating and scary. I would bet that the hospital's  purported "no visitor" policy is discrminatorally applied as well. A hospital that routinely denied  all families the right to be with their hospitalized loved ones would not remain in business very long, whether public or private. We also know that the hospital had a discriminatory motive, in that Jan was told her family had the bad luck to be in a City, State and hospital that hated them. I hope this is appealed and that all efforts are brought to bear to ensure that hospitals in Florida and across the country can't do this again. I also hope disciplinary steps are pursued against the Hospital staff who went out of their way to be vile and cruel.

No Justice from the court....what about assistance from the cruise line?
I am saddened and outraged by this mal treatment from Jackson Memorial Hospital.  My thoughts and prayers are with Janice Langbehn and her family.

I work for a cruise line in Miami and would like to point out that all the major cruise lines operating out of the USA are headquartered in Miami.  The cruise line which made the decision to land a medical condition should be made aware of this hospital employee's malice to one of their passengers.  They have clout in Florida and are heavy players in the Miami business environment.  All the major lines actively promote and advertise LGBQT friendly guest and crew policies and enforce non discrimination work environments. It would be great to see them actively display their commitment and issue a response.  They also happily take millions of gay dollars from guests and charters.  Just a thought on another avenue for possible assistance.


What We Are Fighting For
If the LGBT community truly reflected on WHAT we are fighting for (including the rights that were denied to Ms. Langbehn's family), I can't imagine that we'd still be "fighting" with phone calls, petitions, and donations.    What is at stake deserves much MUCH more than that.

I guess I'll always be part of that tiny "crazed fringe" that sees HOW we fight as submissive, passive, and full of victimhood.    We need to FIGHT like those who will do anything to protect their beloved family and children; they deserve better now - right now.

Appalling & Heartless
Did you hear that Jackson Memorial Hospital has robots working in the administration office? An official robot with no heart, that would deny a family the chance to be with their loved one and say goodbye. I don't give a rat's ass what the "law" was, you mean to tell me that they couldn't have made an exception in this situation? Where time was of the essence? I hope they can't sleep at night.
I am so irate. When I heard about this story I sent an email asking Janice for the addresses of anyone & everyone I could write to in Florida. What good it'll do now, I don't care.
My moms are planning a 10 day vacation in February. They'll be in Florida. If the laws are the same in a few months, I hope they'll come up with a plan in case of emergency. It's pathetic that they'd have to, but I hope that if something unforeseen should occur, they'll be able to be together. Even if it's as "sisters". Pathetic, indeed.
My heart goes out to Janice and their kids. No one will ever be able to give her those moments back. When she should have been by Lisa's side and holding her hand, laying next to her. Whispering all the wishes and prayers in her ear. How can this be righted?

A closed mind is like an unfed lake. It becomes stagnant, dark and unsuitable to sustain life.  

Guess I lucked out
A former member of our gender support group was in the final stages of colon cancer and in a Catholic affiliated hospital. A friend and I were allowed to sit with her for long periods of time on several occasions.

Stop visting Florida
I live in the Orlando area. What you can do as out of state tourists is stop visiting Florida. Stop pumping money into our economy. Call the gay cruises and tell them that you will not cruise out of Florida ports. Gays pump a LOT of money into the economy, especially in the Miami area. Just stop going. I have been boycotting Miami/Dade county and the City of Miami for quite a few years now. If I am heading to the Fla Keys, I make sure I have gas and stuff before I get to Miami. I have not spent a dime there in over ten years. I know my little boycott doesn't help, but if you all boycotted the whole state, I bet it would be noticed. How much money do you think gay days puts into the Orlando economy every year. STOP GOING!!!!! Let hotels and Disney know why you are not going. It does no good to boycott if you don't let the intended target know about it and why!!!

Beyond disgusting
Are there any demonstrations or rallies planned in Miami?  I don't live anywhere near FL but this should fire up even the most passive glbtq out there.

Doesn't sound like this only affects LGBT people.

If I read this correctly, this says that even "traditional" spouses, children, parents, etc. can be kept out of the trauma unit. Is this true? Unfortunately, neither the post nor the Lambda Legal link points to the ruling (if it's available at all).
