The Governator signs major pro-gay bills overnight - but vetos trans rights bill

Some pleasant surprises -- and a downer for the transgender community. Why can't there be a clean sweep? (LGBT POV):
Late last night, Gov. Arnold Schwarzenegger signed the Harvey Milk Day, out-of-state marriages bill and domestic violence protection bill.

"This is huge!" Equality California legislative director Alice Kessler tweeted early this morning.

However, Schwarzenegger vetoed AB 1185 (Lieu), which Kessler described as "a simple bill allowing better access to birth certificates for transgender people." He also vetoed AB 382 (Ammiano), which would have established protections for LGBT prisoners, which he said was "unnecessary."

Equality California (via press release):
Today Governor Schwarzenegger signed into law two historic LGBT rights bills - recognizing the contributions of slain civil rights leader Harvey Milk and a bill that underscores that same-sex couples married before the passage of Proposition 8 are entitled to full recognition as married spouses in California, regardless of whether they married in California or out of state. Both bills were sponsored by Equality California (EQCA) and were introduced by Senator Mark Leno (D-San Francisco). The bills were the top priority of EQCA, the state's leading LGBT rights organization and were targeted by right wing anti-gay groups who worked to defeat the bills first in the legislature and then by urging the Governor to veto the measures.

"We are grateful to the Governor for signing these critical and groundbreaking measures into law and rising above partisan politics to improve the lives of LGBT Californians," said EQCA Executive Director Geoff Kors.
The Harvey Milk Day bill marks the first time in the nation's history that a state will officially recognize and celebrate the contributions of an openly LGBT person with an annual "day of special significance."

"Californians will now learn about Harvey's amazing contributions to the advancement of civil rights for decades to come," Kors said. "He is a role model to millions, and this legislation will help ensure his legacy lives on forever."

The Marriage Recognition and Family Protection Act, also signed today, holds that same-sex couples married before the passage of Proposition 8 must be recognized as married spouses in California, regardless of whether they married in California or in another state or nation. In addition, the new statute also confirms that same-sex couples married outside of California after November 5, 2008, must be given all of the rights, protections and responsibilities of married spouses under California law, with the sole exception of the designation of "marriage."

"We are grateful that the Governor has signed this critical bill, which provides much needed protections for same-sex couples who have legally married out of state, or will in the future, and who deserve to be treated like any other married couple," Kors said. "This bill will allow same-sex couples to get married in other states and countries and ensure they are treated equally under the law when they return to California. Ultimately, however, restoring the freedom to marry is the only way to ensure that all Californians receive the dignity and respect that comes with marriage."

...The Governor also signed EQCA-sponsored legislation by Assemblymember John A. Pérez to help leverage funding for same-sex domestic violence services and vetoed two bills on the grounds that existing law and policy already provided the protections the bills sought to put into statute: the Equal ID Act, allowing transgender people to obtain new birth certificates and the LGBT Prisoner Safety Act, considering sexual orientation and gender identity to safely house prisoners.

"While we believe it is important to have these protections in statute rather than just as policy or court precedent and are disappointed by the vetoes, the Governor's reaffirmation of these policies will hopefully help ensure they are enforced," Kors said.

He denied the Trans brothers and sisters anything at all since they are disposable.
Part of the blame has to go to the kinds of attitudes that I see from some Lesbians, and probably from gay men as well, who attend L conferences as representatives from California

Schwarzenneger is the one to blame here
So why don't you e-mail him with your thoughts? EQCA worked hard to pass these bills and get the governor to sign every pro-LGBT bill on his desk. To suggest otherwise is counterproductive.

Well you know...
we're not really people anyway... why should we have any rights?

Makes me feel like a major fool for the six years I served in USAF Aeromedical Evac saving lives.  I get the privilege of protecting and paying for everyone else's rights while I can't legally marry my wife and I get to watch every day as the we are denied even the most paltry concessions for trans people by the states and federal government.

New Zealand is really looking good to my wife and I right now.

A few quick comments from EQCA
We're disappointed at the governor's veto of the Equal ID Act and the LGBT Prisoner Safety Act. We put a lot of time into all of the legislation we sponsored this year. We're very excited about the victories and are celebrating them, but we are very disappointed that the Governor vetoed two of our bills and are determined to do what it takes to expand protections in the years ahead. We are happy to have gotten all of these bills through the legislature and had hoped for more.

I can tell you as a transgender person working for EQCA that there is a strong commitment here to continue to strengthen protections for transgender people. During the 2009 session, we sponsored state resolutions on a trans-inclusive ENDA and hate crimes bill at the federal level. Both of these passed, putting the California legislature on record encouraging the U.S. Congress to pass these bills. In 2008 we passed trans-inclusive bills that strengthened anti-discrimination protections in insurance and state-funded programs, required health professionals in senior care facilities to receive mandatory training on creating LGBT-friendly environments and strengthened protections for foster youth against harassment and discrimination. Prior to 2008 EQCA passed a trans-inclusive non-discrimination bill in the state that includes employment and housing. We have also passed a state-level trans-inclusive hate crimes bill and passed the only legislation in the nation to prohibit discrimination in health care based on gender identity. We will not endorse any candidate who doesn't support full equality for transgender individuals, including requiring insurance companies and government to cover transition-related surgery.

The governor's veto on these bills is disappointing, but it's far from the end. We'll continue to pursue trans equality in the legislature, and our Health and Human Services Network (a 501c3 project that is run by the Equality California Institute) will continue to pursue trans equality in health care. We are also planning to co-sponsor a trans lobby day with the Transgender Law Center next year. It's clear we need to reach out to the governor and his staff and do some further education work.

Is there any chance on an override of the veto or was the vote too close?

Not really, unfortunately.
We hit the same problem that we keep hitting with the budget process. For veto overrides, just like for the budget, we'd need a 2/3 majority. To get that we would need some broader Republican support that we just don't have at this point.

One other thing to note, though: the Transgender Law Center won a case this year, Somers v. Superior Court. It was ruled in this case that it is unconstitutional to deny a transgender person born in California but living out of state the ability to petition a California court for corrected identification. This essentially covers the same issue that the Equal ID Act does. Having this protection "in statute" as well (as Geoff said in our press release, quoted in Pam's post) could add some extra weight for enforcement, but thanks to TLC's awesome work we do have this right. When EQCA failed the community by helping to hand Prop 8 to the Mormons, I complained loud and long while it was happening and after the fact.  So when it succeeds in serving the community -- as it very often does -- I feel an obligation to say thank you for those victories.

It's mind-boggling that American citizens are still fighting for basic civil rights in the 21st Century.  It's terrible that there are those who still stand in the way of equality.  I'll never understand why EQCA made so many obvious mistakes and effectively surrendered on Prop 8, but I do understand that you can't win everything all the time even when you're actually doing all the right things to win.

Thanks for today's victories, good luck on reversing the losses, and keep up the good fight.

The only way for that to happen is to have a sudden shift where WE in the TLBG family are the majority, and it's the straights who have to beg and scrape for the tiniest of civil rights, while ministers rant about the queers who deny their natural homosexuality and have the audacity to flaunt their perversion of loving the opposite sex!

I was stating it in order for those who feel they're superior to see what it's like to be on the side being discriminated against!

There's a program some elementary schools use called "Blue Eyes/Brown Eyes". For a certain period of time (usually a week), the kids with blue eyes get to be superior -- they get to go in front of the line for recess, lunch, special privileges, etc. Once that period of time is over, then the other colour gets to be in charge. I don't know how the kids with hazel, green or other colours are treated, tho.

I appreciate the kind words, and I admire your passion. We are doing our best to advance rights for the entire LGBT community. Marriage is one of the issues we work on, and we're out for a win next time. We now have 20 field staff in 9 offices across the state who are out going door-to-door with volunteers every single weekend in districts that voted Yes on 8. Whatever it takes, we will win marriage back in California.

I don't live in CA
(I live in the Detroit area, in fact)  But if the Michigan advocacy groups pushed through a bill exactly like this, with the same results, I would simply continue to pester them until they went forward.  I would make sure that they find it easier to push for legislation than to back away from it, lol.

After having transitioned in a customer service supervisory job, standing firm for myself is now second nature.  That's just the sweet smiling, dulcet-voiced spitfire that I have become, however.  YMMV.

What a difference three decades makes
In 1977, a California governor approved of transsexual birth certificate amendments (the law that the 2009 bill was attempting to amend) but disapproved of same-sex marriage (the first CA DOMA.)

In 2009, out-of-CA same sex marriages get the nod while out-of-CA transsexuals get the boot.

Make no mistake, I'm not saying that same-sex marriage should have gotten screwed over at any point.

Still...

There's a reason - well, several reasons - we get a bit annoyed when we see same-sex marriage pushed to the top of 'the agenda' at all costs.  Sometimes it forces the 'long arc of history' into a path taken by a boomerang.
