A few words on Maine and the dying hog of homophobia

Mainers came out in droves for fairness; volunteers from around the country flocked to the state to educate, inform and appeal for equality. There were long dedicated hours spent to preserve the civil right of gay and lesbian couples to marry.

But even in the great state of Maine, there are far too many people who cannot move past the word "marriage" because of its ties to religion and cultural norms. The result is that the filthy hog of homophobia continues to be fed with lies and deception. Witness the reaction of Matt "Bam Bam" Barber. Read it; I know you don't want to, but you need to see the level of hate that propelled discrimination to a victory - historians will pore over this filth decades from now, and wonder how could anyone find satiety in this level of bigotry:

Matt Barber, Director of Cultural Affairs with both Liberty Counsel and Liberty Alliance Action, issued the following statement on news that the voters of Maine have rejected counterfeit "same-sex marriage" by 53% - 47%:

"There's good news and bad news here," said Barber. "The good news is that even in one of the most liberal States in the Union, Maine, the people have once again rejected the ridiculous and oxymoronic notion of 'same sex marriage.' The momentum has again shifted - hopefully for good this time - in favor of protecting legitimate marriage. A counterfeit is a counterfeit. An orange is an orange no matter how much you want it to be a turnip. This isn't about 'marriage.' It's about hurting and broken people desperately seeking affirmation of an objectively deviant lifestyle. One that, even in their heart of hearts, they know to be a dead end. As for the militant 'No on 1' homosexual activists? I'm reminded of spoiled children dressing up and playing house, refusing to come in when mom calls for dinner.

"Here's the bad news. The margin of victory could have been greater. Many behind the 'Yes on 1' campaign, rather than simply telling the truth, chose the Neville Chamberlain approach. They merely circled the wagons around the word 'marriage,' even suggesting that 'domestic partnerships' ('gay marriages' by another name) are acceptable. This makes no sense. If that's a viable compromise, then why not simply allow 'gay' duos the word 'marriage'? It's an incongruity that demands an explanation. This is an historic battle for the minds and souls of our children - for our very culture. The mealy-mouthed approach must end. This is not just about 'marriage.' It has everything to do with forced affirmation of homosexuality - under penalty of law. Indeed everyone who fought hard to defend marriage in Maine is to be congratulated, but if it weren't for a brave group of truth tellers - Paul Madore, Peter LaBarbera and Brian Camenker - who came to Maine in the final hour to hold a press conference and address the pink elephant in the room - homosexual deviancy and the radical 'gay' agenda - counterfeit marriage might have prevailed."

The fact is that it was, yet again, not yet time to test equality when put to a popular vote. It is proof, yet again, that civil rights should never be decided by mob rule -- but the hateful people behind Yes on 1 capitalize on spreading fear -- suckling pigs at the teat of dying, mud-covered sow of homophobia.

The hog is going to die. Hate alone cannot sustain that beast.

We should find solace in the fact that the children and grandchildren of those who voted to rollback the rights of fellow Mainers will be embarrassed that their relatives were so short-sighted, duped by entities that exist solely to discriminate using the ballot box as a weapon -- and making money off of the hate with great gusto.

I want to thank barista Louise for her tireless citizen journalism during this journey; her reporting and enthusiasm exposed us to the wonderful teamwork of all of the No on 1 efforts, she captured the local faces and voices. She opened our eyes to the work that it takes to educate, motivate and GOTV. And a hat tip to barista Lurleen as well there's much to celebrate in Washington state (still so close!), she  illuminated the hard work it took to battle the right-wing haters on the ground there on Referendum 71 in her reporting. It's a coup that the Blend had the perspective of local contributors to show readers the inner workings of activism.

All of those people fighting to kill Yes on 1 are to be heralded for making us see what outreach and organization can do to pull voters to our side -- and the limits of effecting change in firmly held beliefs despite using every tool in the tool box.

It's simply not time, not in this place. What this loss in Maine (and the victory in Washington State) says to me is that I am so grateful that my civil rights, as a person of color, were not put up to a popular vote. As we've seen over and over in the last year, the emergence of naked racism lives despite laws on the books banning discrimination based on race. Reality-based arguments to people who are raised with bias have little motivation to change their thinking outside of keeping their bigotry out of the realm of law-breaking (and even then -- it still occurs!). The feelings simply go underground.

That public expressions of racism have re-emerged and been  cultivated by a major political party shows the work the LGBT community has to do as it waits for equality at the federal level. Changing hearts and minds every day is necessary -- not just when there's a pending bigoted mob rule ballot measure.

LGBTs -- and more importantly, allies -- need to come out of the closet advocating for equality in ways large and small. It's the only way to move many voters, particularly the ones who think they don't know someone who is gay. Too many politicians who support us privately still don't have the spine to step up their game when our rights are under attack. That has to change.

I'm sure I'll have more to say later, but I just wanted to thank everyone for putting so much energy into fighting what is an unfair, unconstitutional battle.

This is the time and place!
If this were a fair election with facts presented to the voters of Maine that were honest and truthful, we would be celebrating a vicyory right now. One year down the road.....ten years...what does it matter, if the opposition is permitted to funnel unlimited financial resourses for a multi media campaign of lies and deception, all coming from the tax exempt churches. This isn't 'the voters of Maine have spoken'. This is 'the church has spoken' and their message won't change. The country IS ready, this is our time.  The No on 1 campaign needs to legally challenge the legitimacy of this election right now. Do not accept defeat. They need to delay in order to demand exposure of the funding sources that a judge has ruled to be public record. This maneuver and exposure will be invaluable for Maine voter's, and for campaigns in the future. Because there will be future campaigns

Thank you, Pam and Louise and Lurleen.  The dying-hog metaphor is most apt and is much needed today.  We ARE going to win.

Hope For the Prop 8 Federal Lawsuit
Wonderfully written article, and big thanks to Louise and Lurleen for providing their perspectives of these important ballot measures and campaigns.

If I could chime in, I absolutely agree that these ballot measures are unconstitutional to begin with, and I am very glad that Olsen and Boies challenged Prop 8 and the CA Supreme Court ruling over it in Federal Court.  I sincerely hope that the US Supreme Court considers setting a precedent that no pre-established fundamental civil rights can be taken away by a public vote through the initiative process in any state and locality.  If we can achieve this, our civil rights movement towards nation-wide marriage equality will come much faster as state legislation and court rulings will not be nearly as easily overthrown like the flick of a penny.


We all know how hard No on 1 worked
but a loss is a loss. We are 0-31. It's not going to help to fill this thread with moral superiority.We are BIG LOSERS. AGAIN  Something is not working. Our ads were uplifting. To us. Smiling back while under attack clearly does not work. We need to call them bigots on TV and in print, just like they call us child predators.

I think it's stupid to keep on fighting ballot measures. We need to be more strategic. NO MORE focusing on states that have easy mob rule reversal referendums. Court fights and working in states that don't allow mob rule tyranny over the majority is the only way. Maine has a history of overturning our gains. Anyone who thought the Maine legislature passing it was permanent needs to wake up.

Taking the "high road" may make us feel better but it's often a loser politically. Win dirty or lose clean. I like the former. Our enemies know how to do it. We need to learn as well.

I'm tired of the positive think happy crap.  We LOST.  That is not a case for joy or "well, we almost made it."  Do you think other minorities celebrate their losses?  We have been screwed and we should be fighting just as sleazy as our competition.  And Maine can go to hell right with California.  We can spend our money and time elsewhere.  Vacations, products, tourism--send them notes saying (like Arnold did) FU.

Don't view this as a "we have to fight dirty" issue, just "we need to be more assertive".

Fight Back-Stop Sacramental Marriage
I object to a Church claiming the sole right to define and to santify marriage.

I object to their imposing their rules upon me, a non-member and campaigning to keep their rules enshirned into law.

Therefore, I ought to have the right to protest whenever they try to perform a "sanctified" marriage by their rules, since I object to their rules and find them discriminatory and in the end persecutory.

....to find out how a marriage that cannot "procreate" is a threat--because by Yes on 1's definition, my own marriage is a threat because my husband and I are incapable of procreation and therefore "oxymoronic". Since, after all, these people love to state that the purpose of marriage is procreation.

Our battle is not over!
It took 144 years for women to get the right to vote! Only 13 states passed a Women's Suffrage ballot imitative, but some of those took multiply attempts before they passed. However, 16 states did not pass the Women's Suffrage voter initiatives and in Oregon it took six attempts before it passed.

Human Rights should not be subject a popular vote! The LGBT population is only about 5% of the population, but 47% of the people came out to vote in favor of the basic human right to be able to marry the person that you love.

And Thanks to Louise and Lurleen for all your hard work.  No one ever said this was going to be easy.  If everytime we lost we just roll over we would not get anywhere.  Yes, we lost...this time but it's not a time to give up.

What we have in our favor is that people who are on the side of marriage equality don't shift back over to the other side.  5 short years ago how many states passed DOMA?  What were the margins?

Civil Rights should never be put up to a vote plain and simple but the Right is losing.  Maybe not yesterday but they are.  Look at the younger generation, they are growing and the older biggotted ones are dying off.  This is not going to be an issue in the future, unfortunately we are living in it now.

It took Maine 3 tries to get protections for its LGBT citizens if they gave up after the first time where would they be.  We pick ourselves up, clean the wounds and start anew.  We're not going away and this is personal to us.

I think Washington State will win because the 'churches funding the hate machine were in overdrive in Maine'. My suggestion is to place voter referendums in every State (that doesn't have SSM marriage yet) all on the same day. We will call it Equality Day! There is no way they can amass the funding to fight every one of these battles at once. Clearly we are a true grassroots local movement with donations and volunteers at the local level, and can sustain this type of effort.

Staying power is key...
Reading Bam Bam Barber's comment, it struck me that he's looking toward the end of his battle, talking about "the momentum shifting, hopefully for good this time". Maybe I am reading too much between the lines, but I don't think he and Maggie Gallagher, and Peter LaBarbera, and their friends in fundamentalist churches realize that they will have to fight this battle indefinitely. They will have to devote their entire lives to oppression, and in the end, it won't be enough. GLBT people and their families aren't going away, no many how many popular referendums we lose. We have no choice but to stand up and fight for our rights and the rights of our families, and we will still be here long after they are gone.

No On 1 / Protect Maine Equality did a great job of organizing. We should all be proud of what they did, even though they didn't win this battle. I am heartened by the strength of their effort.

Barber and his ilk continue to speak about gay marriage as if it is something that doesn't exist or that can be eradicated.  They conveniently (and strategically) ignore the fact that every week, there are ever more gay marriages in this country,  thanks to the four states currently performing them (with NH set to come online soon)--and we're not likely to see that change.  There isn't, for example, even a glimmer on the horizon that Vermont, say, will move backwards, and even the 2008 marriages in California have been locked in by a unanimous state supreme court.  Gay marriage is part of the legal and social landscape in the United States, and no matter how many elections the other side manipulates with their fear-mongering, it is something that will continue to exist for their entire lifetimes.  We have our proverbial nose in the tent, and however painful votes like Maine's are, the setback will ultimately prove temporary.

I had planned a week to 10day vacation in Maine this upcoming summer....and I usually spend upwards of $2000 on vacation....I cancelled it this am....I'll spend my money in Inclusive states...Mass, vermont, NH.... I called Maine's Tourism Brd this am..and Told them WHY I cancelled it.... if you have a vacation planned there,and wanna cancel it...call'm and tell'm why..they can ROT!

is to contact the Maine Senators and Senators of your home state. ENDA Senate hearings are tomorrow at 10am. Now more than ever the gay community needs Federal protections from being fired from our jobs, and our opposition has already launched a phone campaign to our lawmakers. Imagine that.

Both Collins and Snow are co-sponsors of ENDA, but we need a push from them to get other Republican Senators on board.

It's that simple.  They hate us.  Almost everywhere there's a vote (how silly is it to VOTE on a citizens equal rights? - but that's another story) we lose.  This, no matter how we couch it    ----    we lose.

The problem is religion.

there, I said it.  The problem is religion and the way it poisons minds.

It doesn't matter if it's "the black church", the Roman Catholic Church, various and sundry Protestant denominations, Orthodox Jews, Muslims, Mormons, etc., etc., etc., etc.

"Pastors", "shepherds of the flock", etc., etc., etc. wield way too much power.  They affect education, they foster ignorance, they sometimes have what amounts to the power of life and death over their "sheep".

It doesn't matter what WE say, how much WE try to "educate", for the haters it's a "matter of faith"  --  no logic, no "facts", no "reality" can penetrate the armor of "faith".

We will not win before this current religious fervor diminishes  --  and that doesn't seem likely to happen simp0ly because the control suits our leaders too much.

So, let's get over ourselves.  

The majority of folks don't care if we live or die.  The great majority would be happier if we didn't exist  --  or went back in the closet.  It hurts their little minds to have to think, to look at us as human beings, to see us as real people.  

To many we are just a bunch of stereotypes  --  hairdressers, gym teachers, etc., etc., etc.  They like it that way.  They want us as characters on some sit-com, some day-time talk show host ("isn't she cute")  --  look what happened to Rosie when she tried to be fully human.  Do you see her on TV anymore?

But MARRIAGE?  Full CIVIL RIGHTS? NO!!  Don't we know our "place".  We are always the kind of outcasts "liberals" and "open minded people" can include in one or another gathering  --  if they feel like showing off their "inclusive" side.

Let's focus on building our lives.  Let's focus on community.  

In some ways we are like the Jews in bad old Germany  --  somewhat assimilated  --  ripe for the picking.

Let's fight for our basic right to exist  --  ENDA, hate crimes    -----    all with the understanding that if "things" happen to us (especially if we are "troublesome"), the police might not respond, people might just not give a damn (Well, she brought it on herself - what did you expect?).

Also, let us stop all the infighting  --  it is NOT our "fault" this stuff doesn't pass   ---   people hate us at a deep visceral level  --  get used to it  --  especially in these days when someone like Obama passes as a Democrat, or (here's the real joke) a "Progressive".

In Maine, marriage is more a civil institution than most states
While churches had a profound impact in furthering hate, I don't think you can pull up the very widespread misconception that "marriage is a religious institution" to explain the triumph of bigotry in Maine.

Maine is one of only three states -- the others being North Carolina and Florida -- where the signing of marriage documents is a purely notarial act that can be "officiated" by any appointed notary public, no clergy or judge required.

Personally, I think it is very long past time for clergy to be stripped of this special authority. Religious hocus-pocus has no legal standing anyway, so why should clergy have this power? Give it to notaries public in every state, and the lie that "marriage is a religious institution" will vanish in a puff of incense smoke.

Plus ça change, plus c'est la même merde.

With all due respect, Pam, I think you are mistaken.  Have you seen the Virginia election results (I am a Virginia resident)?  Hate rules, and I see no sign that it will not continue to do so for the foreseeable future.

"LGBTs -- and more importantly, allies -- need to come out of the closet advocating for equality in ways large and small."  I agree with that as far as it goes.  I also think it is unrealistic not to at least consider the possibility that a majority of Americans actually believe their personal religious opinions regarding gays, abortion, contraception, etc., ad nauseam, should supersede the law of the land.  I apologize for not having any suggestions what to do about this, but this morning I am thoroughly demoralized.

6-12th graders, soundly approving R-71 in their mock election. In just 8 short years, they'll be 15% of the voting public, and the current GLBT-friendly 18-29 year olds will be another 15-20%.

One small personal victory from very rural Maine- my mother, father, aunt and 2 elderly friends all voted NO.

Last spring, I spoke with Mom at length clearing up misinformation collected over 60+ years. She is now a staunch supporter and w/o me asking, took it upon herself to initiate conversations with the others listed above.

That my father and his sister, 2 of the nastiest, most hate-filled people I know, voted NO- that gives me hope, determination and some insight as to what has to happen next.

Mom called me this morning and gave me a list of what she feels was overlooked/ could have or needed to be done better, to educate her peers.

I see the way- I know what to do- and this is NOT over. And my personal commitment just got stepped up even further.

Pam, I may tap your brains via emails later on for some feedback- too exhausted now and need a day or so to rest up...

I wish that I could say that I've been as effective as you in persuading my family members to re-think their position re: LGBT rights, but alas, I cannot. I do feel more hopeful, though, in reading how your own family members have changed their minds.  It goes to show that those who aren't brainwashed by the church can reason and be influenced by the rest of us.  THANKS AGAIN.

some sobering news from a reader
This was in my inbox from a Blender:
I had breakfast next to 4 legislators who are part of the Republican leadership in NH. They were discussing the election.  Their internal polling had nailed the results of the Maine election; 53% yes to 47% no.

They told me their polling shows 30 to 40% of the voters do not like homosexuals to various degrees (the Homophobes) and will march through a blizzard to vote against anything gay and feel any pro gay vote directly affects them.  A greater number favor gay rights, 45 - 50%.  The only difference is the gay rights supporters feel they are not directly affected by the issue and are not driven as strongly.  Roughly 4 to 5 percent of the population is gay and is strongly for gay rights and is directly affected by the vote. The strongest support of gay marriage is from the well educated and the least support from the less educated mostly in the rural areas.  They also said the Maine voters are tired of the gay issue and that it may be years before it ever has a chance in Maine again.

They told me it's much easier to wage a negative campaign than a positive campaign because you're not restricted by the truth and can state anything at anytime to play to people's fears. All they have to do is strike a fear in 5 to 10% of the voters to win.

Although the Republican's did not directly get involved in the Maine vote they were watching closely. They told me that NH is almost a perfect copy of the Maine electorate.  They plan to use the anti gay 30 -40% in NH to win back the legislature and the Governor's office.  They claim it will be easier in NH because they only have to target a few weak Democratic candidates to get the legislature back.  Their problem is the Governor,  but with the economy combined with the tea bag mentality they think he will be vulnerable. And even if he wins he is not a strong supporter of gay rights and may not veto any bill to kill gay marriage.

I dread this happening.  The only hope I see is that gays will be getting married here by the time the election rolls around and it might sway a few voters. A lot of this I blame on Washington. I have the urge to go to Washington and personally kick Obama in the ass to get him moving.

Ah, but it's not merely hate - it's religiously-backed ignorant hate, monetarily-backed religious idiocy.  Which is why with regard to equal rights for gays (much like the teaching of evolution) being decided by the electorate, this hog's death is asymptotic ... the hog may approach zero (death) but will go on indefinitely.

To last, this has to be addressed as unconstitutional discrimination (as well as a separation of church/state issue) but I wouldn't want the current SCOTUS deciding the case.

Keep up the pressure on the courts to get those donor's names released. You might come into states and lie and stir up hate against us, but you don't get to do it secretly.
I swear when some of the same CA H8 donors names get exposed, the anger won't just be a little more, it'll be ten fold.
Bam Bam lied about Maine being a liberal state, it isn't and never was. It's a bluish purple state, moderate Republicans have represented for  decades.
louise and Snooky, kev, john, mainewriter and others worked so hard, we ran a campaign that honestly showed our families, it was funded well, and a superhuman amount of effort was expended...yet hate still won.
None on our side bear any blame or recrimination, it's putrid folks like Bishop Malone, goons like Knights of Columbus, Dobson, Perkins, LaBarbera, Galagher, Mutty who bear the blame. Mormons if we find your names, Angel Moroni help you.

Tax the church
Can't we begin to plan an initiative to tax the church and put that up to a vote?  How can we and our organizations ever compete with religious organizations who are untaxed and well organized?  Tax them and see the bigots run for cover.  Maybe if we start on a somewhat level playing ground, our chances of success will improve. I'm still thinking that federal legislation is our best bet, however.

It is truly sickening to see hate and deliberate lies prevail.  You hit part of the problem, however, right on the head - more of us need to come out of the closet and force the bigots to see (1) how numerous we are and (2) that we are their neighbors, friends, co-workers, doctors, CPA's, police officers, etc.  It is far more difficult to vote for hate when it impacts someone you know personally. Things will not truly change until enough of us live out and proudly as citizens.

President Obama standing on the sidelines in Maine and Washington was appalling. The failure of our national organizations and leaders to demand his involvement was equally appalling. The outrageous act of the Democratic National Committee sending an email into Maine asking Maine Democrats to call into "NEW JERSEY" instead of to support the fight against bigotry was unbelievable. No one gets to sit on the sidelines in an epic battle against apartheid and no one gets a free pass. If you want our support, you have to earn it. We are way beyond where we will accept a little bit in 2009, some in 2010 and maybe more in the second term. Does anyone think after yesterday election results and the upcoming 2010 election, Obama has the ability to repeal "Don't Ask, Don't Tell" and "DOMA" next year? Does anyone really believe we haven't already missed a historic opportunity in the first 10 months of this year? Only a courageous fighting President and Congress can now help turn us this around and that we have not seen so far. Enough.

No more ballot drives on our side
CA needs to stand down. They are delusional along with the idiots who want to go to the ballot box in Oregon. NOM should just put them on the payroll. Wake up people.

We are 31-0. This strategy sucks. Read the New York Times article on our latest defeat today. We are serial losers and our going back to the ballot just gives the other side more victories. The easy states are picked off. Dump this tactic and focus on ENDA,DADT, and working for marriage strategically in the court system and in states that don't have mob rule veto power.

With their defeats last night the White House is only going to be focused on the economy. Do some of you actually believe Obama is going to push gay marriage as winning issue in 210 after our latest ass kicking? We are a joke to them.
