2 Months Into NH Marriage Law Going Into Effect, The Fight Now Goes To Town Meetings

Here we go AGAIN.


A conservative group's effort to push for a statewide vote on a constitutional amendment to ban gay marriage has met with mixed results.

A number of towns will be weighing in on an article at town meeting this March that asks if the people should be allowed to vote on a constitutional amendment defining marriage. The resolution complements a bill sponsored by state Rep. Dudley Dumaine, R-Auburn, that would create a constitutional amendment defining marriage as between one man and one woman.

But some towns have rejected the idea of voting on a resolution that essentially calls for overturning the state's same-sex marriage law.

State Rep. David Bates, R-Windham, is spearheading the petition drive and has formed the group "Let NH Vote" to promote the effort in towns across the state. Yesterday, Bates said he expects votes will take place in at least 125 towns, and he is waiting to hear from more.

Towns in some remote areas have gone ahead and gathered petitions without any help from Let NH Vote, he said.


"It's all over the state. Every county will have (towns with) a question on the ballot," Bates said.

Although a precise count of participating towns was unavailable yesterday, some of the towns the resolution will be voted on are: Allenstown, Auburn, Charlestown, Danville, Hampstead, Litchfield, Littleton, Londonderry, Newton, Pelham, Plaistow, Rye, Seabrook, Sandown, Stratham, Swanzey, Wakefield, Weare and Windham.

Success in towns like Londonderry has been attributed to the group framing the debate not as a gay rights issue, but as a voters rights issue. Londonderry town councilors on Monday overturned their previous decision not to put the resolution forward and accepted a new petition after a flurry of angry calls from residents.

State Rep. Al Baldasaro, R-Londonderry, who submitted both petitions and is the sponsor of a bill to repeal gay marriage, said it was the desire to vote that helped him gather more than 900 signatures.


"The people in this town are saying they want to vote," said Baldasaro. "Even people who are in favor of (same-sex marriage) wanted to have a vote."

I've got a better idea for my New Hampshire neighbors: let's vote on the rights of Baldasaro, Bates and DuMaine to marry!

Let's vote on THEIR rights, their families, their privileges! Their protections under law, their coverages on a laundry list of insurance policies, deeds, medical forms and the like...

23. Veterans' discounts based on spouse's armed forces status.

24. Assumption of spouse's pension after death.

25. Ability to file joint bankruptcy.

26. Ability to collect unemployment benefits after leaving a job to relocate because of spouse's job move.

27. Ability to transfer property from one spouse to another without transfer tax consequences.

28. Access to fostering children.

29. Automatic next of kin status for emergency medical decisions and hospital visitation status.

30 Immigration and residency priority for spouses from other countries.

31. Ability to invoke spousal privilege in a court of law.

32. Access to reduced-rate memberships at health clubs, social clubs, and other organizations.

33. Prison visitation rights.

Voting on Gay Marriage
And when we are stuck with a vote, our groups need to make ads calling out those rights. We tend to make these touchy-feely ads that talk about marriage in a nebulous way, when what we need are the ads that say things like "my partner got hit by a truck, and I wasn't allowed in the ICU to be with her when she died because we couldn't be married." People who aren't gay don't necessarily think about these things.

I've seen both kinds of ads
Trust me, whichever type gets used, someone will bitch that the other kinds wasn't.  Either type is effective with parts of straight society, and no one type of ad will ever be effective with everyone.

Baldasaro
Baldasaro is full of S _ _ t!  99% of the people signing his petition are anti gay marriage. Who's he trying to kid. He says all he wants to do is vote but he never wants to vote on any other bill, just the gay marriage bill.  

Which is why
As flippant as it sounds, I would suggest a similar petition drive to vote on HIS, and every other heterosexual couple's, right to marry.

Here's the thing: As it currently stands, his right is recognized as legally equal under New Hampshire state law to that of a same sex couple.

To be able to vote on the legal status of ONE couple, versus another, with equal status, IS DISCRIMINATORY.

I think it could be argued that the very petition itself is illegal.

This is why I thought it could be argued in Maine that the referendum process last fall was discriminatory and illegal.

We had a law that our House, Senate and Governor all agreed was constitutionally acceptable- so they passed it and signed it into law.

The People's Veto/ referendum process did NOT address all of the marriages in Maine- only the same sex couples' marriages. The law had not yet gone into effect, but I see that as irrelevant.

The two circumstances of marriage, same sex versus heterosexual couples, were EQUAL. And elimination of one of these 2 was discriminatory/ in violation of Maine's constitution.

Any lawyers out there wanna weigh in?

Now that all marriages are legal in NH, that's how we need to frame it.
No votes on just same-sex marriage. If people want to vote on the legality of marriage in New Hampshire, make them vote on the legality of marriage. Make the ballot question a simple up-or-down vote. Is marriage legal in this state, or is it not?

It was such a relief when I moved to Massachusetts last year, and I feel like I had to pick the burden back up when I traveled south to visit family in the fall. I haven't in the past week, but I regularly make trips to Nashua, Pelham, and Plaistow. Crossing the state line is going to feel heavy next time I do it, until this nonsense gets a) kept from the ballot or b) voted down.

this is something i have difficulty getting friends and family to understand.  it is depressing, because it tells me that they haven't internalized my plight even a little.

Yup.
The GUILT I felt, as my privileged state of a legally married person in Maine was re-established, the night of November 3rd- GAH. Overwhelming.

We at the bloggers table had access to the numbers far quicker than anyone else in the room. And when it became apparent that there was little chance, I passed my laptop to Kevinchi and JohnVisser and took my beer for a walk through the crowds.

I knew that a few blocks away, Frank Schubert, Mutty, Emrich, and all of the Yes On 1 folks were starting to celebrate- and for the life of me, I will never understand that they didn't realize what had occurred.

They didn't defeat the Mainers that were now being denied the right to marry; they damaged the institution of marriage in  Maine.

We will right this wrong; it's just going to take some time. But this discrimination will be corrected... here and nationally.

It is NOT going to the polls
Both bills to repeal gay marriage are already being voted down by a bipartisan majority in the state legislature. And even if they get 60% of the state legislature to pass a constitutional amendment, they still need 2/3 of the electorate to approve it which is virtually impossible unless we're talking about Georgia or Utah.

that numerous towns will vote on a non-binding resolution at their town meeting this spring.  more on that here.
