Same-Sex Marriage Can Help In Economic Recovery

The Defense of Marriage Act (DOMA) and the religious motivation for the law is a clear violation of the Establishment Clause in the first amendment of the U.S. Constitution. Congress over-reached its authority under the law and discriminates and violates the Equal Protection Clause. The law violates the fundamental right to marriage (including same-sex marriage) under the due process clause and it should be repealed immediately to help reconstruct the economy.. Supporters of DOMA argue that the act is a legitimate exercise of Congressional power under the Full Faith and Credit Clause and the act does not violate either the Equal Protection Clause or the due process clause of the United States Constitution.

On June 21st, 2004 an analysis from the Congressional Budget Office called “The Potential Budgetary Impact of Recognizing Same-Sex Marriages“, was sent to Honorable Steve Chabot, Chairman, Subcommittee on the Constitution, Committee on the Judiciary, U.S. House of Representatives at his request. The analysis stated that recognizing same-sex marriages by the Federal government would affect federal revenues through both the individual income tax and the estate tax. Revenues would be higher: by $400 million a year from 2005 through 2020 and by $500 million to $700 million annually from 2011 through 2014. A billion dollars earned from Federal tax revenue is what would be added to the U.S. Treasury every three years if same sex-couples were allowed to file Federal Income tax forms.

The stock market keeps on crashing as I predicted with my words of warning written in the Wall Street Journal, Oct. 31, 2007. No one listened. Not lawmakers, not President Bush, not Vice President Cheney. Exactly a year later after my warning, Christian evangelicals gathered around the Merrill/Lynch bronze bull sculpture, the standing one with shiny low hangers to pray for a bull market.. The organizer of the prayer group stated to Pat Robertson’s 700 Club, “This is so severe in the economic area because we are facing judgment from the actions, not only for our stance towards Israel, but our blatant sin against Him in passing laws such as the one allowing homosexual marriages.”

President Obama promised in his campaign to sign a repeal of the Defense of Marriage Act once Congress hands him the repeal law.. I of course am speaking of marriage as a civil marriage. Ms. Nair, a Chicago based journalist recently blogged, "Couples can get married in the Church of the righteous cheese cracker, but the marriage will not be official until the paperwork down at the courthouse goes through in regards to getting the privileges accorded to married couples. In fact, the state also has to recognize the validity of a person's authority to perform a wedding, before the wedding is legal. Authority over weddings is purely a government controlled process, the church stuff is only window dressing."

My late wife Evangeline and I were married by my brother in law, J. Seward Johnson on his luxury yacht “Ocean Pearl” sailing in the waters off Hobe Sound, Florida.. Although Seward was a captain of a ship and had the authority to conduct a marriage, a Florida Justice of the Peace was also in attendance to make sure our marriage was recorded in the county records.. Evangeline and Seward’s father founded Johnson and Johnson Pharmaceutical Co. and our tax bills as a couple filing jointly were huge adding a lot to the government‘s revenue.. As a one man one woman marriage we were also allowed to automatically receive the 1,138 benefits allowed by the Federal government and Internal Revenue Tax Code. Evangeline and I were a couple for 23 years.  Evangeline passed away and I fell in love with a man and have been with Kevin 18 years.

In 2004 I organized a tax protest against President Bush’s initiative to amend the U.S. Constitution to define marriage as only a union between one man and one woman. Kevin and I are legally married in the State of California.. We are treated as second class citizens by the government seen as the "ick" factor.  The Internal Revenue Service claims I owe millions of dollars in past taxes since 2004 and my case goes to court in May at U.S. Tax Court, San Diego, California. .

Celebrities such as performing artist Melissa Etheridge have joined the tax protest and recently said on “Oprah” that she would see if she will pay state and federal taxes come April 15th, 2009.. If nothing is done soon to start the repeal of DOMA, the consequence of having thousands of gay, lesbian, bisexual, and transgender community members angry to the point of not filing taxes April 15, 2009 is a real possibility. The tax discrimination protest could further add to crashing the economy.

Yes - widowed.  Sorry, Charles, you silly Canadian goose.   Mentally I think I switched our stories (wishful thinking) where I was widowed [from my EX] and you were just divorced.    Oops.

I just wish we could round up all of those who have been seriously harmed by things like DOMA, since THEY are the ones who have been most hurt, many devastatingly so , and are ANGRY ENOUGH to chain themselves together, tax protest, or sit in somewhere where we can do some REAL civil disobedience AS A UNITED GROUP.

Even though Equality is OURS TO TAKE - WE ALREADY DESERVE IT - we are still begging for it as if we're not really sure we are ALREADY ENTITLED TO IT.

Thank you for this beautiful story.  It is heartwarming.  I said I wouldn't pay my taxes, but I don't make enough to make a difference.  I think I agree with petey about not backing any politician who does not support a repeal on DOMA and passage of an all-inclusive ENDA.  

Can't quite participate...
I make little enough money that I need my refund.  Hopefully by the time I could afford to participate, I won't need to...

? Will HAGGARD pay his taxes...

On the taxes...
I suggest that gay couples get married in their church or synagogue and then file joint tax returns.

The problem is that you have to keep your withholding low enough that when you file you will owe taxes.

If you file a joint return as a same-sex couple, the IRS will likely change your filing and then adjust your refund, so you have to make sure you are paying them, not the getting a refund.

If all same-sex couples were to file jointly, as above, there'd be plenty of protection.

Even if only a few dis this, you'd likely have a pretty good legal case.

As a heterosexual woman, I'd be willing to do something with my taxes, such as not filing, but it is a chicken and egg thing. I'm not willing to be one of three people who refused to file and I don't know how you could verify that the number of non-filers is large enough to provide some safety from prosecution.

I can make the argument that the tax system is unfair to gays, but I can't make that argument about myself, so it is more important to do this as part of a large group.

not a good idea,
because it would help perpetuate the myth that a church marriage is the same as or even more solid than legal marriage.  this is a major point of confusion for many americans, and is milked by spineless politicians like obama when they want to find excuses for not tackling legal heterosupremacy.  we should never do anything to perpetuate this confusion.

My point is this...
By marrying in a faith community and then filing a joint return, you can claim discrimination based on religion in court.

Bottom line is that religion should not determine public policy, as you correctly point out. However, religious views have been adopted as law in this situation and are preventing same-sex marriage from being implemented at the federal level.

So, I say, use the enemies' argument against them.

I agree that the "freedom from your religion" argument needs to be used by religious pro-equality people.
I just don't think this is the best way to make that point.

Maybe, maybe not
I'd say that's up to the attorneys looking for ways to win in the courts. I'm for any argument that will fly in the courts.

I've always thought that the religious discrimination argument is a good one, but I can't recall it being used for this purpose.

I'm an Episcopalian. We have gay clergy, such as Bishop Gene Robinson, and marry same-sex couples. Why should couples that my church will marry be discriminated against in federal law because Baptists won't marry them?

You are right
The issue should be challenged in court.  DOMA was intended to endorse the traditional, Judeo-Christian concept of marriage over and above other religions' views.  While some religous groups firmly believe that marriaqge, civil or religious, should be limited to heterosexual couples, other religious groups strongly disagree.  The United Church of Christ - the denomination of both the Pilgrims and President Obama allows its clergy to perform same-sex weddings and has come out strongly against Proposition 8 in California.  The Interfaith Working Group, for example notes that seven religious organizations grant same-sex marriages "as a matter of policy", and that two other groups leave the decision on same-sex marriage to "clergy, congregations or local governing bodies"  By deciding that the issue of same-sex marriage is in favor of one religious view over others DOMA unconstitutionally endorses that belief.  It fails what as know as the "Endorsement Test".

in the court of public opinion
this fact can get some traction.  but no civil court is going to rule marriage restriction laws invalid simply because some religious groups disagree on that law.  sorry, but i see this as a non-starter with the courts.  but of course i could be wrong, so if you can point me to some legal reasoning backing up your approach, i'd be interested in reading it.

I argue that DOMA is a violation of the Establishment Clause under any of the three tests the Supreme Court has created.  (case laws).  First, under the Lemon test, DOMA was motivated by a religious purpose and its effect has been to unconstitutionally establihs religon.  Next, under the Endorsement test, DOMA'S purpose and effect were both the endorsement of one religious view to the exclusion of all others.  Finally, under the coercion test, DOMA unconstituionally compels the acceptance of a specific religious belief.  I will send you all 22 pages of my argument and attach it to an email if you wish.  My e-mail is CHARLESMERRILL3@AOL.COM

The poll about taxes...
Uh, there was no answer on the poll that stated "I would like to participate, but my employer takes my tax money automatically before I get my pay check".

How do we not pay our taxes in protest when it is taken by our employer? Sure I could claim 1 and then at the end of the year I'd owe, but that would only be a fairly small amount, most of my tax bill would have still been taken out of my paycheck before I got it. How many people work and get a paycheck? None of us would be able to participate.


there is a form you can file
that allows you to pay estimated taxes yourself rather than have your employer withhold them.  ask your h.r. department if interested.

As far as tax protests go

it might make more sense to simply calculate one's tax based on the married filing jointly status, and to pay that amount.



Don't file jointly
Unless you want to be charged with a felony.  That would put you in deep do do.  It is a felony for same=sex legally married couples to file a Federal 1040 jointly.  "failure to file" in protest is a misdemeanor.  A repeal of DOMA will lead the way for Federal recognition of state marriages.  Don't let law makers and President Obama redefine same=sex marriage as anything else but what it is, marriage.

Charles, what are the potential punishments and financial penalties?
It's nice to think about these protests in the abstract, but I doubt you will interest many (any?) in joining the protest unless you lay out what is at stake.  for example, who will pay for legal counsel for protesters?  what sort of financial fines and penalties might a protester face?  is jail time a potential outcome?  etc etc.

$25,000.00 fine or l year
in prison for "failure to file".  I am in an unique position and don't recommend this for everyone.  I am an old dude at the age of U.S. male death expectancy (74) so prison doesn't scare me.  Anyway, it would be low security prison and people my age are given jobs like watering the flowers.  My aim to take this to appeals court where constitutional issues can be challenged.  My attorneys wanted me to settle, so I fired them.  They just didn't get it and were looking out for their own interest and pocketbook.  Due to the Internet and Lexis Nexis for case law, it is amazing how one can research and put in hours that lawyers would charge by the hour.  U.S. Tax Court where the cases would start is a statutory court.  The judges can only do what the laws say they can do aka DOMA.  The appeals court is where the constitutional arguments against DOMA can be made.  
There was a previous case 1996 Chicago, where a gay man filed jointly with his husband - Mueller v Commissioner and challenged DOMA and he got prison time.  The judge ruled that it was frivolous.  Of course that was 13 years ago before some State marriages were legal.

Not 'Filing' your taxes is stupid...
...unless you have arranged not to have anything withheld beforehand.  If you don't file, you may not get the refund you are due.

If you can arrange to have Payroll, Social Security, and Income taxes taken care of individually and privately, then by all means, stop filing.


Stupid for you
with your boss automatically taking out weekly witholding tax .  Some people don't have anything taken out, and are independent contractors or retired and have control of paying or not paying taxes.
