Bar exam flunker has hat in hand to fight marriage equality in Massachusetts

This guy Stephen Dunne has already had his 15 minutes of fame, and I don't really feel like giving him another 30 seconds of it, but this is so lame-o that I couldn't resist. He's raising money on a website so that he can defeat Homosexual Marriage.
My dream is to become a Lawyer, but I cannot defile my Christian faith simply to pass an examination. I will not pay the price that the Defendants are forcing me to pay in order to practice law in Massachusetts. There is no price tag on my faith. It is not for sale.
As reported in an earlier Blend post by Dana, Dunne is sore because his score of 268.866 just missed the 270 points he needed to pass because of a question he said required applicants to "affirmatively accept, support and promote homosexual marriage and homosexual parenting," violating his First Amendment right to exercise his religion. 
On June 25, 2007, I filed a Federal Complaint challenging the inclusion of the question regarding Homosexual Marriage and Homosexual Parenting on the Massachusetts Bar Examination. Furthermore, I am challenging the constitutionality of Homosexual Marriage and Homosexual Parenting in Massachusetts. In 2003, four unelected judges legalized Homosexual Marriage in Goodridge v. Dept. of Public Health, 798 N.E. 2d 941 (Mass. 2003). I sincerely believe that this ruling is profoundly undemocratic and un-American.

[Modesty abounds...]I have preemptively fired the first shot that has been heard around the world. An Army of Liberal Lawyers led by the Massachusetts Attorney General stand at the ready to dismiss this lawsuit as quickly as possible. If I am to successfully challenge the constitutionality of Homosexual Marriage and Homosexual Parenting in Massachusetts, it will be because of the generosity, support and conviction of my fellow Americans. I cannot overlook the passage in Matthew 10:16: "I am sending you out like sheep among wolves. Therefore be as shrewd as snakes and as innocent as doves." With that passage in mind, I plan on hiring America?s #1 Law Firm to help me win this case. Justice is expensive in America, but with your support it can be realized. Litigation expenses, expert witnesses, court costs and legal fees associated with legal research are only a sampling of the costs that must be paid to guarantee victory and protect the faith of the Founding Fathers of this beautiful Country. I humbly solicit your support and will gladly offer an accounting of the funds received by a Tax Attorney/CPA. The majority of donations will be utilized exclusively to fund the incredible expenses of this Federal Lawsuit. This case is about the protection and defense of Christianity.

Wow, so it's worse than we even thought! He's not just trying to have his own bar exam given a passing grade, but he's also trying to end gay marriage in Massachusetts! And he, someone who should know a thing or two about religious freedom and separation of church and state, is basing his ENTIRE CAMPAIGN regarding a civil institution on his own personal faith views!

Frankly, I'm surprised the Taliban at the Alliance Defense Fund haven't picked up on this.  They love to champion baseless, wing nut cases like this one.  He mentioned hiring "America?s #1 Law Firm", but ADF sure doesn't qualify for that!

Hey!  If he'd passed that bar exam, he'd be able to represent himself! :-D

  Don't you see, he should have claimed to be an ex-gay that found Jesus, then he would have them falling all over him, and the $$$ would be rolling in for him.

Perhaps he failed the bar because he has such a poor grasp of the English language; especially as it relates to rhetorical improprieties.

Mr. Dunn needed to study harder not attempt to find a loophole.
It appears that he is making the issue that he was forced to answer a question incorrectly rather than violate his principles.  It appears to me that he should have studied harder so that he answered one or two other questions correctly and therefore he would have given himself the luxury of passing on the gay marrage question. 

In his mind it is the one question he missed rather than in reality, he wrote a very marginal bar exam.

The total possible score is some 400 points.  He didn't fail because of his refusal to acknowledge the state law regarding same sex marriages.

He failed because he can't pass the bar.

Independent Branches of the Government
If this a$$hat thinks the rulings of unelected judges are "undemocratic" and "unamerican", perhaps he flunked his bar exam for other reasons.  He needs a refresher in Constitutional Law, specifically the part about how judges are appointed at the federal level, and his state constitutional law as well.

Idiot.

In Massachusetts, as at the federal level, judges are appointed by the executive and confirmed by the Senate.

Furthermore, the state legislature just killed a proposed amendment repealing same sex marriage, so now that democratically elected legislators have (de facto) affirmed same sex marriage here he's going to have a difficult time arguing that it's still an undemocratic feature of the state (if it ever was so).

..in Massachusetts, judges are nominated by the executive and confirmed by the governor's council.  An elected body, but it is separate from the state senate.

THAT'S what the fundamentalists forgot! If only they could have put together enough money for even a single lawyer, fresh out of squeaking through the bar by a single question, why then whole thing might have gone differently.

And of course, once they get a lawyer, the whole thing starts over. They will re-open Goodridge, and this time they will WIN because they never heard a lawyer as good as Stephen Dunne before! And then Stephen Dunne will score the winning touchdown and become President of the United States and be the first to walk on Mars!

Or he could hit the books and work on getting some of those other questions, eh? Maybe save the boasting for when he actually accomplishes something... or for that matter, understands just HOW he is going to accomplish it within our legal system. 

(Incidently, I think that we should all get free chocolate from the moon on thursday.  Just ask for an address where you can send your financial contributions. All or most of the money will go toward helping me pass law school so that I can make your dream, and mine, a reality at last.)

the site is even his?  I looked up the domain name and it does list Stephen Dunne as the "organization name" but this could be some idiot making money off this loser.

Help a dense guy out
Can he sue to overturn legalized gay marriage in Mass. at this point?  It seems to me the issue made it to the courts, was settled, was enacted into law, and a constutitional amendment, quite likely the only remaing tool left for overturning the evil sin of gay marriage, was also defeated.  Isn't it likely the judges will refuse to hear this portion of the case again but might humorously take up the case of a guy suing because he's not QUITE smart enough to actually be a lawyer?

I think he's planning to sue in Federal Court, not State Court.  I'm not an attorney, but it seems to me if he were to sue in State Court it would be thrown out immediately.  It probably will at the Federal Court, too, but my guess is they'll politely tell the dumb ass that there are no federal issues invovled in his complaint, and that on the matter of marriage, it's a state matter.

I maintain that this guy has much more studying to do, since he got 268.8 when the maximum possible score is 400 and is split evenly between MA and multistate topics. The bar exam is hard, sure, but if he studied better on the rest he could skip the question on us gays (or write an inflammatory response if an answer were required) and still pass! He certainly forgot a few details about the criteria for frivilous lawsuits. I wonder at this point if he barely failed on purpose so he could make himself a rich li'l martyr. On the other hand, it will be difficult for him to find work as a lawyer afer all this fuss, except at self-proclaimed Christian law firms.

But in order to PRACTICE law, you need to have a basic UNDERSTANDING of the law.  This dufus obviously doesn't.

Just imagine if this were medicine: 

Question - The patient is experiencing sharp abdominal pain on the right side, nausea, vomiting, fever, etc.

Answer - this is either caused by a small toad living in his gizzard or an imbalance of humors in his body.  Or it could simply be the will of God that he die a horrible death.

Result - Dunne flunks his medical boards.

Action - Dunne complains that 1) his viewpoints are being discriminated against, or 2) his religion is being assailed by common logic.
