The HRC's Bad ENDA Behavior -- And A Cover-Up?

Hypocrisy. It's detestable in elected officials, it's detestable in religious right organizations, and it's particularly detestable in any of our LGBT non-profits and civil rights organizations. So, seeing the HRC caught late last week supporting a non-inclusive ENDA on their website after saying the organization wouldn't -- it leaves a particularly bad taste in my mouth. But worse yet, after being discovered supporting a non-inclusive ENDA on their website, it appears they attempted to cover up their bad behavior.

Let me digress a bit. Monica Roberts spelled out in a clear and cogent diary why many transgender people are no fans of the HRC; I previously wrote in a diary that I wanted a divorce from the HRC; Monica and I didn't like the apparent anti-transgender behavior and public duplicity that has, with regards to transgender people, colorfully checkered the HRC's past.

Well, more recently, the HRC recently stated that it wouldn't support ENDA without "perceived gender" protections:

On Monday [October 2, 2007], the HRC Board of Directors voted to affirm its 2004 decision not to support a version of the Employment Non-Discrimination Act that does not explicitly include protections based on gender identity. We do not support the current version of ENDA that is being considered by the House, and are not advocating for it on the Hill.

Wouldn't it be wonderful if that were completely true.

Marti Abernathey at TransAdvocate.com wrote a piece entitled HRC's Bait and Switch. She highlighted that the HRC was as recently as November 1st was...

...passing off HR. 3685 as transgender inclusive (it's not, gender identity has NEVER been included in 3685) , and asking people to support it! So much for their claim of not supporting 3685, but not opposing it. This is FULL FRONTAL SUPPORT.

If one follows the links in TransAdvocate.com's article; however, one would find that the webpages Marti referenced have been taken down -- apparently, the HRC noted that their webpages indicated hypocritical behavior, and noted that their hypocrisy had been exposed.

Unfortunately for the HRC, Google and MSN caches of the ENDA Take Action and passendanow.org pages were still available (passendanow.org comparison: October 29th cache; November 1st cache).

So much for damage control.

So here's what the HRC said on the now downed pages. On the ENDA Take Action Page, the HRC said:

The U.S. House of Representatives will vote on the Employment Non-Discrimination Act (ENDA) in a matter of days. Now is the time to call your Member of Congress and tell them to vote for H.R. 2015. The capitol switchboard number is 202-225-3121.

That's right. In 31 states, it's still legal to fire someone because they're gay; and in 39 states it is legal to fire someone for being transgender.

Thousands of hardworking GLBT Americans have lost their livelihoods simply because of who they are. The Employment Non-Discrimination Act (ENDA) is a federal bill that would make it illegal to fire, refuse to hire, or refuse to promote employees simply based on sexual orientation or gender identity.

This historic legislation will be up for a vote soon in the U.S. House. But the radical right is flooding lawmakers with misinformation about ENDA.

You can set the facts straight. Call your lawmakers at 202-225-3131 and make sure they know passing ENDA is the American thing to do.


In a link at the bottom of that statement -- a link that took one to passendanow.org -- the HRC's letter read on November 1st as follows:
Dear [Decision Maker],

As your constituent, and a Human Rights Campaign Supporter, I'm writing you to share my strong support for HR 3685, the Employment Non-Discrimination Act, legislation that protects GLBT Americans against discrimination in the workplace.

I know you share my belief in the right of all American workers to be judged by their qualifications, and their job performance - not by the color of their skin, the name of their religion, or the country of their birth.

But, in 31 states, it's still legal to fire someone because they're gay - and in 39 states, it's legal to fire someone for being transgender.

In a country founded upon the principle of equal opportunity, it's time to put an end to this injustice. Corporate America has already taken significant steps toward this goal, with almost 90% of Fortune 500 Companies now including sexual orientation in their non-discrimination policies.

Please support equal employment rights for all Americans.

This post isn't about playing "Gotcha." It also isn't about taking the eyes off the goal of a fully inclusive ENDA -- the voting on which looks to be finally happening this week. However, it is about holding the HRC accountable for saying one thing and doing another -- and then engaging in what a first glance appears to be a cover up of their actions as exposed on TransAdvocate.com.

Is it any wonder that so many transgender people continue to hold the HRC in such low regard?

The broad LGBT community -- and not just the transgender community -- deserve more straightforward behavior from the HRC than they've been demonstrating.

Daimeon sent me an email, reminding me of the HRC's original statement (from their press release) on the HR 3685 version of ENDA:

"Since 2004, HRC has had in place a policy that supports only a fully inclusive version of ENDA and the Board of Directors voted to reaffirm that position," Solmonese continued.  "Therefore, we are not able to support, nor will we encourage Members of Congress to vote against, the newly introduced sexual orientation only bill."

I suggest we start with the United Enda coalition.  Seems to me they represent more of the actul LGBT corwd than HRC ever has.

Seems like NGLTF
has been taking the lead that HRC has dropped.  Despite their lack of "BT" in their title, NGLTF have been pushing hard for meaningful inclusion.  unitedENDA is a new umbrella coalition so can't really lead as an intact org, as far as I am aware.  But please correct me if I'm wrong!

Off Topic, But Important...

Ted Klaudt (R) is on trial for the rape of two foster children in his custody.

Klaudt, a 49-year-old former Republican lawmaker, is charged with four counts of second-degree rape in Hughes County for offenses against two foster daughters. The rapes happened in Pierre during the 2005 and 2006 legislative sessions and one of the offenses happened when one of the girls was a legislative page, prosecutors said.

...

Klaudt is also charged with rape, other sex offenses, witness intimidation and stalking in Corson County, where he lives on a ranch. The trial on those charges is set to begin Nov. 13 in Deadwood.



Why The Transgender Community Hates HRC

The first gay only rights bill, passed in Wisconsin in 1982 has been that way for 25 years now. There's no indication by the GLB leadership in that state if they'll move to rectify the omission of their transgender brothers and sisters or if they'll assign it a priority as high as the one they place on marriage equality.

We also heard the excuses during the 90's to justify the gay and lesbian strategy that ranged from 'the country needs more education on transgender issues', we need 'incremental progress' to the mean-spirited 'it's not your turn to get rights yet'. Ironically there are now more transgender inclusive laws on the books than gay-only ones, and those numbers are increasing.

And where does HRC fit into this equation?

One of the people most responsible for excluding transpeople from an attempt to pass a gay rights law in Minnesota in 1975 was a gentleman by the name of Steve Endean, who in 1980 would leave Minnesota to help found the Human Rights Campaign Fund, the proto organization that later became HRC. Some Minnnesotans assert that it's not a conicidence that the same year HRCF was born in DC, Minnnesota's gay rights proposals became T-inclusive and eventually lead to the first T-inclusive law in 1993.

In 1995 Elizabeth Birch took over as Executive Director of HRC at atime when there was an epidemic of gays and lesbians cutting transpeople out of civil rights legislation.

In many cases gay people who sat on various HRC boards either nationally or regionally led the efforts. In 1999 Dianne Hardy-Garcia, who was the executive director of the Lesbian Gay Rights Lobby (now Equality Texas) at the time and an HRC board member, led the succesesful effort to cut transpeople out of the James Byrd Hate Crime Bill (to mine and TGAIN"s vehement opposition). That bill was eventually killed in the GOP-controlled Texas Senate but passed in 2001 as a GLB only bill and was signed into law by Gov. Rick Perry.

Elizabeth Birch for a while eclipsed Janice Raymond as Transgender Public Enemy Number One when she was quoted at a Chicago GLBT event as stating that transinclusion in ENDA (the Employment and Non Discrimination Act) a top legislative priority of transgender leaders would happen 'over her dead body'.

That sowed the seeds to the growing perception amongst transpeople that HRC was 'The Enemy'. It got worse when transgender lobbyists were told by sitting senators, congressmembers and various staffers that HRC Capitol Hill lobbyists Nancy Buermeyer and Winnie Stachelberg showed up on the Hill accompanied by GenderPac's Riki Wilchins before transgender lobby events in 1997, 1998, and 1999. They asked those members and staffers to tell the transpeople coming to Washington that inclusion in ENDA wasn't possible, but hate crimes was. That revelation so enraged the transgender community that a group of activists that included yours truly founded NTAC in 1999.

After doing an investigative report during the summer of 1999 that determined the extent of HRC co-option of GenderPac leaders, NTAC decided to pursue a multi-pronged strategy to deal with it. They decided to explore partnerships with other GLBT organizations, made it clear that transinclusion in federal ENDA and Hate Crimes was non-negotiable and during my time there I helped author a legislative strategy designed to go around the congressional barriers set up to block transgender inclusion in ENDA

I have been crossposting hers a lot but I wanted to point out that part so that people could read here too. It is why many of us had hoped that ENDA would be different this time around. Pam hope no minded me posting a little more of what she wrote in here it was deeper down not for sure how many actually read everything that why wanted to make it easier to catch a imporant part the top stuff is important too.

 That was so helpful , in connecting to the dots on the dynamics and evolution of the HRC,  for those of us, not keeping such a close eye on 'em. due to other pre occupations under this culture war and general government insanity  That was needed information well consolidated  Oh  boy they sure did keep those = bumper stickers coming for awhile and too many assumed , as you say that the T in a legislation was a given. Bills were and are being passed inclusive , no T bargaining chip..happened right here in NM.  anyhow been following this, and this history is indespensible.

I had another link to another place too but I forgot the link, but it also talked about the divide as well. It's important to understand on why many are upset about this.

breaking news
365gay.com says that HRC, NAACP, AFSCME and others have submitted a letter to congress saying that it is OK to pass non-T ENDA.  I have not been able to find a corroborating report yet. 
Tuesday, however, it appeared there are not the votes to pass an all inclusive version of ENDA and in an open letter to members of Congress, HRC, the NAACP, the National Education Association, the National Employment Lawyers Association, the Religious Action Center of Reform Judaism, the Leadership Conference on Civil Rights, the American Federation of State, County, Municipal Employees and a number of other groups said they would support ENDA without gender identity.
The vote has apparently been postponed...again.

“It seems that the most controversial issue here is our board's position on H.R. 3685, the stripped-down bill that Rep. Frank introduced last week.  We will neither support the bill nor ask members to vote against it.  Let me be clear:  this does not amount to approving of a non-inclusive bill; it does not set up a situation where a non-inclusive bill will pass without gender identity, and it most certainly does not give Congress a "pass."  I will explain in detail below.  

First, we do not "support" the non-inclusive bill.  HRC is not lobbying in favor of H.R. 3685.  We have not mobilized our members in support of it, nor expended resources to secure a vote on it.  HRC cannot throw our resources behind it, because it leaves transgender people behind.  Plain and simple.”

What makes you so sure that the pages you cite were not in error and taken down due to being a mistake? As a professional writer, editor & proofreader I see errors like this all the time.

The HRC must be held acountable

 

 I am so livid, i followed that, i saw it, read it and signed it , giving the HRC the benefit of the doubt - even though i was already furious that they would try to think of abandoning a full inclusive gender identity ENDA in the first place, they called me and i hung up on em no shit . Told em Gender pac would get any pesos i had. CLICK.

  ok....now i feel had - I READ those pages and retractions as quoted above with my own two eyes.   and the NLGTF  the national gay task force. in its incarnation is a lobby group of choice.

    This was no mistake.  It was a chain yanking beyond the pale.  Great post Autumn - thank you for this meticulous coverage.   HRC  rest in peace.  never to be trusted again. EVER

gender pac, co - opted or misled ?

 

  There is a whole lot of stuff going down. Bills  bill numbers..the possible co option of Riki i don't understand..its possible she was outright misled. By a very sneaky mean spirited morally bankrupt divisive HRC - NTAC the strategy of unity always rings true for me.  Any strategy that causes a split or even thought of a split of "gender identity" out of a bill undermines the principle of the entire thing.  ..is bass akwards and exploitive.  AS far as gender pac goes more information is needed for me to catch up...one thing for SURE - HRC is no friend. no friend at all.  Dispicable.
