New York: Appeals court rules state must recognize same-sex Canadian marriages

Woo hoo, what great news to cap off the week! My marriage is legal somewhere in the U.S. (Newsday):

The Appellate Division of state Supreme Court on Friday reversed a judge's ruling in 2006 that Monroe Community College did not have to extend health benefits to an employee's lesbian partner.

Patricia Martinez, a word processing supervisor, sued the school in 2005, arguing that it granted benefits to heterosexual married couples but denied them to Martinez and her partner, Lisa Ann Golden.

The couple formalized their relationship in a civil union ceremony in Vermont in 2001 and were married in Canada in 2004.

The ACLU has issued a press release on the case; the reversal was unanimous:
In a unanimous decision, a New York appellate court today ruled that marriages of same-sex couples entered into outside of New York must be recognized. The case, filed by the New York Civil Liberties Union, is the first appellate court decision in the state and the first known decision in the country to hold that a valid same-sex marriage must be recognized here.

"This is a victory for families, it's a victory for fairness and it's a victory for human rights," said Donna Lieberman, executive director of the NYCLU. "Congratulations to all same-sex couples validly married outside of New York State: You are now considered married in New York as well.   Now we need to work toward a New York where you don't have to cross state or country lines to get married."

..."If a marriage is valid in the state or country in which the marriage took place, New York law generally requires the recognition of that marriage," said Arthur Eisenberg, the NYCLU's legal director. "This case involved a straightforward application of that principle."

..."Today's decision is a great step forward for same-sex couples in New York," said James Esseks, Litigation Director of the Lesbian Gay Bisexual and Transgender Project of the ACLU.  "But there is still lots of work to be done here.  It's now up to the state legislature to finish the job it started last year and pass the marriage bill so that lesbian and gay New Yorkers won't have to leave the state to celebrate their commitments."

I would like to see a constitutional amendment concerning the definition of marriage for two reasons. First, because it evidently needs defining if the courts can't quite comprehend this topic. And second, this social engineering by ultraliberals in academia and the judiciary is not going to slow down or stop until the vast majority makes it clear by dint of constitutional amendments that we have had enough of this nonsense and will amend the document every time in the future that their peculiar initiatives and rulings upset us. Call it the tyranny of the majority if you will, but it sure beats the tyranny of the minority and the tyranny of the judiciary we have at work right now tearing down this great nation.

And it's an unlikely one, is if the NY legislature changes marriage law to specifically not recognize the marriages:
The state Legislature "may decide to prohibit the recognition of same-sex marriages solemnized abroad," the ruling said. "Until it does so, however, such marriages are entitled to recognition in New York."

Canadian Marriages
My partner and I are getting married this April in Ottawa. We planned this weeks before this ruling came down. As a teacher, I am able to add him to my benefits due to an Executive Order in May 2007.

The only thing that concerns me about this ruling is that no one has reported anything about all the state rights that come along with marriage equality. Saw a lot of information about how public and private employers have to recognize the marriage, but couldn't find anything about tax benefits, inheritance rights, etc. In fact, one of the articles by a pro-gay site said that there are over 1300 state rights we still need to work on getting.

So I'm not sure where this ruling leaves us. We'll be talking to a lawyer who deals with issues faced by gay couples, so hopefully she'll be able to sort all this stuff out.

What does make me very happy though is that I can't imagine the state appealing this ruling (at least not very aggressively). AG Cuomo supported Martinez, the Gov is pro-marriage equality and we have a Dem majority in the Assembly that won't allow a so-called DOMA.

It's good to know that when we are traveling throughout the Northeast, we are protected.

I do think that in a year or so, there will be at least ten states that'll recognize the marriages from other states and countries.

The more the merrier for the inevitable hearing before the Supreme Court about marriage equality and the 14th Amendment.

Not long thereafter, mayor Michael Bloomberg stated that he would ask that the city’s five pension systems recognize; domestic partnerships, civil unions and same-sex marriages of city employees performed in other jurisdictions (such as Massachusetts, Canada, New Hampshire, New Jersey, Vermont, Oregon (delayed; pending Feb 08), Maine, Hawaii, Connecticut, California , District of Columbia and Washington) These decisions are being challenged in court.

From the NYT on today's ruling:

Mayor Bloomberg’s office declined to comment on Friday’s ruling, saying it had not seen the decision.

Attorney General Andrew M. Cuomo also declined to comment, noting that his office may be involved in an appeal as the traditional defender of state agencies. Monroe Community College is a branch of the State University of New York.

In the past, Mr. Cuomo has said that state law requires that marriages performed in other states, and in Canada, be recognized in New York.

Weird situation
Because of Mass. laws, a couple from New York can't get a marriage license here--because they can't get one in New York.

However, a married Mass. couple that travels in New York or moves there permanently would have their marriage recognized under this court decision.

So the technical answer to your question is "yes".  But there are obstacles to getting married in Mass. for most out-of-state couples.

IANAL.  Folks should contact GLAD if they need legal advice.

BTW, I predict that as soon as there are other states with marriage equality, the lege here in Mass. will get rid of the non-resident law.  The votes are there already, I believe; it's just a question of not wanting to shit-disturb at the moment.

So, in may when I get married this May in Niagara-on-the Lake, Ontario, I will still be married one mile across the river in New York when we return. Absolutely Wonderful!!!

And to the freepers: Good luck with that amendment of yours, since eight states already have some kind of same sex partner recognition and the longer that goes on, the more the public sees that the sky did not fall.

  Hopefully it will be brought to the front now and honest debate can begin.  The problem is though will the Democratic candidates grow a spine anytime soon?  After all NY is Hillary's state.

She's going to have to come up with some kind of sane answer
Because the old "personal issue" or "religious convictions" saws that have been cited as why she, Obama and Edwards couldn't embrace full marriage equality make no sense. The Republicans are bound to make it an issue. We are talking civil law, not religious law, or individual queasiness about the idea of gays marrying.

Think about it - all three are lawyers and believe that Loving v. Virginia was a correct SCOTUS decision -- superceding state laws prohibiting interracial marriage. All three, conveniently ignore that the legal/Constitutional issues are precisely the same, even down to the religious excuses for denying equal rights.

My advice, and I said that yesterday after asking my question on the Signorile show's LGBT caucus, is that Clinton and Obama just scrap the lame rationalizations and simply say that the matter will end up in SCOTUS, and the best chance to resolve this is to elect them to ensure a more politically balanced SCOTUS engages the case.

That's funny, I told my local ActBlue candidate
almost the exact same words. He was having some challenges with the community here, who he's been supportive of in the past, pushing for a solid I'll-be-your-DOMA-hero commitment.

I told him that it's legitimate to put it back on us with, Hey, I'm as in favor of marriage equality as the next straight guy, but if you want it you're going to have to go see the Supremes--not Diana Ross and Co, the OTHER Supremes--and I'm running for Congress on a repeal-DOMA plank. That's literally all I can do. Has the advantage of being true.

IOW, I don't think he needs to be more Catholic than the Pope on it, he just needs to be in favor of putting us back in the game instead of inside our own end zone.

  Best advice anyone could give them.  And not only when it comes to Marriage Equality, but all the other issues.  

 But since this is about Marriage Equality, I will stick to the subject.  

 As I do agree that the SCOTUS will have the fianl decision regarding all 50 states.  It would also be a win for the democratic candidate that addresses the issue head on with the facts revolving Same-Sex relationships.  You can't remove the ick-factor that many people have regarding what happens behind closed doors, But you can inform people of the true desparities between Heterosexual and Homosexual Marriage.  It was those facts that two people who LOVE each other, Committed to each other are being denied so many rights.  Most people don't know all the rights that Same-Sex couples are denied.  

 The American people want, actually yearn for a politician to be honest.  What better issue other than Marriage Equality could a Politican be more honest about?  

 The War? Gas Prices soaring along with oil company profits?  The cost of Health Care?  The Cost of Medications?

 IMHO, there is too much money to be lost via campaign contributions for those.  The opposition to Marriage Equality out money the LGBT organizations 10 to 1, and they scream the loudest that the LGBT Lobby groups are  finacially strong.  And that is wear they are wrong and they know it.  We are heart strong, there are no large profits to be made regarding Marriage Equality.  It is a Human issue, not a profit issue, and that is why it is a winning issue for who ever stands up for our civil rights.

I know I'm paranoid...
But why does it seem like there has been some huge pro-gay "activist judge" ruling right before every big election, for several years running? In 2006 it was New Jersey.
The normal part of my brain is cheering. The cynical part of my brain says this has been a continued (and fortunately failing,) ploy to motivate the Paulists to action. Will we conveniently get more favorable rulings on October 31st?

I have been hoping that this is the year, after two presidential election cycles of being a wedge issue, when things are so awful that certain easily-manipulated people won't fall for that crap; voting against their own self-interests in favor of a "moral issue" that doesn't actually have any tangible effect on their lives.

Pam, you and your wife are a beautiful couple. Congratulations.  I have no doubt that people will get more comfortable with LGBT couples as they meet more of them.

But what really chilled my spine was the comment in your other thread about needing not to establish an "intent to stay", which could jeopardize your wife's ability to get a legal visa.  What is wrong with us when we are so afraid of immigrants taking our jobs we set up bizarre hoops for foreigners living legally in our country.

My legal spouse and I settled on this side of the border. It's actually not that simple to get residency, but it is possible, and nobody ever referred to me as an alien.
