NY: Out of state same-sex marriages are legal (for now)

This victory nearly slipped under the radar. New York's highest court decided not to review a ruling in February that same-sex marriages performed elsewhere (Massachusetts and Canada, for instance, where Kate and I married), must be recognized by the state.
In a cryptically worded one-sentence order issued on May 6, the New York Court of Appeals, the state's highest, declined, for the time being at least, to review a February 1 appellate court ruling out of Rochester that a lesbian couple, Patricia Martinez and Lisa Ann Golden, who married in Canada in 2004 are entitled to legal recognition of that marriage by Monroe Community College, Martinez's employer.

Since the Rochester ruling is the only New York appellate court ruling - coming from the Appellate Division's 4th Department - on the marriage recognition question issued to date, the decision stands as legal precedent statewide unless contradicted by one of the other appellate departments or reversed by the Court of Appeals.

The Empire State Pride Agenda, New York's statewide LGBT lobby group, taking note of that precedent, was quick to claim victory from the high court demurring on the issue.

"Today's action by New York's highest court means that the state of the law remains the same," said Alan Van Capelle, ESPA's executive director, in a written statement. "Same-sex couples who have gone to places like Canada to get married, or have moved to New York from places like Massachusetts, will continue to be treated as the married couples they are here in New York."

Legislation that would officially legalize marriage equality within the state is still pending, and the key is to ensure there is a pro-marriage majority in the state Senate, and that means turning that body over to Democratic control in the fall.
"Until a law is passed by the New York State Legislature, there will always be the possibility that another court decision could undo Martinez v. County of Monroe and strip away from otherwise legally married same-sex couples all of the 1,324 state-based rights and responsibilities that come with a marriage license in New York," Van Capelle said in his written statement. "Besides, no loving, committed couple should ever have to leave their home state to make sure that their family has the protection and stability of marriage."

How curious that this would break on Friday, when Friday was the first time in 4 years here that I actually saw one colorfully dressed professional male walk another to the corner and give him a "have a nice day" peck.

Like your typical muslim kneeling in public (I've seen more of those here than the other), there is an unmistakeable sense that the performance is just that: a performance, done for effect. That sort of motivation dies out when its audience yawns and loses interest.

IT needs to be settled in the United States Supreme Court. It's a sad day, that people lack common sense and force perversion on everyone. It's no longer "tolerance". It's FORCED acceptance.

More proof a Federal Marriage Amendment is needed.

Of course McCain is essentially FOR homosexual marriage.

i'm rally glad that that freeper
who disdains muslims for public kneeling (although i've never seen that myslef - jonly catholics...) is willing to speak out against false and showy religiosity.  i can't wait to hear him rip into the next wad of fundies he sees publicly "praying" in front of planned parenthood clinic or the state house.

Have a cyberfriend who joyfully told us of his engagement and nuptuals last winter in Toronto.  They live in New York. Didn't know status of their law was under attack, but was glad to see status quo for now. Sent him Congratulations. Also to all others in New York.  

Here is his story ..editted for anonymity, if I can figure out how to post it.

 "Here's a piece of unrelated good news...After twelve wonderful years of togetherness, hubby and I are getting married in Canada. I proposed, he accepted. Thank God!!! Ceremony will be held on December 15th, hubby's 41st birthday. He's not getting any younger. Its time I made an honest man of him."

Thank You!! I can't tell you how blissfully happy I am. I wanted to marry him  after our first date, but hubby had this silly idea about getting to know someone before taking the plunge. Now twelve years later, Here comes the grooms.... We're having a small, quiet chapel ceremony with both our parents attending, if they behave themselves. But we have two very good friends in Canada waiting on standby just in case they don't. No, I'm not kidding!! My sisters are throwing us a reception party upon our return, with both families and friends. Should be an awesome blast.
Most of the wedding plans are completed: Matching tuxs, rings, flowers. Both mothers FINALLY deciding on a dress. At one point they chose the same dress. I don't know how. But hubby's lovely sister intervened and got my future mother-in-law to choose something equally beautiful. Can you say stress!!! We leave next week.
Our wedding was perfect. Despite the forecast for a major snowstorm, we were married in Toronto, with our parents and two friends attending. We wrote our own vows. I never realized how hard it was to put into words how much you love someone. But I managed to say my vows without becoming a crying babbling fool. Thank God it was contagious. Hubby had the same problem. Lxxx and Pxxx were pronounced married at 1:10 pm.

After the ceremony and pictures were taken, our friends hosted a wedding brunch in a very nice restaurant in Rxxx. I had no idea what I ate. Then we went ice skating. So much fun!!! Hubby loves skating. Big time hockey fan. Should've bought along his hockey stick I got him for his birthday and played a game. Everyone was still dress in wedding attire. Why change? My parents checked out of their hotel and took an early flight home. They called me before boarding the plane. Little disappointed, but hardly surprising.
Anyway, we were exhausted and had decided to stay home. Wedding dinner was quiet with hubby and I, and some very good Thai takeout and champagne. Perfect ending to a beautiful and perfect wedding day.

Sunday we stayed inside and watched the snow fall from our warm and very cozy cottage. Little Christmas shopping, dinner and snowball fight, in that order, on Monday. Christmas decorations in downtown Toronto were beautiful! Lots of colorful holiday lights.

We left Toronto last night, with hubby's parents.
Reception party is tonight.

Thank you for the wonderful good wishes! Married life definitely agrees with me. I highly recommend it.

Just a little happy share. So much anymore is a downer.

1. It's not a sad day for New Yorkers.  It's just a sad day for Peter LaBarbera.

2. I hate it when LaBarbera is forcing his "Christian" blowhard lifestyle on us, and he's using the "activist judges" card.  But we do have to recognize that Peter LaBarbera is a crazy fundie, and recognize the fact that the FreakRepublic is an extremist organization.

Of course, we had the original decision a few months ago when all of us ran to change our marital status with our employers.

It really did not raise any kind of particular stir in New York, possibly because there were no television crews showing same sex couples getting married close to local landmarks, since people had to run off to Canada to "get hitched."

If Peter is just noticing now, he is a bit late, amazing given that it is his worst nightmare...taxpayers paying to fund benefits for same-sex spouses of government employees....and Peter, I'll just bet that most of those Lesbians are raising or plan to raise...gasp...children....and are probably Pagans to boot.( huge Pagan festival is held in western NY)

Can't complain about activist Judges either, these Judges made the conservative move and refused to hear the case, upholding a lower court ruling and refusing to reverse..

New York is ours, Peter, and you will forgive me for gloating for a moment...we have suceeded in truly protecting marriage against the forces that would tc cheapen it by making it nothing more than a right wing political tool.

Weddings

My Steve and I were handfasted in Las Vegas, Domestic Partnered in California before it meant anything, legally married in San Francisco ... then unmarried by the Supreme Court of the State ... and married in front of friends and again handfasted on our tenth wedding anniversary.

But last fall Steve really wanted to go to Canada and get married.  He REALLY wanted to.  I put up road blocks.  I knew that the California Court would decide on marriage this summer.  I figured we could wait and see if we could get married in California, our home state.  If not, then we would go to Canada.  But Steve really wanted to go to Canada last fall.  I finally prevailed and we put the money into a big tenth anniversary party.

And then he died before he could have the one thing he wanted more than anything else ... to be legally married to me without the threat of a court invalidating the marriage.  In our next lifetime together I hope I lsten to his wants better.  I wish now I had listened last fall ... though our anniversary was lovely and he enjoyed it immensely.

My congratulations to all the New York couples.  It is wonderful that the high court acted correctly.  Now, if yall can only elect a good state senate this November!

Here's the comment reply of Plainiff Martinez to the Village Voice article which claimed her Canadian marriage was recognized in NY...it's not.

"Hold the presses!

The court hasn't made any ruling, nor has it validated our marriage.

The court merely sent the case back down to the lower court to resolve some small issues such as damages, attorney's fees, etc.

The court sent the case back down because it wasn't yet ready to be argued at the Court of Appeals. Once the lower court resolves the open issues, the case will be re-submitted to the Appellate Court for affirmation. Once that affirmation is received, the county may then apply for leave for appeal.

Hope this clarifies for you.
