TN: brutal trans-bashing by Memphis police officer caught on tape

Our trans brothers and sisters are human beings. How difficult is this concept to grasp for the bigots out there? I'm sick and angered by story after story about grown adults -- in this case a law enforcement officer sworn to serve and protect everyone -- acting like violent brutes out of fear and ignorance. And all the while they are enabled by others who look on and do nothing. Memphis station WMC-TV has the video. You must watch it.
The video, recorded February 12th, shows Duanna Johnson in the booking area at the Shelby County Criminal Justice Center after an arrest for prostitution.   The tape clearly shows a Memphis police officer walk over to Johnson - a transsexual - and hit her in the face several times.

"Actually he was trying to get me to come over to where he was, and I responded by telling him that wasn't my name - that my mother didn't name me a 'faggot' or a 'he-she,' so he got upset and approached me. And that's when it started," Johnson said.

Johnson said the officer was attempting to call her over to be fingerprinted.  She said she chose not respond to the derogatory name the officer called her.

"He said, 'I'm telling you, I'm giving you one more chance to get up.' So I'm looking at him, and he started putting his gloves on, and seen him take out a pair of handcuffs," Johnson said.

The officer went on to hit Ms. Johnson with his handcuffs several times in the face; she said "the third time he hit me, it split my skull and I had blood coming out. So I jumped up." Did it stop then? No. He pulled out the mace and sprayed her.

When a nurse finally came out did she attend to Ms. Johnson, who by this time is handcuffed on the floor? No. She went directly over to the officer to tend to him. You can see it in the video as she walks past Duanna, who is clearly in pain.

And remember, all of this occurred in a booking area, where the officer surely knew he was on tape. That's how brazen this BS is.

The only tiny consolation about this horror story is that the Memphis police officer who held Johnson has been fired, while the assailant is on desk duty while awaiting a hearing.

It's an enraging reminder that while each civil rights gain in the LGBT community is meaningful, we cannot rest until we are all safe, all free from discrimination.

The Tennessee Transgender Political Coalition.was first made aware of this attack several weeks ago, but we did not issue a public statement in deference to Ms. Johnson's attorney's wishes.  Last night's release by Memphis station  WMC-TV of the video, capturing the brutality of the attack, and the indifference to her suffering by other members of the Memphis Police Department as well as by the attending nurse allows us to comment today.

"This reprehensible attack upon a person who was not resisting simply because of her gender expression has no place in a civilized society," said Dr. Marisa Richmond, President of TTPC.  "The brutality of this attack must be dealt with by the judicial system.  If Shelby County District Attorney, William Gibbons, who is reportedly considering a run for Governor in 2010, will not prosecute the officers involved for this obvious hate crime, then he should be removed from office for dereliction of duty," continues Richmond.

This past Saturday, the Memphis Police Department had a recruiting booth at Mid South Pride in Memphis, just steps away from the TTPC booth.  "While we welcome the MPD's outreach effort to the GLBT community of Memphis, the fact that they still have not fired the officer who actually performed the assault calls into question their commitment to opening their doors to gay, lesbian, bisexual, and especially, transgender employees.  Their presence at Pride was an important step, but the video shows how far they have to go," maintains Richmond.

The Tennessee Transgender Political Coalition extends our sympathies and support to Johnson and her legal team.

UPDATE 2: From HRC's release:
The Human Rights Campaign, the nation's largest gay, lesbian, bisexual and transgender civil rights organization, today called for a criminal investigation into the case of polie brutality against a transgender woman. A newly released video out of Memphis, Tennessee clearly shows a police officer brutally abuse Duanna Johnson as she was held in the Shelby County Criminal Justice Center.  Johnson is a transgender woman, and had been arrested on a charge of prostitution.

"This type of profound violence is the exact thing that police officers are supposed to protect people from," said HRC President Joe Solmonese.  "HRC is calling for a full criminal investigation and prosecution to the fullest extent of the law."

...Unfortunately, this is not an isolated incident.  Transgender Americans are often targeted for hate violence.  Hate crimes against transgender people tend to be particularly violent.  Bias-motivated violence against transgender people appears to be epidemic, although statistics are not collected on the incidents of violence against transgender people.  Crimes against transgender people are under-investigated and under-prosecuted.

Meanwhile, the Memphis Police Department confirmed to Action News 5 that the officer holding Johnson was on probation, and has been fired.  The officer who threw the punches is currently on non-enforcement status pending an administrative hearing.

Why should these thugs act any differently if they know that the worst that will happen to them is losing their jobs?  If Duanna Johson had fought back and killed (or, for that matter, even seriously injured) one of these wothless pieces of garbage, she'd already be convicted of capital murder and on her way to the death chamber.  Criminals with badges know that - ultimately - no civilian has any power to stop them from beating the shit out of anyone they want to any time they want to.

A copy of the tape was reviewed by both the FBI and the District Attorney's office, the latter of which dropped all charges against Johnson.  An FBI investigation into possible civil rights violations is still underway.

The Bush junta's FBI doing anything about this?  That's as funny as the video is sad.

Another sad thing...
I'm sure there's people in the DoJ who'd like to do something about cases like this. The question is whether or not their overlords will let them.

Ms. Johnson should have a civil cause of action against not only the attackers, but I would think those who were there and did nothing to protect her. Not that this would be much consolation given what she had to endure.

God this makes me angry. It's hard to internalize that this happened right here in the USA. That is, it's hard to internalize until I remember that the US has the world's highest incarceration rate, an abundance of taser happy police, and a history of police brutality directed at minorities.

I'll be watching (with my video and digital cameras) the major Pride festivities this year in NYC. We have a few thousand more tasers here in NYC as of this week.

Sad but true
I am very Pro-Law Enforcement and 99.9999999% of Cops are awesome human beings (and immediate family).  Sadly, it's the bad apples that get all the attention.

Even without sound it's blatantly obvious the Officer walks right up to her, must have said something derogatory to her which probably made her reply with something unkind prompting the Officer to unjustly begin beating the crap out of her.

I hope he's fired then prosecuted. I really HATE Bad Cops because they make the Good Cops look bad and they make the public distrust Police Officers.

Look, I know it's usual to arrest Black and Latina TGs for prostitution. It happens all the time. But how do you know she broke the law, rather than just being Black and TG?

You see, you make the same assumptions that the police do. They're often right, after all. But we should require some actual evidence first. And in this case, there wasn't any. "No probable cause."

Sickening...
Human's inhumanity toward humans, it never ceases to amaze and agonize me even though it is commonplace.

I hope there is some way that justice can prevail in this case.  I also hope that one day these officers will feel an honest sense of shame and remorse for what they did.  I know that my hopes are unlikely to be fulfilled but without them existence would be unbearable.

I feel that it is important to register my disgust regarding the actions of these officers and to stand in solidarity with my transgender brothers and sisters.

When anyone's basic humanity is questioned, the humanity of all persons is questionable.


I can finally see again
After rubbing the tears from my eyes. This is so blantant, so ugly and so awful it turns my stomach. As a previous poster stated, if she would have fought back, she would be in line for some hefty jail time. As it is, even if they get fired they won't have to pay for drink for a very long time within their little transphobic circle of friends. What's scarier to me personally is knowing that I too, with my trans-status am just one bad turn away from having the same thing happen to me. Especially here in Kerncountry.

Jail house beatings and rapes committed against sex workers aren't all that uncommon.
Along with anti-GLBT harassment and the rising number of murders they highlight the burning need for a hate crimes bill like the one the Democrats ditched. By publically junking the Matthew Sheppard Hate Crimes bill to lure bigoted voters the Democrats went on record saying they didn't care one way or another if we're beaten and killed. Pelosi, Reid, Frank, Clinton and Obama and all the Congressional Democrats bear some of the direct responsibility for these incidents.

Additionally the direct connections between hate speech and hate violence is absolutely clear in this video and illustrates why we need a powerful anti-hate speech law to supplement a hate crimes law. One doesn't work without the other.  

Our community has to respond aggressively to these attacks. I'm glad so see lawyers involved but the leaders of the Memphis GLBT community should consider taking a time out from partisan campaigning to mount a far more important campaign; a campaign to demand that all the police present and their supervisors be fired and lose their pensions. The perp should be prosecuted for aggravated assault they should be prosecuted as accessories.

This beating could have ended tragically for Duanna if this bigoted EuroAmerican pig had made the initial arrest - she could have been taken into an alley and killed. It happens.

The reason it isn't being taken seriously is because the people in control of the Memphis government don't take anything seriously.  I live 3 blocks from where this attack occurred.  The city government has been repeatedly raped by wacko officials who are more corrupt than you could ever imagine.  The mayor just resigned with echos of a sex scandal in the background.  The city is seriously bankrupt and the level of poverty here isn't imaginable.  I just moved here a few months ago after having left the midsouth for years, and forgot how underbelly Memphis is.  Contact Mayor Willy Herenton on Memphis' official webpage.  He should enjoy that.

my god...
   First of all, Ms. Johnson shouldn't of needed to work on the street like that.
Second, I'm sure this pig of a cop DID say something JUST to try and provoke a fight. And Ms. Johnson wasn't resisting, but was being held down in the chair...she wasn't cuffed or put into a cell. Meaning the cops were confident she wasn't a threat in the first place.
 So, they have no defense whatsoever. None.

 I hope she can get monetary compensation that will take her from the streets and therefore such vulnerability to criminals AND cops.
