NC: anti-bullying bill killed

Unbelievable. Let's just look at this from the 30,000-foot view. How on earth is it controversial to protect children from harassment and violence? (N&O):
Sen. Doug Berger, a Franklin County Democrat, said the bullying bill will not be approved this session.

The bill was controversial because it listed "sexual orientation" and other characteristics as reasons schoolchildren might be the targets of bullying. Groups such as the Christian Action League and the N.C. Family Policy Council did not want the term in state law, saying that gay-rights groups would use it to leverage other rights.

Somehow, the bigots at the Christian Action League and the N.C. Family Policy Council scared enough of our Senate Democrats (including State Senator and U.S. Senate candidate Kay Hagan, who supported the bill, but decided not to show up and do her job to help NC students have a safe environment in which to learn). Of course we all know the cultural GOP fossils do the bidding of the far-right fringe organizations here in NC, but if all of these Dems had shown up, the bill would have passed. PFLAG:
In fact, "survey results released on Wednesday by Public Policy Polling (PPP) show that 72% of North Carolinians support this explicitly LGBT inclusive anti-bullying bill. Those in favor of the bill were in the majority in all demographic groups. Additionally, 58% of Republicans supported the measure."
Again, we have to rid our state of representation by Elizabeth Dole. It's clearly a matter of whether one believes that you can be elected in NC and publicly support any LGBT-perceived issues on the record with a vote. After all, this was a bill that would cover  children who may not be gay at all, but simply not conform to gender presentation norms.

It's a strategic question facing our movement and our elected officials and advocates in NC; it's  difficult to see how the hard work people put into moving our rights forward must remain relegated to support in whispered conversations. When will it be "politically safe" to be on-the-record when we cannot even pass a watered-down bill to protect children? That's a statement of exasperation.

This reminds me so much about national level pols who ran from any comment or position-taking on LGBT issues in the last presidential election. It was perceived to be a mine field, because of the fear of the wrath of the professional "Christian" organizations. In 2008, look at the difference, in all of the Dem candidates versus the GOP. Apparently spine-enhancement is a trickle-down sort of thing.

Of course this only further emboldens organizations like the Christian Action League and the N.C. Family Policy Council, even as public support clearly shows elected officials that this bill didn't deserve to be killed.

If you read the entire N&O piece, one of the means to attempt to get a vote on this bill was "pairing," which would facilitate a vote by taking pro votes and setting them opposite nay votes. Senators in opposition were told not to accept pair requests from senators who would have voted for the bill if present, aka Hagan. That in the end killed this. Had the MIAs been present and voted, it would have passed.

Perhaps this information might help those fence sitters and MIAs to think about what they could have done to stop the violence:

GLSEN:

Only nine states and the District of Columbia have comprehensive anti-bullying laws that specifically address bullying and harassment based on sexual orientation and only three of these laws mention gender identity. Nine other states have "generic" anti-bullying laws that do not specifically define "bullying" or enumerate categories of protected classes such as sexual orientation or gender identity. The remaining 32 states have no laws at all. The NSCS found that both states with "generic" anti-bullying laws and states with no law at all had equally high rates of verbal harassment. States with inclusive policies that specifically enumerate categories including sexual orientation and gender identity, however, have significantly lower rates of verbal harassment (31.6% vs. 40.8%).
* Bullying and Gay Youth:  Students hear anti-gay slurs such as "homo", "faggot" and "sissy" about 26 times a day or once every 14 minutes.

Anti-Gay Bullying: What's the Big Deal?

Overall, 61% of students said they knew someone who had been called gay or lesbian. That's the biggest increase of any form of harassment students knew about, up from 51% in 1993. Most other experiences of sexual harassment have remained steady or decreased.

* When asked about their own experiences, 36% say they have "ever" been called lesbian or gay. That's the biggest jump among all the types of harassment students experienced, up from 17% in 1993.

* 19% of boys said they had been called gay "occasionally" or "often," double the rate in 1993 (9%).

* 13% of girls said they had been called lesbian "occasionally" or "often," almost triple the rate in 1993 (5%).

I will have further updates to this post as I contact key people to help bring context to this story (I'm in the middle of a NN session).

You may not be gay, but you may be next.

Kay Hagan...
...deserves to lose.  As much as I can't stand the excessively face-lifted Helms-lovin' alternative, there's simply no reason to add more dead weight to the Democratic caucus in the Senate.

I notice she's polling quite a bit lower than Obama in NC, and I'm not surprised.  There's still time for her to tap into the Dem enthusiasm, but so far, she's been the epitome of uninspiring.

Are Democratic gains expected at the state level in NC?  Maybe they let it drop for now rather than pass it without the list of explicit classes, and they intend to take it up again after the election.  Is that overly naive and optimistic?

Dole has to be stopped
I can't support a sit-out on voting for Hagan, given the alternative. I know there are others who would rather not send a faux-Dem in her place. I actually think Hagan supports many LGBT issues, but wants to do it behind closed doors because of the fear factor. That's a matter of education.

However, as you said, if that means not taking a stand if elected (aka "dead weight"), it's a serious problem.

I just checked my area.
In my district(s)I've got Austin Allran runninf for NC Senate (apparently unopposed) and he seems to be listed as a co-sponsor of NC DOMA

And Mark Hilton (R) is running against Libertarian Lawrence Hollar for the House seat. Hilton was also listed is as co-sponsor for DOMA. I've not been able to find any info yet from Hollar.

I have links to the state legislative site, where it shows the bills they (and other NC senators and representatives) introduced, but wasn't sure if I should post them here or not. If you want I can.

So as far as my little portion of NC I don't hold out much hope for anti-bullying

Hagan was not the problem
Kay Hagan was out most of the week, as were several others. They had expected the session to end before now. Hagan took responsibility to "pair" with another senator on this bill, meaning her presence wouldn't have made a difference. She was a passionate advocate for this bill among her colleagues and pushed to bring it to a vote.

There are people who deserve your anger. Hagan is not one.

FYI: Walter Dalton and Janet Cowell, the other two Democratic state senators running statewide this fall were also great allies on this bill.

I am exasperated that this could have passed, everyone knew it, and it's pretty clear that the only a few votes were needed to pass the bill, and we have no way of knowing who was on the fence, against it, for it, or afraid to go on the record in an election year.

It reminds me of the trans-stripped federal ENDA debacle, when  we were told "we don't have the votes," but we weren't told who those fence sitters or naysayers they expected to vote no were. It's pretty hard to lobby specific people if we don't have names out there with a vote.

The swing votes in the Senate were in the last action alert I posted on a previous thread.  Start looking for the fence sitters there.  Some have opposition in the fall; some don't; one isn't running again.

How about holding some feet to the flames.

Can incidents be reported to the States AG by GLSEN, PFLAG, ACLU, NAACP etc. Just start flooding press releases even snail mail post boxes with reports. With copies of each and every one to KAY HAGAN!.... forget Dole...she forgets you all so easily.

That is actually a great idea
Even if Hagen is on our side, sending info to both the fence sitters and our allies is helpful. It gives our allies ammunition for persuading colleagues if they have copies of the same info that goes to the fence sitters.

This is beyond disappointing
It is one thing to lose when the public overwhelmingly disagrees with you or when the GOP has insurmountable power (ie a veto) but it is quite another to lose here.  Iowa and Kansas of all places have managed to pass decent bills.

We have done a tremendous job of playing defense but a crappy one of playing offense.  There is no excuse for losing this.  If the pairing thing is a last minute problem then our side should refuse all future pairing requests. If it isn't, then Hagan and any other absentee senator should be read the riot act.

I am grateful that we have avoided a marriage amendment, but bungling this bill cost lives.  We need to acknowledge mistakes and change behavior.

if it were up for a public vote, it would have passed, so why aren't these elected officials doing their jobs? No excuse for this.

Since the NC Government is derlicting their duty to protect gay teens.
If your child is gay or lesbian and is bullied, get them out of NC public schools. Homeschool them, get them a GED...


You have got to be kidding me!
It seems like every time I turn around the "leadership" in Raleigh pushes me one step closer to fleeing the state.

I think that the real reason we need to include sexual orientation in the bullying bill is to prevent right wing Christians from claiming that verbally harassing a child due to his or her perceived or actual sexual orientation does not count as harassment because it should be considered free religious speech. Those who opposed this bill, in my opinion, want their children to have the right to bully GLBTQQ children so that they can continue to harass and bully GLBTQQ adults.

I live in a part of the state where it is devastatingly acceptable for children (and adults) to use anti-gays slurs and harass members of the GLBTQQ community. Our communities need the kind of support this bill would have provided. Speech (hopefully)not tolerated while a child is in school is too often tolerated and even encouraged when they are under the care of others. We need these laws to send children a message about what is and is not appropriate behavior, regardless of their personal feelings toward homosexuality, especially when bad behavior is deemed acceptable by the adults in their lives. We also needed this bill because it would have given teachers a leg to stand on when they are confronted by angry, anti-gay parents who do not want their child punished for using anti-gay slurs in the classroom.


I agree totally on the teacher's needing this law
I am lucky to work in a school which is trying to take this somewhat seriously and feel I would be backed up if a parent complained but have definately been in the opposite position.  If you as a teacher care about this issue you are immediately open to charges of being gay yourself which can be difficult.  I really wish this law had passed.

We need this bill because
My car had the words "I'm a fag" carved in the back of it, and because my tires were slashed in the school parking lot twice, and the school administration did nothing.

I wonder if we could get people who were bullied for being LGBT to send their stories in detail to the senate and house if it would help persuade them for the need to protect children.

I am sorry that happened to you
I wonder the same thing.  Honestly, I really would prefer not to tell all of what happened to me when I was in middle and high school.  But I would gladly do so if just one kid could be prevented from going through what I went through.

It is sad
I blogged about this too. A really touching case was reported out of NC.  A 30 something women was raising her lesbian sister after their parents died.  Her poor sister came home from high school in tears of rage or humiliation at least once a week from the verbal assaults she got at school.  She said the school counselors were quite understanding but did nothing.  She and her sister testified before the legislature and really thought the compromise was going to pass.

The author of the compromise was one of those who flipped when the Religious Reich hit him with emails and calls.  What cowards these politicians are.  What cowards these "christians" are.

It truly is outrageous.
