Things Moving Quickly With Prop 8 And The California Supreme Court

From the San Francisco Chronicle's article State high court shows interest in anti-Prop. 8 suits:

The California Supreme Court has asked state Attorney General Jerry Brown to reply by Monday to lawsuits challenging the voter-approved ban on same-sex marriage - a sign that the justices are taking the cases seriously and will not dispose of them quickly.

Two groups of gay and lesbian couples and local governments led by the city of San Francisco filed the suits a day after the Nov. 4 election, when Proposition 8 passed with a 52 percent majority.

They argue that the initiative, a state constitutional amendment, violates other provisions of the California Constitution by taking rights away from a historically persecuted minority group and stripping judges of their power to protect that group. The couples' suits contend that Prop. 8 makes such fundamental changes that it amounts to a constitutional revision, which can be placed on the ballot only by a two-thirds vote of the Legislature.

Brown has said he will defend Prop. 8 in court while also supporting the legality of an estimated 18,000 weddings performed under the court's May 15 ruling legalizing same-sex marriage...

Added the Sacramento Bee:

The state Supreme Court has indicated it may decide whether it will hear the challenge, reject it, or send it first to a lower court by the end of this week. Opponents of Proposition 8 have also started an on-line petition as part of their efforts to put another same Sex Marriage initiative on the ballot next week.

Peaceful Demonstration--PLEASE PASS THIS ON

Sunday, Nov. 16, 2008 at 10 a.m.
at the Mormon Temple in Newport Beach, Calif.

This will be HUGE - Come be a part of civil rights history!
We must expose those whose agenda is to eliminate the fundamental right of same-sex couples to marry by incorporating their religious beliefs into the
California Constitution. The Mormon Church led the support of Proposition 8 with 40% of the financing. This peaceful demonstration will communicate that:
• We intend to continue this fight for equality until it is won
• Discrimination in any form is harmful to our society
• Our Constitution guarantees equal protection of fundamental rights for all
• We insist on an impermeable separation between church and state

LOCATION: The Mormon Temple and Chapel, 2300 Bonita Canyon Dr., at the
corner of Bonita Canyon and Prairie Rd., in Newport Beach. Located just west of
the 73 toll road; exit Bonita Canyon Dr.; or turn east onto Bonita Canyon Dr. from MacArthur Blvd.

PARKING: We urge everyone to arrive early and park in the Bonita Canyon Sports Park, which is off Prairie Rd., opposite St. Matthew's Catholic Church and across the street from the Mormon Temple. Drive past the ballpark to the parking lot on the right. There's also limited street parking. Please DO NOT park at the shopping center at San Miguel and Ford.

BRING: Signs & banners expressing your support for Marriage Equality and Civil Rights, and your outrage at the Yes on 8 Campaign tactics supported by the Mormon Church. American, rainbow and California flags, water.

Can we reappoint judges with the same view
If the judges get recalled in 2010 can we appoint judges with the same view as the ones who got recalled immediately?  

While putting another amendment on the ballot to legalize SSM
  There needs to be another amendment placed on the ballot.  To Make it unconstitutional for Mormons to practice in the State of California We need to protect the Children you know,

And let the Mormons hollar that putting that on the ballot is unconstitutional to be put to a majority vote.  

If I make sense? it was quite by accident.


I'm sure the court
is quite aware of the opaque legal situation the 18,000 married couples are in and want to give them legal clarity as soon as possible.  Not to mention end the illegal withholding of rights asap (if that is what they decide is happening).  If this were triage in the ER, we'd be the code blue patient rushed past the lady with the sprained ankle.  Or so I like to think.

It is too bad the AG doesn't agree that Prop 8 was a revision, not an amendment.  While he has an obligation to defend the laws of the state, he does not have to defend the procedure employed by the proponents of Prop 8 to get on the ballot.  The reason it is unfortunate is that the state taking the same position as the gays would have given the court significant cover to do what we (or at least I) want them to do: determine Prop 8 constitutes a revision.  It is also unfortunate because it probably means AG Brown has given it a serious look and concluded that Prop 8 is not really a revision... and-- most unfortunate of all-- he is probably right.

We have the right to determine the fate of the Attorney General in the 2010 primary for better or for worse.

If making exceptions to the equal protection clause...
...isn't a revision, then the clause is relatively meaningless, isn't it?  In other words, it's open season on any unpopular group.

Brown is a supporter of equality
Because of his position, he must go through the motions as he represents the state in any lawsuits against it.

Unlike Republican Att General Cox [sic] of Michigan who couldn't wait to disenfranchise gays and lesbians of that state once the anti gay marriage amendment passed, Brown is stalling that's all.

Let's hope for a speedy and fair resolution.
I wish I were confident that justice will be done, but either way, it's nice to know where you stand.

And if Prop 8 is upheld, then the sooner we know, the sooner organizing can begin for a counter-amendment, along with any other amusing amendments the community might think of.

with those amusing amendments. If we make a wrong one there could be major backfire.

It's still too much like Prop 8.
If you want a really pointed example of how Prop 8 implies that any state-guaranteed rights are up for popular vote at any time, make it something more blatantly arbitrary.

Make redheads ineligible for entry into the University of California and California State University systems (and back it up with black-and-white photos "proving" that "traditional Americans" all had black and grey hair -- more accurate than the Prop 8 crowd's claims regarding marriage).  Declare the children of married couples ineligible for school-lunch programs.  Withdraw employment nondiscrimination protections for people whose given names start with a vowel or an "L".

Why should WE worry?
Listen, if all it takes is a million signatures to get some questionable amendment on the ballot and if multiple millions will then vote a poisonous piece of crap into existence, then why shouldn't we participate?

I understand the (apparently) inbred need for rationality and moderation and cool practical heads that seem to populate (far too many) attitudes in our (twisted) community, but can we please give it a rest right now?

Haven't we just spent 18 months contorting ourselves into ridiculous positions in order to support a candidate for office that had to vomit off camera any time he was cornered into saying something nice about us?  Many of you won't see it that way, but some of us certainly do.

You cautious - self titled pragmatic - types had your turn and now its time to let your hair down a bit and stand on the sidelines and wring your hands in silence.  The election is over.  Lots of us are pissed off (for various causes) and you know what...it's time for us to join the impact.

Believe me, within 12 months you strategic and timid types will be back on your podiums hosing us hot heads off to make sure the lackluster Democrats aren't embarrassed as they prepare for the 2010 elections.  It is inevitable that the moderate milquetoasty middle will rise up in very little time to demand obedience.  

For right now though - RIGHT NOW - 10 days after Prop 8 and when we have a wave of indignation and rage cresting across the US of A-hole, I am not going to discourage ANY creative and/or vicious and/or vengeful idea from taking shape.

Hell yes, we ought to propose an initiative to ban divorce.  I'd sign.  We all should.  Don't be silly.  It's all about the potential for social disorder - whether or not it even comes close to getting on the ballot.  It is worth the drama in order to make a point to a bunch of dunderheaded knuckle draggers.

In fact - as an even more apt move - I suggest we gather signatures to amend the CA Constitution to eliminate the right of interracial couples to marry.  The rights of inter racial couples were obtained the same way our right to marry was granted and theirs can be taken away in same fashion...if Prop 8 stands.  

IF that point can't be made, then what good is ANY activism on this issue?  The best way to make that point is to begin the work that would make it happen.  

Wait until 2009 to return to chickenshit politics.  For the rest of 2008, can we please act like we have courage, wit and rage?

that we should be soft. If we back a dumbass amendment that gets passed, people will blame us. I'm just warning that if we take things too far, it will do more harm than good.

case of age discrimination to fight prop 8
There may be a case to be made to fight prop 8 on age discrimination. Take the case of a couple where they wanted to marry but one wasn't 18yo before Prop 8 passed. How could CA court justify some gays are legally married in the State, but a younger gay now 18 yo is denied it?

If the kid was 18 at the time, he could have married. Just the same, if this older couple divorces and wants to remarry, they won't be able today... "Age discrimination" argument is fallacious at its core.

Read and educate yourselves.
There are three lawsuits all going after the same thing from three different "plaintiffs": 1) same sex couples who didn't get married yet and want to; married same sex couples; and several counties (SF and Santa Clara) who object to Prop 8 because it prevents their public agencies from fulfilling the Equal Protection clause of the State Constitution.

Pacific Justice Legal group's (the same guy who says gays are like Nazis) letters are the best explanation because of how they object to the lawsuits ie. counties can't get married so they don't have cause to sue.  

BTW Att General of the State of CA, it's his job to represent the state in lawsuits....Jerry Brown is an ally.  Let him do his thing.  Why do you think the Court put him on notice to reply by Monday...he's not into it.  Same before for the re Marriage cases.  Then Att Gen Lockyer just went through the motions as he was on record as supporting marriage equality.


It's going to get struck down-QUICKLY!
