Equal Marriage in Iowa, Closer Than We Think? Queer Orgs "Cautiously Optimistic"

Lambda Legal has dropped a very juicy quote about the upcoming equal marriage case in the Iowa Supreme Court Case:

Last year County Judge Robert Hanson ruled that [Iowa's ban on same-sex marriage] violated the constitutional rights of due process and equal protection....

Lambda Legal, which represents the six couples said it is cautiously optimistic the Supreme Court will uphold Hanson’s ruling.  Lambda attorney Camilla Taylor noted that the Iowa court traditionally has led the nation on civil rights issues, pointing out that the Iowa justices struck down a ban on interracial marriage more than a century before the U.S. Supreme Court declared such laws unconstitutional.

“This is not even a close constitutional call,” Taylor told The Des Moines Register. “If you examine the law in other states, the case law in Iowa is at least as strong, if not stronger. The Iowa Supreme Court has made it clear from its inception that the law includes broader guarantees of equality than federal law.

The Iowa Supreme Court case is this Tuesday @ 10am & will be open to the public according to the receptionist I spoke with. The room that will be available to the public is "The Auditorium". Space may be filled quickly, however inclement weather is expected. You can call the Iowa Supreme Court for more information on public access at (515)281-5174.

What would this mean for the marriage equality movement? The freepers won't be able to claim that queer rights is a quaint "coastal elite" enjoyment, along with expensive double moccha lattes and French wine with cavier.

Iowa is a Midwestern state, no ifs and or buts around it. It is in the heart of the coming battle for marriage equality. I am confident that in 5 years time, All of New England, California and some other coastal states will ring with marriage equality. When these victories are secure, the states often neglected by the LGBT rights national organizations will be ground zero for the marriage equality fight.

The earlier we get a victory in the Midwest, the more time our national organizations have to organize in those states before they become the main focus of the marriage equality movement.

This is about more than marriage, this is about money. The amount of money that we will see pouring into some of these states to support equality will be unprecedented. We will be building a queer infrastructure that will exist well beyond the marriage equality fight.

This means a lot. Barack Obama famously said:

The pundits, the pundits like to slice and dice our country into red states and blue States: red states for Republicans, blue States for Democrats. But I've got news for them, too. We worship an awesome God in the blue states, and we don't like federal agents poking around our libraries in the red states.

We coach little league in the blue states and, yes, we've got some gay friends in the red states.


The future of LGBT activism is "Red State Queer Activism" (although in this case, Iowa is very much a blue state).

Our movement for long enough has been confined to the "gay ghettos" of the coasts and small bastions scattered in other parts of the country.

Our next priority is organizing the existing LGBT infrastructure in Southern and Midwestern states. the Marriage equality movement will push us in that direction.

It's time to reach out to those "gay [and trans] friends in the red states". Our National LGBT movement is about to more closely resemble an actual national movement.

I heard
that unlike the California Supreme Court which has to issue a ruling within 60 days of aural arguments (I think it's 60, might be 90), the Iowa Supreme Court has set amount of time for it to issue a ruling.

Anyone know Iowa's legislature?
Other than the well-known fact that 'There ain't nothin' halfway/About the Iowa way [they] greet you/If they greet you/Which they may not do at all'?

IIRC, this suit responds to a law limiting marriage to opposite sex couples. So the only thing to be concerned by is the possibility of push-back in the form of an amendment.

Also, IIRC, Iowa's constitution requires amendments to be passed through the legislative body.

So, Hawkeyes, what's the situation? (If you're not so pissed about the Music Man joke that you're not speaking to me...)

and apparently the people in the power seats have been blocking former attempts at getting an anti-equality amendment rolling.  but i have no idea whether the legislature is pro-equality on balance and can withstand real pressure after a possible court victory.  hopefull theantidesi can fill us in.

As you'll find in my diaries...
...and/or comments (and which I'm too tired/lazy to link to this reply), we have a DINO governor who told a reporter nearly a year ago he'd summon the legislature (to special session if necessary) to amend the state constitution if the court finds for the plaintiffs. That said, he isn't all that popular among his own party, and Democrats slightly increased their hold on the General Assembly in November.

We also desegregated our lunch counters (and other public accommodations) circa 1949 after a picketing campaign and a lawsuit (http://sdrc.lib.uiowa.edu/iwa/findingaids/html/GriffinEdna.html)--that's right, several years before Rosa Parks had her moment on that bus. Also, a judge in the 1850s refused to allow a black man to be removed from the state (the man had been working near Dubuque to earn his freedom with his master's permission when the master changed his mind and sent slave catchers to retrieve him). So you see, we do sometimes act as if civil rights matter, even in the face of popular resentments.

The process could be quite slow here--one wonders if our Justices are awaiting outcomes in other states. Further, amendments to the state constitution must pass two general assemblies (that's at least a year, given the single annual regular session), then pass muster with the voters (sadly, with a mere simple majority). Iowa is evenly divided
Don't know the pecking order of the Iowa Supreme Court judges. Obama won Iowa in the election and in the caucus.  Are they religious ?  Do they think like Obama about marriage, that "god is in the mix" ?

Same-Sex Marriage is good for the economy.

Obama was also opposed
to these so called "marriage protection" amendements. So if anything, thinking like Obama is the least we should want from them.

Not so fast there, O Cynical One
According to the Des Moines Register:

"Amendments require simple-majority approval of the Iowa House and Senate during two consecutive general assemblies, followed by a simple majority of voters in the next general election. If the court filed its decision early next year, the earliest that a proposed marriage amendment could reach voters is November 2011."

In other words, if the Court follows the precedent of Iowa's cases that point toward limiting government interference with personal choices by upholding the trial judge's opening of marriage, in a decision reached next June--there could be a few thousand couples married in Iowa by the time this hits the legislature.

So that's more like MA and less like CA, in terms of the structure of state lawmaking.

More interesting, though:

"A statewide poll in October found that 28 percent of Iowans support same-sex marriage, and 30 percent would back civil unions. But support for same-sex marriage would increase if the Iowa Supreme Court declares it legal, according to a Big Ten Battleground poll conducted Oct. 19-22. The margin of error was plus or minus 4 percentage points."

So my take-away on the polling is, it was part of a poll taken during the election season. The results have been widely circulated and those which were testable at the ballot box were highly predictive.

In other words: the Supremes know that the professional liars from ADF, who filed amicus briefs to support the state's discrimination, are outside agitators who are strongly supported by a small wedge of Iowans who feel that the Lord wants to run state government. But a plurality of Iowans could give a damn who's married to who, as long as everyone pays taxes and keeps the lawn mowed. Which is a best case scenario.

Don't doubt the ability to rush this amendment through and certainly don't underestimate the stupidity and bigotry of American citizens.

Hey - I'm all for marriage in Iowa.  I wish them luck!!

I wonder what number they will be...by 2011 there could be a few more amendments passed.

To all the dissenters hating on Iowa as unwinnable
My husband and I have been married in Iowa for over a year.  We have found the state to be nothing but firm in it's support for civil liberties.

Iowa is a highly educated population with an extremely strong constitution.  We have a very long history of upholding civil liberties, and the people of Iowa greatly value equality and fairness.

The opponents to marriage in Iowa are mostly Alliance Defense Fund lackeys, and they get a majority of funding from the national anti-marriage orgs.  We have no serious evangelical base, and our most social conservative mainstream religions are considerably more moderate than their southern counterparts.

If we lose in Iowa, we lose.  If you think that Iowa is "lost" because it's not a gay ghetto like San Francisco, that would be the only way we would lose we will lose.  Iowa is a diverse culture that values all citizens.  It is in fact the most important state for us to win, even more so than California.  California is universally despised by the fundies, but no one considers Iowa anything other than the heartland of America.

We must win Iowa.  You must help.  Please do your part to help support One Iowa.

We are blessed with tons of free time to read Pam's House Blend =p.  I would lie if I said everything we said was our idea, but Tim and I discuss things constantly and take our duty very seriously.

My spouse and I are also among the few, the privileged, the married. I didn't want to get famous or become a leader, I wanted specific benefits from the state for my kid.

We've been plaintiffs as well, but since we prevailed in our demands, we were not forced to become famous against our will. During that awful exciting time, we spent a lot of time crafting our presentation.

GLAAD was helpful in providing our small community with a structure in which  to create our own sound bites. But the most important thing is that we take it seriously. It's that corn-fed, wholesome sense of duty that drives us.

You two have made a lot of Midwesterners proud.

I can't speak for everyone, I'm not "hating on Iowa" specifically. I'm just generally tired and bitter after this past election season, and my faith in American sense of fairness has been shattered. "Equal rights" really means "exclusive privilege" and "justice" has been interpreted to mean "just us" and it hurts.

How can we help the cause in Iowa at this juncture?
